unstar this property answer text <p>Ministers and officials from my Department and across Government continue to engage broadly across all sectors - including the financial services sector - and across the UK to hear the business’ priorities and issues relating to our exit.</p><p>The Secretary of State and all the ministers in my Department met with business leaders from across the economy to discuss the White Paper at Chevening House on 20 July. This included a deep dive session on financial services with major firms and financial institutions, which included discussions on the proposed new economic and regulatory arrangement.</p><p>In addition, ministers and officials in the Treasury continue to engage closely with firms across the Financial Services sector on the White Paper and wider EU exit issues.</p><p>The proposals outlined in the White Paper set out an ambitious and credible proposition for a close future relationship on financial services with the EU. This would provide stable and predictable access to each other’s markets, while recognising that the UK and the EU will exercise autonomy over regulatory decisions through domestic equivalence processes, and protect financial stability.</p>

unstar this property answer text <p>The Prime Minister has been clear that safeguarding the rights of EU citizens living in the UK, and UK nationals living in the UK, is her first priority for negotiations.</p><p><strong> </strong></p><p>We have reached an agreement with the EU on the rights of EU citizens living in the UK, as set out in the draft legal text of the Withdrawal Agreement. The agreement confirms that all EU citizens legally resident in the UK by December 2020 will be able to continue living their lives broadly as now.</p><p><strong> </strong></p><p>The Home Office published a Statement of Intent on 21 June, providing further details about how EU citizens and their families can obtain settled status. The process will be straightforward and streamlined and we will support applicants to get the right outcome.</p><p><strong> </strong></p><p>We have published a White Paper on the EU (Withdrawal Agreement) Bill which will implement the Withdrawal Agreement we reach with the EU in UK law. This sets out the detail on how the Bill will legislate for key elements of the Withdrawal Agreement, including the agreement on citizens’ rights.</p><p> </p>

However, a responsible government should prepare for all potential outcomes, including the unlikely scenario in which no mutually satisfactory agreement can be reached. That is exactly what we are doing.</p><p>In the event of a no deal scenario, the Government’s objective is to ensure that movement through ports is as frictionless as possible, whilst maintaining safety and security. unstar this property answer text <p>In its White Paper the Government is advancing a detailed proposal for a principled and practical Brexit, including in financial services.</p><p> </p><p>The UK proposes a new economic and regulatory arrangement with the EU in financial services. This would maintain the economic benefits of cross-border provision of the most important international financial services traded between the UK and the EU.</p><p> </p><p>We have also listened to the other side’s concerns and understand the need for a new and fair balance in our rights and obligations in relation to financial services. As such, our proposal recognises the EU’s desire to have control over its own decision making but it also reflects the deeply integrated nature of UK and EU financial markets.</p><p> </p><p>We have suggested how this could be done, by setting out that the new arrangement should include provisions for:</p><ul><li><p>common principles for the governance of the relationship;</p></li><li><p>extensive supervisory cooperation and regulatory dialogue; and</p></li><li><p>predictable, transparent and robust processes.</p></li></ul><p> </p><p>We believe this proposal is the best option for getting a good deal for both the EU and the UK, and we look forward to discussing it with them.</p><p><strong> </strong></p>

unstar this property answer text <p>The Government continues to engage broadly across the economy, to hear businesses' views as we leave the EU, including those representing the tourism and hospitality industries. The Secretaries of State for DExEU and BEIS and the Chancellor of the Exchequer co-chair a EU Exit Business Advisory Group to ensure business is not only heard but is influential throughout the negotiations. The meeting is attended by senior officials from the Confederation of British Industry (CBI), Institute of Directors (IoD), Manufacturers’ Association (EEF), British Chambers of Commerce (BCC) and Federation of Small Businesses (FSB). DExEU Minister Robin Walker has also twice attended the Tourism Industry Council and the former Immigration Minister Brandon Lewis MP held a roundtable with the hospitality sector.</p><p><strong> </strong></p><p>The Government has also asked the independent Migration Advisory Committee (MAC) to gather evidence on patterns of EU migration and the role of migration in the wider economy, ahead of our exit from the EU. In their interim report published in March, the MAC reported that they had received 417 responses from a wide range of sectors and businesses - a record for a MAC commission. The MAC is due to publish their final report in September and the Government will take account of their findings when designing our future immigration system.</p><p> </p>

