star this property answer text <p>In the First-tier Tribunal (Special Needs and Disability) (SEND), all appeals are listed for hearing on the next available date, on receipt. If the hearing date allocated is unsuitable for whatever reason, the cancellation of the original hearing date is counted as a postponement in the SEND tribunal’s case-handling system – GAPS2. If that second hearing is cancelled and the case re-listed, that is counted as another postponement in the system. As part of that review, the Government invited the Law Commission to make recommendations about how marriage by humanist and other non-religious belief organisations could be incorporated into a revised or new scheme for all marriages that is simple, fair and consistent. The Government will decide on provision on the basis of the Law Commission's recommendations.</p><p>The Law Commission published a consultation paper on 3 September 2020 as part of its review and will welcome responses from all.</p> more like this

This is an important and complex social policy reform and requires careful thought and consideration.</p><p>The Law Commission published its consultation paper on 3 September 2020 and the Government, following the final report, will decide on provision on the basis of the Law Commission’s recommendations.</p><p>In parallel, the Government made clear when it announced the Law Commission project that it would also, as an interim measure, undertake work to allow more civil weddings and civil partnerships to take place outdoors through secondary legislation. star this property answer text <p>Between the period of 01/07/19 - 30/06/2020 the biggest pay rise given to someone in the Department was (a) 7.6 in percentage terms and (b) £7,059 in cash terms.</p><p>This pay increase, determined through the independent Prison Service Pay Review Body process and calculated as a percentage increase, was for Prison Service staff. HMPPS received the highest pay rise.</p><p>Figures are based on staff in post as at 30 June who received their pay awards in September which were backdated to 1 April. Figures do not include annual pay increases for staff in the National Probation Service which have yet to be confirmed and paid and excludes pay award for SCS grades as not yet implemented.</p> more like this

The total number of individuals convicted and sentence outcomes for offences under the Animal Welfare Act 2006, can be obtained by selecting the following HO codes: 10829, 10830, 10831, 10832, 10833, 10834, 10835, 10836, 10837, 10838, 10839, 09701, 09702, 09703, 09704, 09705.</p><p>However, whether the offence was committed by a pet owner against their pet is not held centrally in the Court Proceedings Database. This information may be held on court records but to examine individual court records would be of disproportionate costs.</p>

star this property answer text <p>The number of prisoners serving a sentence of imprisonment for public protection (IPP) in each prison in (a) England and (b) Wales as at 30 June 2020 is set out in Table 1. The figures are a subset of those published in Offender Management Statistics Quarterly: <a href="https://www.gov.uk/government/collections/offender-management-statistics-quarterly" target="_blank">https://www.gov.uk/government/collections/offender-management-statistics-quarterly</a></p><p>A prisoner serving an IPP sentence will be released only when the independent Parole Board concludes that the risk s/he presents to the public is capable of being safely managed in the community on licence.</p><p>IPP prisoners continue to have a high chance of a positive outcome from Parole Board hearings. In 2019/20 72% of Parole Board hearings resulted in either a recommendation for a transfer to an open prison or release. As of 30 June 2020, the number of unreleased IPP prisoners who have completed their minimum tariff was 1,856. star this property answer text <p>As at 30 June 2020, the ten longest lengths of time post tariff and before first release which a prisoner on a sentence of imprisonment for public protection (IPP) has served are set out in the table below. The same table shows the recorded ethnicity of each of the ten prisoners.</p><p> </p><p>Our primary responsibility is to protect the public. A prisoner serving an IPP sentence will be released only when the independent Parole Board concludes that the risk to the public is capable of being safely managed in the community on licence. star this property answer text <p>The department’s technology priority since the beginning of the Covid-19 outbreak has been focused on enabling communication between prisoners and their families and friends.</p><p>Since the beginning of March, this has resulted in the deployment of over 1000 secure mobile phones to complement existing in-cell telephones and wing phones.</p><p>We have deployed nearly 250 tablets for compassionate calls across all public prisons in England and Wales and most significantly we have deployed video calls across 105 sites to enable an interim alternative whilst face-to-face meetings were suspended. There are still 7 sites which are yet to have fully operational video visits, these are being worked on by our teams as a priority. Over 27,000 video calls have been made so far.</p><p>As announced in June, £20m was secured to increase technology infrastructure across the estate. This work is enabling additional video-conferencing facilities and the extension of in-cell technology across sites with existing network infrastructure.</p><p>This complements existing work to install technology across the entire youth estate, which will support education and rehabilitation by providing secure access to appropriate content on laptops via our Content Hub. The Content Hub provides access to education materials such as maths exercises, books supporting people learning to read, and specific vocational learning materials (including customer service skills, food safety awareness, and Khan Academy materials to support people learning to be electricians).</p><p>During the COVID-19 crisis, additional education services have been added to the Content Hub, including mindfulness tools, in-cell exercises, and audio books to support the residents during longer periods in cells. National Prison Radio shows have also been used to keep residents calm and to reduce frustration.</p><p>The use of secure technology to enable the safe delivery of education in-cell is a key part of our strategy to improve rehabilitation, get more prisoners ready for jobs on release and reduce reoffending. We continue to consider the recommendations of the Farmer Review when prioritising future deployment of technology.</p>

