unstar this property answer text
Income from the Victim Surcharge contributes to the Ministry of Justices’ Victim and Witness Budget (“the Budget”). This budget is used to fund Police and Crime Commissioners (PCCs) who commission local support services for victims, and nationally commissioned support services including the National Homicide Service, Rape Support Centres, and the Court Based Witness Service. Income from the Victim Surcharge is forecast into the Budget at the beginning of each financial year. However, actual income raised from the Surcharge will fluctuate each year (depending on the amount imposed and collection rates). Should revenue raised from the Surcharge go above the forecast amount, the excess is put towards compensating victims through the Criminal Injuries Compensation Scheme.

Overall amounts are set out in the table below:

Financial Year

Victim Surcharge (VS) Collected *[1]

VS contribution to the Victim and Witness Budget*

Overall Victim and Witness Budget*

2010/11

£1<ins class="ministerial">1</ins><del class="ministerial">0</del>m

£1<ins class="ministerial">1</ins><del class="ministerial">0</del>m

£48m

2011/12

£10m

£10m

£48m

2012/13

£1<ins class="ministerial">1</ins><del class="ministerial">0</del>m

£1<ins class="ministerial">1</ins><del class="ministerial">0</del>m

£50m

2013/14

£<ins class="ministerial">20</ins><del class="ministerial">19</del>m

£<ins class="ministerial">20</ins><del class="ministerial">19</del>m

£57m

2014/15

£2<ins class="ministerial">5</ins><del class="ministerial">4</del>m

£2<ins class="ministerial">5</ins><del class="ministerial">4</del>m

£86m

2015/16

£28m

£18m

£92m

2016/17

£31m

£2<ins class="ministerial">7</ins><del class="ministerial">6</del>m

£96m

2017/18

£35m

£31m

£97m

*The amounts listed in the table have been rounded to the nearest £1<del class="ministerial">0</del>m.

unstar this property answer text

Police recorded domestic abuse crimes have increased by over 60% in the last three years, demonstrating increased victim confidence to report and better police recording of these crimes. Overall, prosecutions and convictions for domestic abuse are both up since 2010 – by 20 per cent and 28 per cent respectively, with 76% of all prosecutions resulting in successful convictions, the highest proportion since 2010. However, the CPS are working closely with the police locally and nationally to ensure appropriate referrals are made by the police and to address any fall in referrals where needed. In November last year, MHCLG awarded £22 million for domestic abuse projects across the country. This is helping to provide over 2,200 new beds in refuges and other safe accommodation, as well as access to education and tailored employment and life skills guidance. MHCLG are also consulting on potential measure for sustainable delivery of support for victims and their children in accommodation-based services for domestic abuse across England. The Consultation ends on 2 August. https://www.gov.uk/government/consultations/support-for-victims-of-domestic-abuse-in-safe-accommodation The figures below relate to legal aid at the Civil Representation level. Legal aid for these matters is also available by way of initial advice and assistance under the Legal Help scheme. Application and percentage data is not held for Legal Help matters, as the decision on whether to grant funding is devolved to the solicitor in question.

Financial Year

Domestic Violence Applications

Granted

Proportion Granted

2010-11

19,951

17,995

90%

2011-12

17,652

16,187

92%

2012-13

17,406

15,812

91%

2013-14

16,925

15,306

90%

2014-15

15,662

14,114

90%

2015-16

14,748

13,574

92%

2016-17

14,092

13,349

95%

2017-18

14,188

13,446

95%

2018-19*

10,200

9,499

93%

Financial Year

Injunction Applications

Granted

Proportion Granted

2010-11

19,951

17,995

90%

2011-12

17,647

16,182

92%

2012-13

17,395

15,802

91%

2013-14

16,925

15,306

90%

2014-15

15,661

14,114

90%

2015-16

14,746

13,572

92%

2016-17

14,090

13,349

95%

2017-18

14,188

13,446

95%

2018-19

10,200

9,499

93%

*(Apr to Dec 2018) Please note that injunction figures, although being separately reported on here, are included as part of the ‘Domestic Violence’ category volumes displayed in the first table.

unstar this property answer text
The criteria used by the Criminal Injuries Compensation Authority in determining whether an applicant cannot afford the cost of obtaining medical evidence is outlined in its internal guidance. This states:

If the applicant tells us they cannot afford to obtain medical evidence we may meet the cost of doing so and deduct it from any award we make, up to a maximum of £50. However, before we do so you should ask the applicant for evidence of their inability to meet the cost. You should consider all the relevant circumstances in deciding whether you accept the applicant cannot afford to pay for the medical evidence. Some factors you should consider include:

• whether they are relying solely on any of the benefits listed [as Jobseeker’s Allowance or low-income benefits on gov.uk];

• whether they have a low income and are in receipt of any of the tax credits as listed [on gov.uk]

• whether they earn less than the minimum amount needed to qualify for Statutory Sick Pay as evidenced by a pay statement or letter from their employer or, if self-employed, copies of their most recent tax returns; or

• whether they are struggling to manage significant debts, bankruptcy or insolvency.

unstar this property answer text
The Victim and Witness Budget, which is used to fund support service for victims and witnesses, is set each year and includes a forecasted contribution from revenue raised through the Victim Surcharge. Between 2015/16 and 2018/19 the revenue raised from the Surcharge surpassed the forecasted contribution, so the excess was put towards compensating victims of violent crime through the Criminal Injuries Compensation Scheme. unstar this property answer text
Income from the Victim Surcharge contributes to the Ministry of Justices’ Victim and Witness Budget (“the Budget”). This budget is used to fund Police and Crime Commissioners (PCCs) who commission local support services for victims, and nationally commissioned support services including the National Homicide Service, Rape Support Centres, and the Court Based Witness Service. Income from the Victim Surcharge is forecast into the Budget at the beginning of each financial year. However, actual income raised from the Surcharge will fluctuate each year (depending on the amount imposed and collection rates). Should revenue raised from the Surcharge go above the forecast amount, the excess is put towards compensating victims through the Criminal Injuries Compensation Scheme.

