	answer	answer is ministerial correction date of answer 03/02/2020 answer text <p>Once a hate crime has been reported it is for the police to investigate whether a hate crime has been committed, in line with the relevant legislation, and to refer cases to the Crown Prosecution Service to decide whether there should be a charge.</p><p>In order for a crime to be charged and prosecuted as a hate crime, the Crown Prosecution Service (CPS) uses the legal definitions contained in the Crime and Disorder Act 1998 (CDA 1998) and the Criminal Justice Act 2003 (CJA 2003).</p><p>The CPS assesses each case on its individual facts and circumstances. Prosecutions can only be brought in line with legislation and in accordance with the Code for Crown Prosecutors.</p><p>The CPS legal guidance on hate crime recognises the right to freedom of expression set out in Article 10 of the European Convention on Human Rights. The legal guidance makes it clear that it is not only speech which is well-received and popular that is protected but also speech which is potentially offensive, shocking or disturbing. These include that the planning policies and decisions of local planning authorities should support the expansion of electronic communications networks, such as 5G.</p><p>We have also introduced a range of permitted development rights to support the delivery of mobile infrastructure, including legislating for higher masts in 2016, whilst also protecting local amenity.</p><p>We hope that these measures will be used by industry, alongside proactive engagement with the planning system, to ensure delivery of 5G. 	answer	answer is ministerial correction date of answer 12/06/2019 answer text <p>As announced by the Secretary of State for the Department for Digital, Culture, Media and Sport on 12 June, we will shortly be consulting on proposals to simplify planning processes in England to support the rollout of 5G and further improve mobile coverage in rural areas.</p><p>Public Health England’s (PHE’s) Centre for Radiation, Chemical and Environmental Hazards takes the lead on public health matters associated with radiofrequency electromagnetic fields, or radio waves, used in telecommunications. Central to PHE advice is that exposure to radio waves should comply with the guidelines published by the International Commission on Non-Ionizing Radiation Protection (ICNIRP). 	answer	answer is ministerial correction date of answer 24/10/2018 answer text <p>My department is funding up to £9.4 million to Oxfordshire Local Enterprise Partnership for the delivery of the A34 Lodge Hill interchange. The Cities and Local Growth Unit requires updates and proof the scheme is on track in order to provide the agreed funding on a yearly basis between 2017/18 – 2020/21. In March 2018 the unit was satisfied the project was on track to be completed as planned and provided the second wave of funding.</p><p>Oxfordshire County Council are the scheme promoter and are leading discussions with Her Majesty’s Government. Highways England are partnering and facilitating discussions with Oxfordshire County Council regularly, and meeting them on a monthly basis as they develop their proposal to add south-facing slips to the A34 Lodge Hill interchange.