star this property answer text <p>Government departments are mandated to use Crown Commercial Services (CCS) Energy frameworks for the supply of electricity. EDF is the current supplier and the current arrangement lasts until March 2022.</p><p> </p><p>We are exploring with CCS how to increase the percentage of energy sourced from renewables. This includes the feasibility of changing the current percentage mix, the costs of securing matched renewable energy through obtaining Renewable Energy Guarantees of Origination (REGOs), and the timescales for doing so.</p><p> </p><p>To date the Department has prioritised energy efficiency and spend to save investment on its estate. But as part of the MoJ’s commitment to achieve net zero by 2050 or sooner, the Department is exploring options for increased on-site renewable energy generation, and low and no carbon energy supply.</p> more like this

star this property answer text <p>Data showing the trends for and levels of violence in prisons is published in the quarterly in the government’s Safety in Custody statistics publication:<br> <br> <a href="https://www.gov.uk/government/collections/safety-in-custody-statistics" target="_blank">https://www.gov.uk/government/collections/safety-in-custody-statistics</a></p><p>The most recent data shows a decrease in assault incidents in the 12 months to March 2020, which are down 8% from the previous year. This included a 5% decrease in assaults on staff and a 7% reduction in serious assault from the previous 12 months. Assaults have now fallen for the last three published quarters.</p><p>Despite the progress made, the level of violence in prisons remains too high and we continue to work hard to address this. We are giving staff the tools and training to help them reduce violence including embedding the Challenge, Support and Intervention Plan to support those at risk of violence, the roll-out of PAVA incapacitant spray and implementing key work across the prison estate. We are also increasing staffing numbers, and investing in £100 million in tough security measures to keep the illicit items which fuel violence out of prisons.</p>

star this property answer text <p>A prisoner is released in error if they are released earlier than their correct release date, they will be unlawfully at large until and unless they are subsequently released correctly or returned to custody. If the person released is not aware of the error and makes no attempt to evade arrest, then they have committed no offence and, in that sense, they may not be at fault.</p><p> </p><p>Releases in error are monitored closely to analyse the frequency across the estate and identify any trends nationally, while taking into consideration the management of risk to the public.</p><p> </p><p>(i) How many prisoners released in error had been convicted of rape; and for how long these prisoners remained at large before being returned to custody</p><p> </p><p>If a request is made for information where very small numbers are involved, the MoJ must consider whether this could lead to the identification of individuals. Since the total number of prisoners released in error where their main offence was rape is two or fewer, we are not able to give further details either by year or for the whole period.</p>

In order to comply with contemporaneous Government directions on Covid-19 prisoners would have to have suitable accommodation and healthcare provision available outside of custody.</p><p> </p><p>When considering who would be eligible for the scheme, establishments assessed their entire populations to find those potentially eligible based on sentence length, and offence type among other factors. Those who met the initial criteria were then assessed based on their behaviour in custody and healthcare needs among other factors prior to deciding if they were suitable for release. Data on the number of prisoners who reached the final stages of risk assessment for the ECTR could only be obtained at disproportionate cost.</p>

