A new set of contracts commenced in 2016 which included various improvements based on independent recommendations made about the previous contract. These changes included a more robust performance management regime, improved data and the implementation of a new quality assurance service.</p><p> </p><p>Spend on Language Services is expected to fluctuate due to the nature of the contracts being demand led.</p> more like this

star this property answer text <p>For publicly funded criminal legal aid work, payment for the trial advocate (or counsel) in the Crown Court is determined in accordance with fees set out in Schedule 1 of The Criminal Legal Aid (Remuneration) Regulations 2013. The Crown Court Fee Guidance published by the Legal Aid Agency provides further guidance.</p><p> </p><p>Paragraph 16, Schedule 1 of the Remuneration Regulations states that an ineffective trial fixed fee <em>is payable in respect of each day on which the case was listed for trial but did not proceed on the day for which it was listed, for whatever reason.</em> The fee payable is set out at paragraph 24 of Schedule 1 of the Regulations and there are different fees according to the category of advocate instructed in the trial.</p> more like this

star this property answer text <p>Efforts to better understand and tackle racial disparity in the Criminal Justice system are typically resourced as part of the mainstream responsibilities for Ministry of Justice and partner organisations, without dedicated budget(s). As such we have not been able to isolate the spend requested. Some additional commentary follows.</p><p> </p><p>On a) per Government’s response to David Lammy’s review of the treatment of BAME people in the CJS, we remain committed to publishing more and better data to inform us on issues of racial disparity in the criminal justice system.</p><p> </p><p>On b) Ministry of Justice is funding a three year programme, the Pre-Application Judicial Education programme, to support improving judicial diversity at a cost of £300,000 over financial years 2018/19 to 2020/21. The Judicial Appointments Commission also lead on initiatives to support diversity in the judiciary including outreach events.</p><p> </p><p>On c) as a matter of course our work on tackling racial disparities engages with academics and their research.</p><p> </p><p>On d) we have taken a range of steps to integrate activity to reduce racial disparities within the youth custodial estate in to the work of establishments and to drive improvements. This includes having dedicated equalities staff in Youth Offender Institutions and Secure Training Centres. We also have specific members of staff based at head-quarters, both within the Ministry of Justice and the Youth Custody Service, who consider the needs of BAME children, develop and implement improvement initiatives and feed into wider policy and delivery work. Examples include, the appointment of a Senior Policy Advisor: BAME Development lead to help address Recommendations 28 and 29 of the Lammy Review, on the recruitment of BAME staff; the YCS mandating the take-up of unconscious bias training for senior managers across public sector establishments, the commissioning and introduction of ‘debiasing training’ for key staff; and the inclusion of a problem-solving approach to complaints (Lammy Review Recommendation 27) in the new Youth Custody Service framework for behaviour support.</p>

Within the next year, we aim to identify options to reduce the numbers of children remanded to custody where appropriate, while ensuring victims and the public are protected.</p><p> </p><p>The Ministry of Justice has published information on individuals who were remanded in custody during court proceedings. With this in mind, the answers to questions a, b and c should be considered independently in each data tool.</p><p> </p><p>Note that we have answered question (c) based on the number of prosecutions as MoJ do not hold data on charges and interpreted ‘children’ as being juveniles, therefore aged 10-17 years old.</p><p> </p><p>In the Magistrates’ Court data tool:</p><p>Use the ‘Age Group’ filter and select juveniles. The total number can be used to calculate the proportion of juveniles remanded in custody prosecuted for a violent crime at the Magistrates’ Court.</li></ul><p> </p><p>In the Crown Court data tool:</p><p>Use the ‘Age Group’ filter and select juveniles. star this property answer text <p>The Youth Custody Service has commenced reform of education services and are developing a vision for learning. Included in the education reform is the provision of wellbeing and exercise with flexibility of provisions. The vision for learning is expected to bring about flexibility which is tailored to the needs of children within the secure estate and we are working with our education</p><p>providers to increase the flexibility of the core day and curriculum to allow for more space, time and resources to provide young people with the activities that are tailored to their needs and offer the most positive engagement with education.</p><p> </p><p>We have also devolved additional funds to Young Offender Institutions (YOIs) governors to commission additional educational, vocational and enrichment activities that best engage and meet the needs of the children in their establishments. This amounts to £0.3m in 18/19 and £1.8m in 19/20 across the four public sector sites.</p><p> </p><p>Where available the information requested on the allocations to the requested establishments for prison libraries are provided in the attached table. Prior to 2014 all library finances were carried out locally in establishments, and are therefore not included. Data for establishments which were or are Privately Managed Prisons are not available as the cost of provision is included in the overall budget. It should also be noted that at HMYOI Feltham the library is shared across both sites and the figures provided are for full provision. Budgets for 19/20 have yet to be officially allocated.</p>

star this property answer text <p>Discipline procedures are central to the maintenance of a safe, decent and rehabilitative custodial environment. They require adjudications to be conducted lawfully, fairly and justly. All prisoners have a full opportunity to hear what is alleged against them and to present their case. Children and young people in custody are some of the most vulnerable people in society and their safety and welfare is our highest priority. But there are occasions when their behaviour is so challenging and violent that it is necessary to instigate disciplinary procedures. Young or vulnerable prisoners, who may lack experience of adjudications, are encouraged to request help from an advocate.</p><p> </p><p>Only Independent Adjudicators, who are District Judges or Deputy District Judges, can, in cases deemed to be sufficiently serious, make an award of additional days. The adjudicators will follow the punishment guidelines issued by the Chief Magistrate. These are rightly, independent of the Ministry of Justice and a matter for the Chief Magistrate.</p><p> </p><p>The information requested can be found in the tables attached.</p>

star this property answer text <p>Any suicide is a tragedy, and we take the welfare of our brave service men and women extremely seriously.</p><p> </p><p>For data on suicides amongst veterans to be of value, the information collected must be reliable, consistent and comprehensive. It is not possible to achieve this through coroners’ inquest conclusions for a number of practical and administrative reasons, including the parameters of the coroner’s role.</p><p> </p><p>Ministry of Justice officials have talked to colleagues in the Chief Coroner’s office about the issues to do with coroners recording whether the deceased had ever served in the armed forces.</p><p> </p><p>Ministers from the Ministry of Justice and the Ministry of Defence have on several occasions discussed the issue of to explore how we gather data on veterans in inquests. The Government recognises that personal information about victims of suicide can be used to improve understanding of “at risk” groups and, from that, to support better targeted interventions. More widely, the Government recognises the need to gather data on veterans in the criminal justice system. The Ministry of Justice will continue to work with the Ministry of Defence and other government departments to explore how we can further this objective.</p>
