star this property answer text <p /> <p>Discipline Procedures are central to the maintenance of a safe custodial environment. They are provided for by the Prison and Young Offender Institution Rules which require adjudications to be conducted lawfully, fairly and justly, and for prisoners and young people (aged 15-17) to have a full opportunity to hear what is alleged against them and to present their case. Independent Adjudicators are District Judges or Deputy District Judges who attend establishments when necessary to hear prisoner adjudication cases which are deemed sufficiently serious and which may merit a punishment of additional days to a prisoner’s time spent in custody if the prisoner is found guilty.</p><p> </p><p>Information on the number of adjudications by type of adjudicators (Governors or Independent Adjudicators) is not held centrally.</p><p> </p><p>Offender Management Statistics are published periodically at:</p><p> </p><p><a href="https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/424905/adjudications-2014.xls" target="_blank">https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/424905/adjudications-2014.xls</a></p><p> </p><p>Further details will be published in due course.</p><p> </p><p>It is important to note that some incidences may have been committed at one establishment and punished at another.</p>

Independent Adjudicators are District Judges or Deputy District Judges who attend prisons and Young Offender Institutions when necessary to hear adjudication cases which are deemed sufficiently serious. These cases may merit a punishment of additional days to a prisoner’s time spent in custody if the prisoner or young person is found guilty. Only Independent Adjudicators can make an award of additional days as a punishment.</p><p> </p><p>A range of safeguarding measures are in place to make sure that a prisoner or young person is physically and mentally fit to face an adjudication hearing and any subsequent punishment. Adjudication outcomes are regularly monitored to make sure that no prisoner or young person is charged or punished for any reason other than their disciplinary behaviour.</p><p> </p><p>Information on the number of adjudications by type of adjudicators (Governors or Independent Adjudicators) and on the number of adjudications by a prisoner’s mental health diagnosis is not held centrally.</p><p> That is why the Government is reviewing driving offences and penalties.</p><p> </p><p> </p><p> </p><p>The number of defendants proceeded against at magistrates courts and found guilty at all courts of offences related to drink driving in England and Wales from 2009 to 2013 (latest available) can be viewed in the following tables:-</p><p> </p><p> </p><p> </p><p>· Table 1 – males</p><p> </p><p>· Table 2 - females</p><p> </p><p> </p><p> </p><p>The arrests collection held by the Home Office covers arrests for recorded crime (notifiable offences) only, broken down at a main offence group level, covering categories such as violence against the person and robbery. The offence of drink driving is not a notifiable offence and does not form part of this collection.</p><p>Data by police force has been provided as we are not able to group results from the Crown Court by local criminal justice board. Additionally, due to changes in court structure we not able to group courts by local criminal justice board across the whole time-period.</p><p> </p><p> </p><p> </p>

star this property answer text <p /> <p>Final bids were submitted on 5 January 2015 and negotiations commenced on 26 January as planned. The full final business case is currently in the process of being updated with results from the negotiation meetings, which then needs to continue through the usual governance and approvals processes that need to occur before any contract award of this type. Further negotiations may be required over the coming weeks to further refine the proposals.</p><p> </p><p>The investment and technology an external provider can bring will enable the automation of many of the manual administrative processes and in turn decrease the cost of providing fine enforcement and increase the amount of fines that are paid. The innovation will free up staff time to enable them to be more pro-active in pursuing offenders to ensure they comply with their court order.</p> more like this

However, the Government considers that limited legal aid resources should be targeted at those judicial review cases where they are needed most if the legal aid system is to command public confidence and credibility.</p><p> </p><p>We are carefully considering the recent judgment in the case of <em>R (Ben Hoare Bell and Others)</em> <em>v Lord Chancellor</em> and our next steps.</p><p> </p><p>As of 11 February 2015, the Ministry of Justice had incurred total legal fees (including fees paid to the litigation team in the Treasury Solicitor’s Department and to Counsel) of £47,555.43 (including VAT) in this case.</p> more like this

star this property answer text <p /> <p>Legal aid is a fundamental part of our justice system, but resources are not limitless.</p><p> </p><p>The Government believe that individuals should have a strong connection to the UK in order to benefit from the civil legal aid scheme. We believe the residence test we proposed is a fair and proportionate way to demonstrate that connection.</p><p> </p><p>The proposed residence test was challenged by way of judicial review brought by the Public Law Project. We are disappointed with the High Court judgement and have been granted permission to appeal. The appeal has been listed for 16 and 17 June 2015 in the Court of Appeal.</p> more like this

The Government is always receptive to possible improvements in the law but has no plans to reform or review it with regard to the issues set out in the question.</p><p>The nature of the material, age and maturity of children involved in such cases or any evidence of coercion or exploitation would be taken into account by the Crown Prosecution Service when deciding whether to prosecute.</p> more like this

star this property answer text <p /> <p>Parliament agreed an exceptional case funding scheme to provide an avenue for providing legal aid to those cases that would normally be out of scope, in order to ensure we meet our obligations under the European Convention on Human Rights and European Union law.</p><p> </p><p>The civil legal aid exceptional funding scheme does not provide a general power to fund cases or individuals that fall outside the scope of legal aid – that is not its purpose.