star this property answer text <p>As at 7 January 2022, the total operational capacity of prisons in England and Wales was 81,291.</p><p> </p><p>The Ministry of Justice (MoJ) publishes weekly prison population and capacity information through the following link: <a href="https://www.gov.uk/government/collections/prison-population-statistics-2022" target="_blank">https://www.gov.uk/government/collections/prison-population-statistics-2022</a></p><p> </p><p>We are committed to building as many prison places as we need. Over the next ten years, additional capacity will come in to use for a range of reasons, including new build prison accommodation, existing accommodation returning to use following the completion of essential maintenance or places coming into use following a change in function. We are investing £3.8 billion to deliver 20,000 additional, modern prison places including 2,000 temporary prison places across England and Wales. This includes creating four new prisons over the next six years and expanding another four prisons over the next three years. The first of these, HMP Five Wells in Northamptonshire, is due to open in February and work is also well underway at Glen Parva, Leicestershire.</p>

star this property answer text <p>As of January 2022, the only prison currently being built in England and Wales is Glen Parva (Leicestershire), due to open in spring 2023. Minor post-completion work is being carried out at HMP Five Wells (Wellingborough) which is due to open in early 2022. Each will provide c.1,680 modern prison places. We have started enabling work in preparation for the construction of a new prison next to HMP Full Sutton after receiving full planning permission. It is due to open in 2025.</p><p> </p><p>As of January 2022, a major programme of refurbishment is underway at HMP Liverpool.</p> more like this

star this property answer text <p>The Ministry of Justice does not hold centrally a record of those IPP prisoners who were residing in Birmingham at the point they were sentenced to their IPP.</p><p>The Ministry of Justice does hold the number of prisoners serving a sentence of imprisonment for public protection (IPP) and (a) their ethnicity in England and Wales, and I have provided the proportions as requested in the table below.</p><p>The Ministry of Justice does not hold centrally a record of the diagnosed mental and physical condition of serving IPP prisoners.</p><p>Every prison in England and Wales must adhere to the Equality Act 2010. This includes support for those with mental and physical health conditions, such as the duty to make reasonable adjustments for disabled persons, in accordance with the Public Sector Equality Duty.</p><p>Since April 2018, a National Partnership Agreement on Prison Healthcare has been in place, to deliver safe, decent, effective healthcare for offenders.</p><p>Our primary responsibility is to protect the public. Prisoners serving IPP sentences will be released only when the independent Parole Board concludes that the risk to the public is capable of being safely managed in the community under probation supervision.</p><p>IPP prisoners continue to have a high chance of a positive outcome from Parole Board hearings. In 2019/20 72% of Parole Board hearings resulted in either a recommendation for a transfer to an open prison or release. As of 30 June 2020, the number of unreleased IPP prisoners who have completed their minimum tariff was 1,856. We are discussing the benefits and risks of this proposal with Registry Trust Ltd to inform an assessment of whether to make reforms in this area.</p><p>We recognise that this proposal could reduce the number of enquiries about claimant data that are received by HM Courts and Tribunals Service (HMCTS). We do not, however, hold data to allow us to estimate the number of enquiries that are received by HMCTS asking for information about claimant data.</p> more like this

The use of police cells is part of normal business: recently, however, there has been a significant increase in demand, prompting the formal request to implement Operation Safeguard.</p><p>An initial £14 million has been allocated, based on a three-month forecast requirement.</p><p>The total cost to the Ministry of Justice will depend on the number of cells occupied under Operation Safeguard and how long they are occupied for.</p> more like this

HM Courts &amp; Tribunals Service continue to review capacity requirements across the estate and where necessary we will consider additional temporary court provision. star this property answer text <p>HMCTS is committed to ensuring the health, safety and welfare of all members of its staff, and takes its duty of care towards members of the judiciary, contractors and to court and tribunal users extremely seriously. In the event of any person testing positive for Covid-19, prompt action is taken, in line with public health guidance, to minimise the risk of further transmission within our buildings and maximise our ability to keep the site open and operational.</p><p>Since the start of the pandemic, HMCTS has increased its cleaning regime significantly with additional cleaners regularly cleaning frequently touched areas throughout the day, and to undertake deep cleans where an individual either shows symptoms or has tested positive.</p><p>Detailed guidance is available to all staff and is subject to continuous review to ensure it remains consistent with advice from Public Health organisations and HM government.</p> more like this

