star this property answer text <p>In the First-tier Tribunal (Special Needs and Disability) (SEND), all appeals are listed for hearing on the next available date, on receipt. If the hearing date allocated is unsuitable for whatever reason, the cancellation of the original hearing date is counted as a postponement in the SEND tribunal’s case-handling system – GAPS2. If that second hearing is cancelled and the case re-listed, that is counted as another postponement in the system. star this property answer text <p>The Government is committed to ensuring that those seeking asylum in this country have access to publicly funded legal advice and representation. In 2021-22, we received over 35,000 applications for legal aid for asylum cases, spending over £32 million.</p><p> </p><p>Access to legal aid is a key part of a fair immigration system, which is why we are spending around £8m expanding access to legal aid, helping victims of modern slavery, individuals prioritised for removal and individuals appealing an age assessment decision.</p><p> </p><p>The Legal Aid Agency keeps market capacity under constant review and takes immediate action when gaps appear.</p> more like this

star this property answer text <p>Section 69 of Police and Criminal Evidence Act 1984 (PACE), provided that computer evidence would not be admissible unless it was shown that (i) there were no reasonable grounds for believing the evidence was inaccurate because of improper use of the computer and (ii) the computer was operating effectively at the time. This was repealed in 2000 based upon the recommendation of a Law Commission review which identified a number of shortcomings with the legislation.</p><p>Section 69 of PACE was replaced by the Common Law rule, namely that a “presumption will exist that the computer producing the evidential record was working properly at the material time and that the record is therefore admissible as real evidence&quot;. There are safeguards in place which allow for this presumption to be rebutted if evidence to the contrary is adduced.</p><p>We are considering the issues relating to computer evidence arising from the Post Office cases and the findings of the courts where there have been appeals. The courts have raised concerns about the “egregious” behaviour of the Post Office in the way that it prosecuted these cases. In particular, concerns have been raised about the way reliability of evidence from the Horizon system was presented and how failures of investigation and disclosure prevented that evidence from being effectively challenged.</p><p>We await the outcome of Sir Wyn Williams’ Inquiry which is examining in detail the failings that led to the Post Office scandal. It would not be appropriate for the Government to pre-empt those findings.</p><p>Pending the outcome of the Inquiry, the Criminal Procedure Rules Committee will consider current practices and potential problems relating to the reliability of computer evidence, drawing on case law and experience in England and Wales and other jurisdictions.</p>

star this property answer text <p>The Bill of Rights will protect people’s fundamental rights, including Article Nine: freedom of thought, conscience, and religion. This protects the right to manifest one’s beliefs whether they are religious or non-religious.</p><p> </p><p>The Government consulted on proposals to replace section 3 of the Human Rights Act 1998. Section 3 imposed a duty to read and give effect to legislation in a way which is compatible with the Convention (European Convention on Human Rights) rights where possible. In practice, this has led to courts interpreting legislation in a compatible way, without Parliament’s input, so far as it is possible to do so. We think that a less expansive interpretive duty would provide greater legal certainty, a clearer separation of powers, and a more balanced approach to the proper constitutional relationship between Parliament and the courts on human rights issues. The Government will set out its final proposals in due course.</p> more like this

star this property answer text <p>I recognise the concerns about the risk to young people of those in a position of trust, abusing their position. This is an incredibly complex area and it is important that we ensure that the law is working effectively to ensure that young people are protected. Any consideration for reform in this area must achieve the sensitive balance between the protection of young people and ensuring we do not infringe upon the sexual rights and freedoms of those over the age of 16 granted to them by Parliament.</p><p>We have taken into account the findings of the review carried out on the legislative provisions on positions of trust as set out in the Sexual Offences Act 2003 and are considering next steps with both pace and care. star this property answer text <p>Both HMP Spring Hill and HMP Coldingley are currently accepting transfers.</p><p> </p><p>In order to control the transmission of the virus, prisoners who are transferred to another prison are quarantined for 14 days upon arrival in order to manage any risks they might bring and protect the rest of a prison’s population. We are also testing all new arrivals and transfers twice in the first six days in all prisons across the estate. In addition, rapid point of care tests are being introduced in all prisons to enable prisoners to be tested prior to transfer. Any positive results or symptomatic prisoners are not transferred.</p><p> </p><p>Whilst transfers into the majority of prisons have not ceased, specific prisons may have to temporarily pause their transfers in/out in the event of a declared outbreak. The timeframes associated with this pause, as well as the recovery measures required, are monitored nationally by HMPPS and taken in close consultation with public health bodies.</p> more like this

star this property answer text <p>While the Ministry of Justice is responsible for coroner law and policy, it does not have operational responsibility for coroner services as they are a local service, funded and administered by individual local authorities. Moreover, coroners are independent judges and the way in which they manage their investigations and inquests is a matter for them.</p><p> </p><p>Rule 9(1) of the Coroners (Inquests) Rules 2013 requires the coroner to notify the deceased person’s next of kin of the date, time and place of the inquest hearing.
