unstar this property answer text <p>As set out in my response to PQ178535, one of the measures Her Majesty’s Prison and Probation Service (HMPPS) implemented after stepping in to run HM Prison Birmingham was to temporarily reduce the operational capacity by 300 places. The capacity reduction was not immediate and was delivered over time with the gradual reduction of the prison’s population through a combination of: end of sentence releases, diversion of court allocations to other prisons in the region and routine allocations of sentenced prisoners to other establishments as part of their sentence progression as is normal for a prison with a ‘local’ function.</p><p>Men who were transferred were subject to the same criteria as all prison moves, taking into account a range of factors such as security category, resettlement needs and release address, offending behaviour needs and personal circumstances.</p> more like this

unstar this property answer text <p>Unlike public sector prisons, privately managed prisons are not placed in special measures but are instead subject to contractual mechanisms when there are performance concerns.</p><p> </p><p>In the case of HMP Birmingham, we issued two Improvement Notices in March 2018, and Outstanding Issues Notices for each in June and August 2018 respectively. Despite this time, performance at HMP Birmingham remained unacceptable prompting us to exercise our right under the contract to ‘step-in’ in August 2018. HMP Birmingham was also scored as a Level 1 prison, as published in our annual performance ratings for year 2017/18.</p><p> </p><p>We are clear that prisons should be places of safety and reform and are working closely with G4S to improve conditions for prisoners at HMP Birmingham. A probation worker’s tasks are not based solely on the number of cases they are managing, but the level of supervision each case requires.</p><p> </p><p>The Ministry of Justice publishes statistics showing the total caseload of the 21 Community Rehabilitation Companies (CRCs) as well as the National Probation Service (NPS). unstar this property answer text <p>Public protection is our top priority and the contracts contain robust provisions requiring each Community Rehabilitation Company (CRC) to ensure that it employs a sufficient level of staff to deliver their contractual obligations. We are taking decisive action to improve CRCs by ending current contracts early, investing £22m in through the gate services, and we have consulted on how best to deliver probation services in the future. We have also recently changed CRC contracts to improve reporting on workforce trends and will use this information to inform contract management activity.</p><p> </p><p>Our Contract Management Teams closely monitor and robustly manage providers on a local basis, taking into account the regional context, to make sure they fulfil their contractual commitments to reduce reoffending, protect the public and provide value for money to the taxpayer.</p><p> </p> more like this

unstar this property answer text <p>Community Rehabilitation Company (CRC) contracts require each CRC to maintain a sufficient level of staff and ensure that its workforce is competent and adequately trained. CRCs have the authority to manage staff numbers as per their business and operating models. Robust assurance of performance is provided through operational contract management backed up by regular Operational Assurance audits, and Internal Audit activity as required. There is regular monitoring of service delivery, including a focus on validating published performance management information. CRC performance information showing services levels against a range of measures is released quarterly as part of the Community Performance Quarterly Management Information.</p><p> </p><p>We take seriously concerns raised by Her Majesty’s Inspectorate of Probation (HMIP) and others over staffing levels, particularly for resettlement work with prisoners nearing the end of their custodial term. The contract changes we agreed with CRCs last year include £22m per year in additional funding for Through The Gate services, which will mean approximately 500 more staff working with offenders in prison after April 2019. We are currently proposing further changes to probation after the existing CRC contracts come to an end in 2020. The proposed changes include measures to ensure the probation workforce is better supported to build their careers and deliver a high-quality service to offenders, such as introducing a standard training framework for staff and a national professional register to recognise the specialism and value of probation work.</p>

In the vast majority of cases the legal representatives are acting for both the agency and all members of its staff called as witnesses, and the respective costs cannot therefore be separated. In a very small number of cases separate representation is provided for one or more members of staff.</p><p> </p><p>These costs relate to the representation provided for public-sector prisons and their staff, and, since its creation in April 2014, the National Probation Service and its staff. The costs of representation for contracted prisons and their staff are met by the provider. Before April 2014 each Probation Trust met its own representation costs, and since then each Community Rehabilitation Company has done likewise.</p>