unstar this property answer text <p>The White Paper on the Future Relationship between the United Kingdom and the European Union was published on the GOV.UK website and shared in a letter to the Chairs of the European Union Committee and the Commons Exiting the European Union and European Scrutiny Committees at the moment the Secretary of State stood up to make his statement.</p><p><strong> </strong></p><p>Copies of the White Paper were put in the libraries of both Houses at 0930 on 12 July but due to an administrative error, the White Paper was not distributed to Members of the House of Commons ahead of the debate. There was no intent on the Government’s part to withhold information from the House and the Secretary of State has apologised for this oversight.</p> more like this

unstar this property answer text <p>Our proposals are for a common rulebook for goods, covering those rules necessary to ensure that there is frictionless trade at the border, alongside a business-friendly facilitated customs arrangement. This is in the interest of both EU and the UK and will enable us to protect integrated supply chains and meet our joint commitment on the Ireland-Northern Ireland border.</p><p><strong> </strong></p><p>As part of the agreement, the UK would also seek participation in relevant EU technical committees and agencies that have a role in designing and implementing rules that form part of the common rulebook. Where the UK has chosen to apply a common rulebook Parliament would have a lock on incorporating rules into the UK legal order, recognising that choosing not to pass the relevant legislation would have consequences.</p> more like this

unstar this property answer text <p>The Prime Minister was clear in the speech she gave at Lancaster House in January 2017 that in leaving the EU we will end the jurisdiction of the CJEU in the UK. Our proposal delivers on that commitment.</p><p> </p><p>Rights that flow from our future relationship will be enforced in the UK by UK courts and in the EU by EU courts - with no more preliminary references from UK courts to the CJEU.</p><p> </p><p>In those areas where we have a common rulebook, it will be important for businesses and citizens here and in the EU that they are interpreted and applied consistently, so our courts will pay due regard to the relevant CJEU case law when deciding a case.</p><p> </p><p>If there is a dispute that relates to the common rulebook, the Joint Committee or an independent arbitration panel will be able to ask the CJEU to give an interpretation of a common rule. However, it will fall to the Joint Committee or the arbitration panel to decide the dispute itself, consistent with the essential principle that the court of one party cannot resolve disputes between the two.</p>

The White Paper: The future relationship between the United Kingdom and the European Union sets out that the UK will make a sovereign choice in a defined number of areas to seek reciprocal mobility arrangements with the EU, for example to allow business professionals to move to provide services, or tourists to continue to travel freely without a visa. This is in line with the arrangements that the UK might want to offer other close trading partners in future, where they support new and deep trade deals.</p> more like this

unstar this property answer text <p>Following our exit from the EU, the UK will no longer be a Member State and will no longer have elected representation in the EU institutions. With regard to the Northern Ireland Protocol to the draft Withdrawal Agreement, the UK has been clear, and has reaffirmed, that we are committed to turning all of the commitments in the December Joint Report into legally binding text in the Withdrawal Agreement. Negotiations are ongoing and the Government has set out our proposed approach on the customs element of the backstop, the Temporary Customs Arrangement. The Government is committed to accelerating discussions on the backstop, alongside intensifying negotiations on the future relationship.</p><p><strong> </strong></p><p>Any negotiated outcomes will need to be compatible with our international obligations under the European Convention of Human Rights.</p> more like this

unstar this property answer text <p>The report shows a misunderstanding of the Northern Ireland and Ireland context and proposes a fundamental redesign of the Common Travel Area (CTA), which neither the UK, Ireland or the EU have ever envisaged.</p><p> </p><p>Whilst there are some parallels with the work we are developing on the wider UK-EU border model that would apply, for example, to the border between Dover and Calais, this report proposes a form of hard border, albeit an efficiently managed one, for the Northern Ireland-Ireland land border and is therefore fundamentally inconsistent with Government policy and the commitments we have made.</p><p> </p><p>It is unacceptable to suggest any solutions which would require physical infrastructure at the border. Both the UK Government and Irish Government have explicitly ruled this out, as the removal of physical checks and security installations has been a key dividend of the peace process.</p> more like this

