star this property answer text <p>UK Visas and Immigration (UKVI), as part of their compliance activities, conduct on-site audits of sponsors and check what assessment methods sponsors have used and their relevant evidence. Where there are any compliance breaches, UKVI take compliance action which can include formal action plans or revocation of the sponsor licence. English language assessments are also considered as part of the Basic Compliance Assessment which sponsors are required to pass on an annual basis.</p> more like this

star this property answer text <p>On 25 March 2022, the Presidential Panel of the Upper Tribunal, concluded in their determination that: <em>“It is amply sufficient to prove the matter on the balance of probabilities, which is the correct legal standard… we do not consider that the evidential burden on the respondent in these cases was discharged by only a narrow margin (as in SM and Qadir v SSHD)”.</em></p><p> </p><p>In view of this, we do not believe there is a need to make any major change in our approach to ETS cases.</p><p>We believe the changes the Home Office has made since 2019 have already brought significant redress this includes grant leave to many who might have otherwise been refused.</p><p>The Department will now look to update the casework guidance in light of RK and DK to ensure applicants are signposted to their right to obtain the voice recording of their TOEIC test from ETS. We believe, in light of the Upper Tribunal’s findings, this to be fairest and most objective way in which an individual can challenge the allegation before them.</p>

star this property answer text <p>From October students will be able to apply for a visa up to six months in advance of the course start date listed on their Confirmation of Acceptance for Studies. This is an extension on the current period of three months.</p><p>Students who require a Secure English Language Test (SELT) must obtain a SELT from an approved provider. A SELT test can be obtained from any of the test centres listed in the below list of approved test centres:-https://www.gov.uk/government/publications/guidance-on-applying-for-uk-visa-approved-english-language-tests</p><p>Higher Education Providers (HEP) with a track record of compliance are able to self-assess the English ability of their students at degree level or above. As part of the Covid-19 concessions, we extended this to also permit HEPs to self-assess the English ability of students on pre-sessional courses.</p> more like this
