answer text Since its inception, the Supreme Court has confirmed two declarations of incompatibility under section 4 of the Human Rights Act 1998, both of which had been made previously by the Court of Appeal. These were in the cases of R (F and Thompson) v SSHD (2010) UKSC 17 and T &amp; Anor, R (on the application of) v Secretary of State for the Home Department &amp; Anor [2014] UKSC 35.<p>In the first case, the incompatibility was remedied by the Sexual Offences Act 2003 (Remedial) Order 2012.</p><p> </p><p>In the second case, while the Government’s application to appeal to the Supreme Court was outstanding, changes were made to the Rehabilitation of Offenders Act 1974 (Exceptions) Order 1975 and to the Police Act 1997 by secondary legislation in response to the Court of Appeal’s earlier judgment.</p> more like this

answer text <p>The Coalition Government originally legislated for Secure Colleges as a way to deliver better education in the youth justice system. This Government is also completely committed to improving the quality of education enjoyed by young offenders. This is one of the Government's top priorities. But the nature of the challenge has changed. The youth custody population has fallen from 1,349 in January 2013 to 999 in April 2015, a fall of 26%. A Secure College could have been desirable with a larger population, but it would not be right to house one third of the entire youth offender population in one setting. It would also be a mistake to press ahead with such a development when resources are so tight.</p><p> </p><p>We are therefore not going ahead with the creation of a secure college pathfinder. All work on the proposed secure college pathfinder at Glen Parva has now ceased.</p> more like this

answer text <p>This Government is committed to developing a new generation of electronic monitoring tags, so that we can more effectively monitor the location of offenders.</p><p> </p><p>But there have been significant problems with this programme. We have not developed the infrastructure for these new electronic monitoring tags to the timetable originally set out nor yet at the level of effectiveness required. Integrating legacy technology on the new system has caused particular delays.</p><p> </p><p>We are now in the the process of testing the new tags. But the new fully integrated service will not be ready for another 12 months at the earliest. We continue to use existing tags for a variety of offenders.<strong> <br></strong></p> more like this

answer text <p>Allocation to open prison is never automatic. Prisoners serving sentences for violent or other serious offences may be allocated to open prison towards the end of their sentence but only where they have successfully completed relevant offender behaviour work and are assessed as a low risk. Prisoners serving a determinate sentence must be within 2 years of release before they can be considered for allocation to an open prison, and those serving indeterminate sentences will only be transferred following a recommendation from the Parole Board. A prisoner in open conditions can be returned to the closed estate immediately should new risks be identified. Following a comprehensive review, the Government has tightened the eligibility for open prisons.
