The Law Commission have recently consulted on possible measures, including introducing a prescribed formula that provides fair compensation to the landlord, whilst also helping leaseholders avoid incurring additional court costs. A fund of £290 million of recoverable loan has previously been made available. Also, in March 2017 we allocated £32 million of grant to 105 estates. The National Planning Policy Framework makes it clear that planning policies and decisions should enable and support healthy lifestyles which can include access to healthier foods. Local authorities have the power to develop planning policies to limit the opening of additional hot food takeaways if evidence and circumstances support it. In considering specific proposals, a local authority may consider the proximity to places where children and young people congregate, such as schools, play areas and community centres. Levels of obesity and the over-concentration of a particular use within an area are also factors a local authority may consider.
