In mid December 2013, the bidders who passed the first stage of the competition to win the regional rehabilitation contracts were announced. The list includes a mix of private and voluntary sector partnerships with more than 50 organisations represented – from charities experienced in tackling a range of issues affecting offenders, to small and large British businesses and experienced multinationals. All of these Tier one bidders have experience in working with offenders or across the wider Criminal Justice System. Approximately one third of the bidders included a potential mutual organisation within their consortium. Additionally, for similar commercial reasons it is not general practice to release information on those organisations which have withdrawn from the competition.</p><p> </p><p>As requested by the Authority, all bidders updated their CPA preferences on 22<sup>nd</sup> January. The current lot preferences are an initial indication of the bidders for each region. During the Pre-Qualification Questionnaire (PQQ) stage of the competition, we tested providers rigorously against a number of criteria, including Economic and Financial Standing, to determine Potential Bidders' ability to fund a proposed contract. The list includes a mix of private and voluntary sector partnerships with more than 50 organisations represented – from charities experienced in tackling a range of issues affecting offenders, to small and large British businesses and experienced multinationals. All of these Tier One bidders have experience in working with offenders or across the wider Criminal Justice System.</p><p> </p><p>We do not anticipate supplier failure, butcontracts will have the full range of remedies in the case of failure; up to and including contract termination in the case of insolvency, default or persistent breach. NOMS will be able to exercise step–in rights, for example in the case of a breach that materially affects the performance or services, and the NPS will ensure we retain this expertise in the public sector. The contract allows for discussions with another CRC provider to be brought in as provider of last resort in the event that the initial provider fails. The Human Rights Act 1998 gives further effect in domestic law to certain rights and freedoms drawn from the Convention, called the Convention rights. Section 6(1) of the Act makes it unlawful for a public authority to act in a way which is incompatible with a Convention right. Under section 6(3), “public authority” is defined as including a court or tribunal, and “any person certain of whose function are functions of a public nature”; but does not include either House of Parliament or a person exercising functions in connection with proceedings in Parliament. Section 73(2) of the Care Act 2011 additionally specifies that a provider of regulated care and support that has been arranged or paid for by a local authority or Health and Social Care trust is also to be taken as exercising a function of a public nature for the purposes of the Human Rights Act. 	answer	answer is ministerial correction date of answer 02/04/2014 answer text <p>The use of judicial review more than tripled between 2000 and 2013, from around 4,300 applications to around 15,700. The increase has been driven mainly by immigration and asylum cases but civil judicial reviews have increased by around 27% over the same period, from 1,745 in 2000 to 2,210 in 2013.</p><p> </p><p>In 2012 only around 1,400 of 7,600 applications considered for permission, including at an oral renewal, were granted permission to proceed to a final hearing. Between 1 October 2012 and 31 December 2013 around 30% of judicial reviews which reached the permission stage or oral renewal were found to be totally without merit.</p><p> </p><p>The governemnt is determined to improve the judicial review process. The rationale for the Government's reforms is set out in ‘Judicial review: further proposals for reform – the Government response' (<a href="https://consult.justice.gov.uk/digital-communications/judicial-review" target="_blank">https://consult.justice.gov.uk/digital-communications/judicial-review</a>).