unstar this property answer text <p>The UK has made clear both in public and during discussions with the EEA EFTA states that we will be leaving the European Economic Area (EEA). Continued participation in the EEA Agreement beyond the implementation period would not pass the tests that the Prime Minister set out for our future economic partnership with the EU in that it would not deliver control of our borders or our laws.</p><p>In the absence of any further action, the EEA Agreement will no longer operate in respect of the UK when we leave the EU in March 2019.</p><p>However, at the March European Council we agreed with the EU that the UK is to be treated as a Member State for the purposes of international agreements for the duration of the implementation period; this includes the EEA Agreement.</p><p>Once the implementation period ends, the EEA Agreement will no longer apply to the UK. We will seek to put in place new arrangements with these countries for the end of the implementation period.</p> more like this

unstar this property answer text <p>The PM set out in her Mansion House speech the UK’s ambition for a future relationship with the EU that allows for a high level of reciprocal market access.</p><p>For goods, the UK will need to make a strong commitment that its regulatory standards will remain as high as the EU’s. UK law may not necessarily be identical to EU law, but it should achieve the same outcomes. In some cases Parliament might choose to pass an identical law – businesses who export to the EU state it is strongly in their interest to have a single set of regulatory standards which means they can sell into the UK and EU markets.</p><p>If the Parliament of the day decided not to achieve the same outcomes as EU law, it would be in the knowledge that there may be consequences for market access.</p><p>There will need to be an independent mechanism to oversee these arrangements.</p><p> </p> more like this

In March we confirmed that we had reached agreement on the implementation period, on citizens’ rights and on the financial settlement. We recently published a joint statement setting out the further progress we have made in locking down the text on many separation issues and we have now reached agreement on the vast majority of the Withdrawal Agreement.</p><p> </p><p>Given this, agreeing a deal is increasingly likely. Nevertheless, as a responsible government we are preparing for all possible outcomes. Departments’ plans are well developed and are designed to respond to all scenarios, including the unlikely possibility that we leave the EU without a deal in place. unstar this property answer text <p>The Government has always been clear that we are committed to engaging the Crown Dependencies and Overseas Territories as we exit the EU, to ensure that their interests and priorities are properly taken into account.</p><p> </p><p>We are seeking a bold and ambitious economic partnership with the EU and want to have the greatest possible tariff- and barrier-free trade with our European neighbours, so that British companies, including Falkland Islands companies, have the maximum freedom to trade with and operate within European markets.</p><p> </p><p>DExEU Minister of State Robin Walker most recently met Hon. Teslyn Barkman, the Falklands Legislative Assembly Member leading on Exit issues, at the 4th Joint Ministerial Council Overseas Territories EU Negotiations held on the 14th of June. Through discussions in this forum, supported by official level contact, the Government understands the importance to the economic wellbeing of the Falklands Islands of their access to the EU market for fish and meat.</p><p> </p><p>We also welcome the substantive input we have received from the Falkland Islands’ Government as the UK prepares to exit the EU.</p>

However, section 6(2) of the Act provides that our domestic courts and tribunals can take into account anything done by the EU, the Court of Justice of the European Union, or any other EU entity after we leave the EU, if it is relevant to any matter before them. unstar this property answer text <p>From the very beginning the Prime Minister has been clear that safeguarding the rights of UK nationals living in the EU, and EU citizens living in the UK, was her first priority for negotiations.</p><p> </p><p>The agreement reached and set out in the Withdrawal Agreement text will provide them with certainty about their rights going forward.</p><p> </p><p>This will mean that all UK nationals resident in the EU by December 2020 will be able to continue living their lives broadly as they do now in their country of residence.</p><p> </p><p>It will be for each Member State to determine how they will confirm the rights of UK nationals under the Withdrawal Agreement.
