unstar this property answer text <p>The Government has agreed a detailed proposal for a UK-EU free trade area which will establish a common rule book for industrial goods and agricultural products and maintain high standards in these areas.</p><p> </p><p>This proposal will protect jobs and livelihoods and ensure that both sides meet their commitments to Northern Ireland and Ireland through the overall future relationship, whilst retaining the constitutional integrity of the United Kingdom and respecting the result of the referendum. Further details are set out in the White Paper.</p><p> </p><p>We are confident that this proposal will work for the UK and the EU and look forward to productive discussions. As a responsible Government we will also continue to prepare for a range of outcomes, including the unlikely scenario in which no mutually satisfactory agreement can be reached.</p><p> </p><p> </p> more like this

unstar this property answer text <p>The Government ran a public consultation in October and November last year on our proposals for legislating for a Victims Payments Scheme. The consultation provided an opportunity for anyone to comment on the shape of the proposed scheme.</p><p> </p><p>In line with the Northern Ireland Office Equality Scheme, we notified our list of consultees - including a wide range of public bodies, political parties, religious and representative organisations - about the consultation. The consultation team also made itself available to meet a range of interested groups and parties to discuss the proposals and the issues arising from them.</p><p> </p><p>We received 367 responses from a variety of parties, individuals, representatives and groups, including the Green Party NI. We carefully considered all written and oral feedback received in making final decisions about the shape of the scheme.</p><p> </p><p>The Northern Ireland Office also engaged with the main parties on the detail of draft guidance that will support the scheme’s independent board in making decisions to award payments.</p>

unstar this property answer text <p>The Government remains focused on re-establishing an inclusive, devolved government that the overwhelming majority of the people in Northern Ireland want to see. Progress has been made in recent discussions which provide a basis for further intensive discussions to resolve outstanding issues. If these further talks are successful, it would be the Government’s intention quickly to bring forward legislation after the Easter recess to allow an Executive to be formed and avoid a second Assembly election. The Secretary of State for Northern Ireland will be keeping the situation under close review.</p> more like this

unstar this property answer text <p>The bespoke mitigation arrangements for Northern Ireland were agreed by the Executive following the “<em>A Fresh Start, the Stormont Agreement and Implementation Plan</em>”.</p><p> </p><p>I understand that the present uncertainty over the future of these schemes has been a cause of considerable concern, especially for those in receipt of the top up payments.</p><p> </p><p>Neither the Northern Ireland Office nor its Ministers can instruct the Northern Ireland Civil Service in the devolved welfare space or direct spending from the NI block grant.</p><p> </p><p>We have however, following the Executive Formation Act, provided departments with additional guidance on the exercise their functions in the public interest in the absence of a restored NI Executive. And of course, we continue to work tirelessly to facilitate the restoration of locally accountable political leadership. I am grateful to the Noble Baroness for raising this matter.</p><p> </p> more like this

unstar this property answer text <p>The amendments made, via schedule 3 of the EU (Withdrawal Agreement) Bill, to sections 6 and 24 of the Northern Ireland Act 1998 mean that the Northern Ireland Assembly, ministers and departments will be acting outside their competence or powers if they legislate or act in a way that breaches the “no diminution” commitment; this would be actionable by judicial review in the normal way. The Government also considers that Article 2(1) of the Protocol is capable of direct effect and that individuals will therefore be able to rely directly on this article before the domestic courts. Individuals will be able to bring proceedings independently or, where the case meets certain criteria, with the assistance of the Northern Ireland Human Rights Commission or the Equality Commission for Northern Ireland.</p> more like this

unstar this property answer text <p>The health and safety of women and girls, and clarity and certainty for the medical profession, is at the forefront of the Government’s approach in complying with the legal duty under section 9 of the Northern Ireland (Executive Formation etc) Act 2019.</p><p> </p><p>As the duty has now come into effect, there have been some immediate changes to the law in Northern Ireland. We do not expect there to be any additional services available ahead of the new legal framework being in place by 31 March 2020. It is important that we get the legal framework right and are confident that service provision in Northern Ireland can meet women and girls’ needs.</p><p> </p><p>In the meantime, women and girls resident in Northern Ireland will be able to continue to access services in England, with all costs of the procedure, including travel and, where needed, accommodation, being paid for from 22 October 2019.</p><p> </p><p>Healthcare professionals who have a conscientious objection should follow guidance from their professional body. We recognise that this is a sensitive issue, and consideration is being given to providing for conscientious objection in the new legal framework for access to abortion in Northern Ireland.</p><p> </p><p>The Government will be shortly consulting on this proposed framework.</p>

unstar this property answer text <p>The health and safety of women and girls, and clarity and certainty for the medical profession, is at the forefront of the Government’s approach in complying with the legal duty under section 9 of the Northern Ireland (Executive Formation etc) Act 2019.</p><p> </p><p>As the duty has now come into effect, there have been some immediate changes to the law in Northern Ireland. We do not expect there to be any additional services available ahead of the new legal framework being in place by 31 March 2020. It is important that we get the legal framework right and are confident that service provision in Northern Ireland can meet women and girls’ needs.</p><p> </p><p>In the meantime, women and girls resident in Northern Ireland will be able to continue to access services in England, with all costs of the procedure, including travel and, where needed, accommodation, being paid for from 22 October 2019.</p><p> </p><p>Healthcare professionals who have a conscientious objection should follow guidance from their professional body. We recognise that this is a sensitive issue, and consideration is being given to providing for conscientious objection in the new legal framework for access to abortion in Northern Ireland.</p><p> </p><p>The Government will be shortly consulting on this proposed framework.</p>
