unstar this property answer text <p>The provisions in Part One of the Civil Liability Act (the Act) apply to the occupants of a motor vehicle whether or not they were injured in the course of their employment. An impact assessment was published following the completion of the Parliamentary passage of the Act, which can be found here: <a href="https://www.gov.uk/government/publications/civil-liability-bill" target="_blank">https://www.gov.uk/government/publications/civil-liability-bill</a>.</p><p>Following implementation, the Government will monitor the management information produced by the new Official Injury Claims service, including data on the impact of the measures implemented through the Act and the supplementary measures to increase the small claims limit for road traffic accident related personal injury claims.</p><p>All claimants, will be able to access the new service which will enable the effective resolution of their claim pre-court proceedings. Claimants will also be able to utilise the low cost small claims track procedure, which is designed to be accessible and uncomplicated should they need to progress their claim through the courts.</p>

unstar this property answer text <p>As an essential public service, Cafcass continues to work hard to maintain its service to children and families during very challenging circumstances. This is a tribute to its leadership and staff at all levels.</p><p> </p><p>At the beginning of the first national lockdown, Cafcass closed all its offices to the public and conducted its work with children, families and the family courts remotely and continued as far as possible to file welfare reports, attend remote hearings and progress cases accordingly. In the summer, Cafcass published protocols setting out how and when its staff attend court in person and on the use of remote video technology and in-person visits to speak with children in their home, in outside spaces such as parks, or at a re-opened Cafcass office from late July.</p><p> </p><p>On 17 November Cafcass published new guidance setting out its approach to working with children and families during the ongoing Covid 19 pandemic. It is Cafcass’ priority to see children and families in person when it is in their best interest to do so, and this will depend on the particular circumstances in each case. From the end of November all Cafcass offices and touchdown locations will be open to provide Covid-secure places to work and to meet children and families while keeping safe. Cafcass will continue to review and ensure that all these measures are in accordance with government and public health guidance.</p><p> </p><p>In terms of the impact of remote hearings on Cafcass, research by the Nuffield Family Justice Observatory published in October shows that most professionals, including Cafcass staff, feel that overall the courts are now working more effectively and that there are even some benefits from remote working. However, the report also highlights some areas of concern that need to be addressed. There are clearly circumstances where more support is required to enable parents and young people to take part in remote hearings effectively, and this is under consideration by the senior family judiciary.</p><p> </p><p>Cafcass continues to experience high levels of demand for its services while managing a rise in the number of open cases due to a reduction in case disposals. The Ministry of Justice has allocated an additional £3.4m this year to help Cafcass meet these challenges. Cafcass has put in place a protocol to enable it, where necessary, to prioritise cases in local service areas so that it can continue to meet the needs of the most vulnerable children and families.</p>

The final evaluation criteria is under development and details are neither finalised nor in the public domain. On that basis the draft evaluation criteria which detail the weightings are currently commercially sensitive and cannot be released at this stage.</p><p> </p><p>However, the contracts for both services will include clauses requiring compliance in relation to Welsh language. The evaluation takes into account a variety of measures and the assessment of Welsh language is being considered as part of the on-going work to finalise evaluation criteria and other tender documentation.</p> more like this

This includes considering whether redactions need to be made. Lady Justice Macur has herself recommended that certain material should be considered for redaction before publication.</p> more like this

unstar this property answer text <p>Probate Services provided by Her Majesty’s Courts &amp; Tribunals Service (HMCTS) have been designed and developed incorporating user feedback. The user satisfaction rate measured at the time the customer submits their application (the point at which they finish their interaction with our online process) remains consistent at 92%.</p><p> </p><p>HMCTS welcomes customer views throughout their interaction with its services, including after the application has been made. The agency’s formal complaints and praise procedure is available for this purpose and customers can engage with it at the court, on the phone, or online at GOV.UK. Feedback is used to inform ongoing service improvement. In respect of probate HMCTS received feedback from applicants on their concerns in a number of ways. The agency has recruited more staff to address a peak of workload and is now issuing in excess of 1,000 grants a day, which has led to reductions in waiting times.</p> more like this

unstar this property answer text <p>a) The Approved Enforcement Agency (AEA) contracts were due to commence on the 1<sup>st</sup> June 2020. MOJ has delayed service commencement from 1<sup>st</sup> June 2020 to 1<sup>st</sup> September 2020, this decision was in part to support the financial position of incoming providers as well as ensuring readiness for service commencement, taking into consideration the restrictions placed upon enforcement by the statutory instrument.</p><p> </p><p>A robust assessment of the incoming service providers’ financial standing was performed as part of the open tender that took place for the AEA contracts. This is recent and comprehensive assessment of the service providers’ financial positioning.</p><p> </p><p>The MOJ has an established contractual relationship with the incoming service providers. There has been regular engagement with service providers from the point of contract award at the beginning of the year. From the onset of Covid-19, engagement has continued to understand and assess the operational and financial impact and whether service providers were likely to seek any contractual relief to support long term service provision. These discussions are ongoing.</p><p> </p><p>The contracts obligate the service providers to notify the Authority of any financial distress event, as defined in the contract, alongside the obligations to ensure regular monitoring of defined financial indicators. MOJ has not received any such notification.</p><p> </p><p>b) The contracts introduced a structured governance process throughout the implementation period which monitors and manages the readiness of parties to commence service delivery against previously reviewed and approved implementation plans. The progress is assessed on a fortnightly basis in addition to ad hoc engagement on specific elements of the plan as identified by the relevant leads.</p><p> </p><p>The delay to service commencement (from 1 June to 1 September) has enabled confidence in the ability of all parties to commence services from 1 September. Issues and risks related to Covid-19 have been identified with an appropriate management strategy. These have been built into the implementation plans and reports provided to the MOJ, and we remain confident of service delivery to the required timescales and in line with the service providers’ bids. The MOJ is continuing to develop the practices, processes and procedures in response to Covid-19 health and safety and are continually discussing these with service providers.</p><p> </p><p>The MOJ has no reason to believe the service providers are unable to carry out the contract deliverables.</p><p> </p>
