answer text <p>The Court of Appeal judgment in the case of Parker v. Financial Conduct Authority was handed down on 25 June 2021 and in the public domain from that point. A letter from Mr Parker’s solicitors, addressed to the Secretary of State, was received on 18 October 2021 informing him of the Court of Appeal judgment and seeking compensation for Mr Parker’s loss. An initial holding response was sent by the HM Courts &amp; Tribunals Service Customer Investigations Team on the 3 December 2021.</p><p>Letters from Mr Parker’s solicitors were received by the Ministry of Justice on 18 October 2021, 9 February 2022 and 7 March 2022. HM Courts &amp; Tribunal Service Customer Investigations Team replied to these on the 3 December, 11 February and 31 March 2022. Ministerial correspondence was also received from the Honourable Gentleman on 16 and 30 November and 2 and 6 December 2021, to which former minister James Cartlidge MP replied on 14 December, and 4 April 2022, following which the Government Legal Department wrote to Mr Parker’s solicitors on 8 April. Emails from the Honourable Gentleman’s office were received on 7, 8, 13, 21, 28 June, and 6, 12, 14, and 18 July. Replies to these were sent from MoJ officials on 8 and 14 June, and 13, 15, and 18 July.</p><p>The Government Legal Department has written to Mr Parker’s solicitors outlining the Government position. It would not be right to comment on the specifics of this.</p><p> </p>

answer text <p>Our assessment of cost was derived from a number of data sources: data from the January to March 2018 edition of the Legal Aid Statistics was used to determine the current volume and costs of inquests receiving legal aid and a unit cost for an inquest was assumed using median spend; the Coroners Statistics 2017 were used to estimate the annual number of future inquests; a survey of senior coroners was used to inform an assumption for the proportion of inquests that had public bodies represented and given the level of uncertainty on this, a range was used. By combining this assumption with the total number of inquests we arrived at an estimated volume of cases annually that would have state representation.</p><p> </p><p>Applying the unit cost of inquests to the estimated volumes gave an estimated additional spend ranging from £30m to £70m (rounded to the nearest £10m).</p> more like this

answer text <p>The PSR Pilot was launched in March 2021 and was rolled out across 15 magistrates’ courts in England and Wales. The pilot was recently extended until March 2023. This is to reflect the disruption and impact of the Covid-19 pandemic on the operation of courts, as well as the unification of the Probation Service. We intend to publish the initial findings from the process evaluation of the PSR Pilot in 2023.</p> more like this

answer text <p>The Government committed to piloting up to five Problem Solving Courts pilots in the Sentencing White Paper published in September 2020, and legislated in the Police, Crime, Sentencing and Courts (PCSC) Act 2022 to provide the legislative framework to enable the pilots to operate.</p><p>The Government announced on Sunday 17<sup>th</sup> July the location of two PSCs which will focus on offenders with substance misuse issues, at Liverpool and Teesside Crown Courts. A PSC for female offenders with complex needs will be in Birmingham Magistrates Court. These pilots are planned to launch from April 2023.</p><p>We are considering a range of locations for the remaining PSCs in order to ensure that they are situated in the best possible areas to provide the broadest range of support services to help manage offenders in the community.</p> more like this

answer text <p>The Bail Act 1976 creates a general presumption in favour of bail. The court can, however, refuse bail for a variety of reasons, including where it is satisfied that refusing bail is necessary for the defendant's own protection (adults) or own welfare (youth).</p><p> </p><p>The court’s decision to remand an individual in custody for their own protection is used as a last resort and out of concern for the defendant, where circumstances are such that a defendant would come to harm if released into the community and there is no other suitable option available to the courts.</p><p> </p><p>The Department does not centrally hold data on the reasons for remand into custody although we understand, anecdotally, that the power to remand for own protection is used sparingly.</p><p> </p><p>The Government is committed to tackling domestic abuse. This commitment is demonstrated by our landmark Domestic Abuse Act last year, and more recently the Tackling Domestic Abuse Plan. The Act has established a wide-ranging statutory definition of domestic abuse that incorporates a range of abusive behaviours beyond physical violence, brings in important new protections and support for victims in court and creates new offences such as non-fatal strangulation. Building on the Act, the Tackling Domestic Abuse Plan seeks to transform the whole of society’s response in order to prevent offending, support victims and pursue perpetrators, as well as to strengthen the systems and processes in place to deliver these goals.</p>

Since January 2020, the Justice Devolution Team has engaged with stakeholders from across the MoJ and has been involved in formal meetings with: the Lord Chancellor and junior Ministers on a regular basis; the MoJ’s Non-Executive Director with responsibility for devolution; and the MoJ’s Executive Committee and senior MoJ officials. In addition, the Justice Devolution Team also regularly engage with officials in the Devolved Governments in a number of forums and this remains an ongoing priority.</p> more like this