star this property answer text <p>HMCTS is committed to ensuring the health and safety of everyone working in and using the courts and tribunals; and to ensuring access to the justice system is maintained despite the public health crisis. Since the start of the pandemic, it has taken a number of steps to ensure that courts and tribunals can remain operational, including in the event of a local outbreak.</p><p>Steps being taken include significantly increasing the cleaning regime, with additional cleaners brought in to sanitise frequently touched surfaces, making hand wash and sanitiser available to anyone within the buildings, and using visible queues to ensure that people adhere to social distancing. HMCTS has also introduced measures including plexiglass screens and the requirement (unless exempt) to wear face coverings in all public areas of courts and tribunals across England and Wales.</p><p>Court and tribunal staff are following central government guidance and a significant number continue to work from home. Those whose roles require them to work in a physical office are working in risk assessed Covid-secure conditions. But HMCTS and the judiciary are working hard to ensure access to justice can be facilitated in new and innovative ways, too. The number of hearings being held virtually has increased substantially throughout the pandemic, helping to reduce the number of people required to work in or attend physical buildings.</p><p>Dealing with local outbreaks must be managed on a case by case basis, working with local health officials and following public health guidance to ensure the most effective measures to control and limit transmission of the virus.</p>

The Ministry of Justice is appointing the National Association of Child Contact Centres (NACCC) as the administrators of the grant for this financial year. His Majesty’s Prison and Probation Service and police forces are in the process of jointly planning how and where these places will be accessed if needed.</p><p>Police forces across the country already use police cells occasionally to hold prisoners overnight, for example due to late sitting courts. The triggering of Operation Safeguard expands this practice and is not an unprecedented move, having already been triggered in 2007. It is an established procedure that has been used before to ensure that our prison system can operate effectively and safely during periods of high demand.</p> more like this

The responsibility for regulating the sector sits with the approved regulators, overseen by the Legal Services Board (LSB). The Solicitors Regulation Authority (SRA) is responsible for regulating the professional conduct of solicitors, as well as most law firms in England and Wales. The SRA’s role involves protecting clients and the public.</p><p>The SRA works closely with firms to ensure that consumers’ interests are protected. Their website provides clear guidance for firms that are falling into administration and warns that they will intervene if consumers’ interests are at risk:<a href="https://www.sra.org.uk/solicitors/guidance/closing-down-your-practice/" target="_blank"> https://www.sra.org.uk/solicitors/guidance/closing-down-your-practice/.</a></p><p>The SRA also provides guidance for consumers affected by their law firm’s closure: <a href="https://www.sra.org.uk/consumers/problems/solicitor-closed-down/intervention/" target="_blank">https://www.sra.org.uk/consumers/problems/solicitor-closed-down/intervention/</a>.</p><p>The Legal Ombudsman (LeO) is also able to support consumers with concerns about law firms who are no longer operational. Notably, there are requirements in respect of the advertising and publication of an insolvency so that creditors and other interested parties are made aware. Lawyers involved in setting up trusts are subject to regulation by independent regulators.</p><p>The Solicitors Regulation Authority (SRA) is responsible for regulating the professional conduct of solicitors, as well as most law firms in England and Wales. The SRA’s role involves protecting clients and the public, which means they have powers to prevent solicitors in breach of their standards and regulations from practising.</p><p>Complaints about solicitors’ poor behaviour and conduct can be made via their website at <a href="https://www.sra.org.uk/consumers/problems/report-solicitor/" target="_blank">https://www.sra.org.uk/consumers/problems/report-solicitor/</a>. If found in breach of said standards and regulations, the SRA has the power to impose a disciplinary sanction against a firm or individual. star this property answer text <p>Between April 2018 and March 2023, there were 25,323 positive rMDT tests for both traditional drugs and psychoactive substances. Data for April to December 2023 will be published as part of the 2023-24 Annual Digest.</p><p>No new Official Statistics on rMDT positivity have been published since the year to March 2020, because since the start of the COVID pandemic testing levels and the number of prisons with sufficient testing have been too low to provide robust data.</p><p>The range of drugs tested in the rMDT panel is subject to change in response to new emerging drug types and new patterns of drug use. This is necessary to ensure our testing approach is targeting the right substances. These limitations mean no robust rate of positive tests can be calculated from the above data and this number of positive tests should not be compared to the number of tests.</p><p><em>Care is taken when processing and analysing returns, but the detail is subject to the inaccuracies inherent in any large-scale recording system. Although shown to the last case, the figures may not be accurate to that level.</em></p><p><em>This does not include tests that were spoilt or lost in transit on the way to the laboratory.</em></p>
