star this property answer text <p>Following my response of 29 June 2015 to Question 3767, the latest published Transparency Data showed that since our operational response to the ETS English language testing fraud began we had suspended, at one time or another, 94 private colleges from the Tier 4 sponsor register by the end of Quarter 1 calendar year 2015. star this property answer text <p>English language ability is a key strand of the immigration requirements for many of those coming as partners and to work, study and settle in the UK. Significant abuse within the English language testing sector was uncovered in 2013/2014, following which the Home Office commissioned an independent review. A key outcome was the need to develop new and robust business and commercial requirements for Secure English Language Testing (SELT). The Home Office has rightly responded to that abuse robustly, particularly considering that thousands of people sought to use evidence that was obtained fraudulently to enter and remain in the UK. The new, strengthened arrangements for SELT came into effect on 6th April 2015.</p><p>One of the security changes introduced was the reduction of the test centre network to mitigate the risks of oversupply and enable the Home Office to achieve greater control and ability to audit centres.</p><p>Whilst the Home Office has reduced the number of test centres, it has increased the number of countries where students could sit tests. Before the 6th April students could sit tests in 79 countries (excluding the UK), they can now sit tests in 129 countries.</p><p>The Home Office has planned the reduced test centre network to meet anticipated demand and test centres in each country are currently meeting demand.</p><p>We continue to have a highly competitive offer for international students who would like to study at our world-class institutions and this is borne out by the figures: visa applications from international students to study at British universities are up by 17 per cent since 2010, whilst visa applications to our world-leading Russell Group institutions are up by 33 per cent since 2010.</p>

star this property answer text <p>Parliament legislated to amend the appeals system in the Immigration Act 2014 so that an appeal only arises where a claim raising asylum, humanitarian protection or human rights is refused, where protection status is revoked and for deprivation of citizenship. Similar provisions are set out in the Immigration (European Economic Area) Regulations 2016. Given the passage of time, many of those refused on the basis of alleged cheating in English language tests will now have arguable human rights claims. Even if refused, these will normally generate an in-country right of appeal.</p><p>The Home Secretary is considering the findings of the National Audit Office report in response to cheating in English language tests. He will then make a statement to Parliament.</p> more like this

star this property answer text <p>Following the changes introduced by the Immigration Act 2014 there is only a right of appeal where fundamental rights are engaged - where a protection claim is refused, where protection status is revoked or where a human rights claim is refused. There is also a right of appeal against decisions under the EEA Regulations and there is an appeal right against a decision to deprive someone of citizenship. For Tier 4 students, this came into effect for applications made on or after 20 October 2014.</p><p>For applications made prior to 20 October 2014, where the person had leave to remain in the UK and at the time of the decision to refuse would have no leave left, the right of appeal was exercised from within the UK. Where the decision appealed against was a removal decision, and human rights had not been raised, that right was exercised from overseas; the Court of Appeal has consistently upheld that the availability of an out of country appeal in respect of a relevant decision in an ETS case is an adequate remedy.</p>
