unstar this property answer text <p>The Ministry of Justice’s annual collection of data from coroners does not include the number of adjourned investigations which are resumed after a murder trial. The number of such cases will be low, however, because the coroner has to have sufficient reason for resuming the investigation and a criminal trial will often cover the statutory questions which the coroner is required to address.</p><p> </p><p>The Ministry’s data collection does include the number of cases <em>not</em> resumed after an adjournment, broken down by sub-groups including murder. unstar this property answer text <p>Going to court can be a daunting experience, that is why the Victims Strategy sets out how we will better support victims during the court process, such as improving the information available for victims attending court and making the court environment more victim friendly.</p><p> </p><p>MoJ grant funds the court-based Witness Service to ensure that witnesses, some of whom are victims, can access timely, high quality emotional and practical support to help them feel more confident and informed so they can give their best evidence in criminal courts. Over 2019/20 and 2020/21, we will provide total funding of up to £22.4m to Citizens Advice for delivery of the Service. The Service provides pre-trial and on-the-day support, as well as an enhanced service for vulnerable and intimidated victims and witnesses tailored according to need.</p><p> </p><p>There are also a range of special measures available to assist vulnerable and intimidated witnesses (including vulnerable and intimidated victims) to give their best evidence in criminal proceedings. The measures available include the power for a court to order arrangements for live video links, video recorded evidence-in-chief, and screens around the witness box.</p>

unstar this property answer text <p>Our vision is one of a justice system that supports even more victims to speak up with the certainty that they will be understood, protected, and supported whether or not they report a crime, and regardless of their circumstances or background.</p><p> </p><p>That is why we committed in the Victims Strategy, published on 10 September 2018, to bring forward proposals for a consultation on the detail of a Victims’ Law in 2019. In taking this work forward we have already begun discussions with both victims and victims’ groups.</p><p> </p><p>I am fully assured that we are on target to deliver this as well as the other commitments set out in the Strategy and we will, of course, work closely with Parliamentary Authorities on legislative slots once we are clear on the proposals for legislation.</p> more like this

An appeal is not necessarily disposed of at its first hearing. The final disposal decision on the appeal may be reached after an earlier hearing had been adjourned (which may be directed by the judge for a variety of reasons, such as to seek further evidence), or after an earlier hearing date had been postponed (again, for a variety of reasons, often at the request of the appellant). An appeal may also have been decided at an earlier date by the First-tier Tribunal, only for the case to have gone on to the Upper Tribunal, to be returned once again to the First-tier for its final disposal.</p><p> </p><p>Latest figures (to December 2018) indicate that since PIP was introduced, 3.9 million decisions have been made, and of these 10% have been appealed and 5% have been overturned at tribunals.</p><p> </p><p> </p>

unstar this property answer text <p>This information requested is shown in the attached table.</p><p> </p><p>Our reforms to probation are designed to encourage long-term rehabilitation and ultimately reduce reoffending – and the first step in this is ensuring that everyone leaving prison has access to secure and stable accommodation. We are improving support for offenders leaving prison with a £22 million investment in through-the-gate services which will help to strengthen ties with key partners, including the third sector, local authorities and the police.</p><p> </p><p>At the same time we are investing £6m as part of the Government’s Rough Sleeping Strategy in pilot schemes bringing together prisons, local authorities, probation providers and others to plan, secure and sustain accommodation for offenders on their release.</p><p> </p> more like this

unstar this property answer text <p>The financial thresholds for civil and criminal legal aid were reviewed by MoJ Ministers in January 2010, March 2011 and March 2016, following advice from officials. Separately, the means test thresholds were reviewed at official level within MoJ in January 2012 and between October 2013 and January 2014.</p><p>The Legal Aid Means Test Review, announced by MoJ in February 2019, will be studying the thresholds for legal aid entitlement, including the effectiveness with which the means testing arrangements appropriately protect access to justice, particularly for the vulnerable. As part of the review process, we will evaluate a wide range of evidence from both within and outside of government, liaising with experts from across the field to explore any improvements to the system.</p><p>Upon conclusion of the review, expected by summer 2020, we will publish a full consultation paper setting out our future policy proposals in this area. We will seek to implement any final recommendations as soon as practicable following public consultation.</p>

unstar this property answer text <p>It is not possible to estimate the cost to the Ministry of Justice of any increase in the number of litigants in person as a direct result of not uprating the legal aid means test thresholds since 2008/2009.</p><p>The Legal Support Action Plan, published in February 2019, confirmed that the Ministry of Justice will undertake a legal aid means test review which will study the thresholds for legal aid entitlement as well as the effectiveness with which the means testing arrangements appropriately protect access to justice, particularly for the vulnerable. Within this review, we will evaluate a wide range of evidence from both within and outside of government, liaising with experts from across the field to explore any improvements to the system.</p><p>The Ministry of Justice has also announced that it is doubling its funding for the Litigants in Person Support Strategy to £3 million per year for the next two years, to ensure that those representing themselves in court can access the support they need.</p>