Overall amounts are set out in the table below:

Financial Year

Victim Surcharge (VS) Collected *[1]

VS contribution to the Victim and Witness Budget*

Overall Victim and Witness Budget*

2010/11

£1<ins class="ministerial">1</ins><del class="ministerial">0</del>m

£1<ins class="ministerial">1</ins><del class="ministerial">0</del>m

£48m

2011/12

£10m

£10m

£48m

2012/13

£1<ins class="ministerial">1</ins><del class="ministerial">0</del>m

£1<ins class="ministerial">1</ins><del class="ministerial">0</del>m

£50m

2013/14

£<ins class="ministerial">20</ins><del class="ministerial">19</del>m

£<ins class="ministerial">20</ins><del class="ministerial">19</del>m

£57m

2014/15

£2<ins class="ministerial">5</ins><del class="ministerial">4</del>m

£2<ins class="ministerial">5</ins><del class="ministerial">4</del>m

£86m

2015/16

£28m

£18m

£92m

2016/17

£31m

£2<ins class="ministerial">7</ins><del class="ministerial">6</del>m

£96m

2017/18

£35m

£31m

£97m

*The amounts listed in the table have been rounded to the nearest £1<del class="ministerial">0</del>m.

unstar this property answer text
The Government is committed to ensuring victims of sexual abuse feel that they can come forward to report abuse, and that they can get the support they need, whether they are a child or an adult. That is why we provide grant funding for victim support services across the country, which victims can access throughout their lifetime.

The nature of this funding has evolved over time to reflect changes in demand and the changing nature of crime; hence we are unable to provide a consistent breakdown of funding since 2010.

Since 2016/17, the Ministry of Justice have provided around £7m per year of ring-fenced funding specifically for provision of support to victims of recent and non-recent child sexual abuse (CSA). In 2018/19, this included £4.7m provided to the Police and Crime Commissioners to locally commission or deliver such services, £1.74m allocated directly to rape support centres and £0.58m allocated to a fund maintained by the Home Office for national and regional organisations supporting victims of recent and non-recent CSA. This funding is not age-restricted; hence we are unable to provide information around how much has been allocated to support individuals under 13.

Victims and survivors of child sexual abuse are also supported by the NHS England-funded Sexual Assault Referral Centres (SARCs), which are open to all victims of sexual violence regardless of age and provide a range of services including crisis worker support and psychological therapy sessions to address any of victims’ immediate needs. This funding has increased significantly from £23m in 2016/17 to £35m in 2019/20, and supports work to improve the therapy offer for both children and adults.

unstar this property answer text

MHCLG are also consulting on potential measure for sustainable delivery of support for victims and their children in accommodation-based services for domestic abuse across England. unstar this property answer text

The Consultation ends on 2 August. https://www.gov.uk/government/consultations/support-for-victims-of-domestic-abuse-in-safe-accommodation The figures below relate to legal aid at the Civil Representation level. unstar this property answer text
The Victim and Witness Budget, which is used to fund support service for victims and witnesses, is set each year and includes funding from a number of different sources. This includes a forecasted contribution from the revenue raised by the Victim Surcharge.

The Victim and Witness Budget for funding victim support services increased to £96m in 2018/19 and has near-doubled funding for victim support services since 2013.

Between 2015/16 and 2017/18 the revenue raised from the Surcharge surpassed the forecasted contribution, so the excess was put towards compensating victims of violent crime through the Criminal Injuries Compensation Scheme. However, we have now changed our procedures so that from this financial year, all revenue raised will be included in the Surcharge contribution to Victim and Witness Budget.
more like this

unstar this property answer text
The number of children in custody has declined by 70% over the past decade, leading to a concentrated cohort of children with particularly complex needs, most of whom are serving sentences for more serious or violent offences. The safety of all children and staff is paramount, so we have taken the following measures:

Last year, the Youth Custody Service published, and began implementing, a new approach to behaviour management – “Building Bridges” – developed with the NHS.[1] This is based on the importance of leadership, trusting staff-child relationships and the benefits of reward, prevention and proactive techniques.

We are funding all our frontline officers to undertake a youth justice qualification up to foundation degree level, which will enable them to better analyse need and risk, and deploy more effective interventions.

We recruited more psychologists and healthcare workers to work with children to help them overcome the issues at the root of their poor behaviour. For those children with the most complex needs, we have created two specialist enhanced support units so they can receive the intensive support they need.

We have commissioned a review of pain-inducing restraint techniques, which we expect to publish shortly, and set up a taskforce to review separation practice and policy.

We anticipate this range of new measures will lead to improved behaviour, fewer incidents and better outcomes for children.

[1] https://www.gov.uk/government/publications/building-bridges-a-positive-behaviour-framework-for-the-children-and-young-people-secure-estate
