One person may make more than one application for legal aid.</p><p> </p><p>The upper limits on financial means eligibility in cases involving protective orders due to Domestic Violence are waived, meaning a client will never be assessed out of scope on finances. The Legal Aid Agency would never refuse an application on the basis that it did not believe the applicant to be a victim of domestic abuse.</p><p> </p><p>Refusals will be based on consideration of whether the circumstances of the case indicate that the court is unlikely to grant an order (minor incidents or passage of time since they occurred), whether there is an alternative remedy available (warning letter, police involvement) or whether the client is already sufficiently protected (bail conditions, remand in custody).</p>

star this property answer text <p>Youth Offending Services (YOS) were established in the Crime and Disorder Act 1998, which introduced a statutory duty for all local authorities to establish a multi-agency team, with members from police, social services, probation and education, to deliver youth justice services. YOS have a statutory duty to:</p><ul><ul><li>provide appropriate adults for children detained or being interviewed at the police station and provide support for children on bail;</li><li>help young people and their families through court proceedings;</li><li>write pre-sentence reports for the courts advising on appropriate interventions;</li><li>supervise young people serving a community sentence;</li><li>stay in touch with a young person if they’re sentenced to custody; and</li><li>assist in the child’s resettlement post-custody.</li></ul></ul><p>All children who come into contact with the YOS (including EEA nationals) will have their individual circumstances and needs assessed and will receive interventions and support accordingly.</p>

star this property answer text <p>We recognise the valuable work that Law Centres do in local communities around the country, and we support them in this through both grant funding and through legal aid contracts.</p><p>We are also working collaboratively with the sector to explore co-locating piloting co-located support hubs as part of work to explore new, better ways to help people resolve their issues.</p><p>My officials continue to meet regularly with representatives of law centres to discuss ways in which we can work together to enhance the breadth of legal support available to everyone in society.</p> more like this

star this property answer text <p>We have long worked collaboratively with the Department for Education (DfE) to improve educational and other rehabilitative outcomes for children in the youth justice system.</p><p>The DfE has a proactive role in the governance and delivery of many youth justice projects:</p><ul><li>Our new secure schools model for youth custody has been developed collaboratively with the DfE and has a strong focus on improving the provision of education through the commissioning of child-focused providers.</li><li>We are retendering learning services in young offender institutions (YOIs) by September 2021 when existing contracts are due to expire. The DfE is part of this project and provides advice on it, particularly regarding developing service requirements and engaging schools, colleges and academy trusts.</li><li>The DfE and Ministry of Justice (MoJ) work closely with other government departments to implement the cross-government serious violence strategy, which includes provisions for schools-based early intervention and prevention initiatives where appropriate, and to minimise the harmful impact of school exclusions.</li></ul><p>Over the longer-term, the DfE, MoJ and other government departments are reviewing the structure and governance of the youth justice system in Wales and the entire youth secure estate to improve alignment, standards and outcomes for children</p>

star this property answer text <p>We believe that that children who offend should have the opportunity to learn from their mistakes and move ahead positively with their lives while ensuring ensure the public are adequately protected.</p><p>The criminal records disclosure regime is designed to help employers make informed recruitment decisions through the disclosure of appropriate and relevant information, particularly for roles involving children and vulnerable adults.</p><p>We have noted the Supreme Court judgment in P and others and my department is working closely with the Home Office to reform the existing regime.</p> more like this
