	answer	answer is ministerial correction date of answer 20/10/2020 answer text <p>The illegal dumping of waste, including fly-tipping, is an unacceptable blight on local communities and the environment. The government is committed to cracking down on the waste and carelessness that destroys our natural environment and kills marine life. We are also committed to increasing the penalties for fly-tipping.</p><p> </p><p>Over the last five years we have strengthened and expanded the powers available to tackle the illegal dumping of waste. Local authorities have the power to issue fixed penalty notices of up to £400 to those caught fly-tipping or to householders who pass their waste to a fly-tipper. Vehicles of those suspected of committing a waste crime, including illegal dumping, can be searched and seized.</p><p> </p><p>Those accused of illegal dumping can be prosecuted and, on conviction, can face a fine, up to 12 months imprisonment, or both in a Magistrates Court; or a fine, up to 5 years imprisonment, or both, in a Crown Court. Local authorities carried out a total of 2,397 prosecutions for fly-tipping offences in England in 2018/19, an increase of 7% on 2017/18. The value of total fines increased by 29% to £1,090,000 compared to 2017/18.</p><p> </p><p>We have invested £60 million in the Environment Agency’s waste crime enforcement work since 2014. This year’s Budget committed the government to investing £7.2 million in the development of electronic waste tracking, as well as £0.5 million in 2020/21 to support innovative approaches to tackling fly-tipping.</p><p> </p><p>In the Resources and Waste Strategy we committed to reforming the regulation of waste carriers, tightening up the regulation of the waste exemptions regime and improving intelligence sharing and joint working between enforcement agencies. The Joint Unit for Waste Crime, led by the Environment Agency and including the National Crime Agency, HMRC, the Police and others, was established earlier this year and has already had a number of operational successes.</p><p> </p><p>The Environment Bill includes a number of measures to help tackle waste crime. This includes significantly raising the upper limit on the penalties councils can issue to £1,000 for fly-tipping and £600 for householders who give their waste to an unauthorised carrier, which we did in July. We have also increased transparency on the use of these penalties by publishing league tables and consulted stakeholders on ringfencing the money raised from these penalties for enforcement and clean up activity.</p><p> </p><p>This builds on the £1.2m Defra has provided in grant funding to help more than 30 councils implement projects cracking down on fly-tipping. A selection of case studies from round one are available online so that others can learn about those interventions which were most successful. These can be found at <a href="https://www.keepbritaintidy.org/fly-tipping-intervention-grant-scheme" target="_blank">https://www.keepbritaintidy.org/fly-tipping-intervention-grant-scheme</a>. We have recently launched another grant opportunity that could see a further £1m handed out in grants to help more councils tackle the issue.</p><p> </p><p>With the National Fly-Tipping Prevention Group, we are developing a toolkit to help councils and others tackle fly-tipping. So far, the group has published a guide on how to present robust cases to court and a new framework which sets out how to set up and run effective local partnerships. Our 2018 Resources and Waste Strategy set out our strategic approach to tackling waste crime, including fly-tipping. Our focus is on enabling local action by providing a clear legal framework of rights, responsibilities and powers and setting national standards.</p><p>Local authorities and the Environment Agency are encouraged to work in partnership with national and local police bodies in carrying out their enforcement functions against fly-tipping. Defra are working with a wide range of interested parties through the National Fly-Tipping Prevention Group (NFTPG) to raise awareness of fly-tipping and to develop a fly-tipping toolkit. Members of the NFTPG include local authorities, the National Police Chiefs Council and the Environment Agency. These include the power to issue fixed penalty notices (FPNs) of up to £400 for fly-tipping offences, including to those caught fly-tipping and householders who pass their waste to a fly-tipper. Local authorities also have enhanced powers to search and seize vehicles of suspected fly-tippers. Powers to issue FPNs provide local authorities with an efficient mechanism to hold fly-tipping perpetrators to account without having to go to court, which can be a time consuming, resource-intensive and expensive process. Additionally, the ability to issue FPNs can deter potential fly-tippers from fly-tipping in the first place.</p><p> </p><p>Local authorities also have the ability to take those accused of fly-tipping to court. If a fly-tipper is convicted, it is punishable by up to £50,000 or 12 months imprisonment if convicted in a Magistrates' Court. The offence can attract an unlimited fine and up to 5 years imprisonment if convicted in a Crown Court. Defra has already worked with the Sentencing Council to amend sentencing guidance for magistrates to ensure that they are aware of local fixed penalty levels for these offences. The Resources and Waste Strategy published in December 2018 includes a number of commitments to improve this, including working with the Sentencing Council to increase magistrates’ awareness of the prevalence and importance of waste crime, helping local authorities improve the quality of cases and ensuring that the Environmental Offences Definitive Guideline is kept up to date and that magistrates are effectively trained on it.</p><p> </p><p>Recent figures showed that there were 76,000 fixed penalty notices issued by local authorities in 2018/19, up by 11% from 2017/18. This included a commitment to strengthen sentences for fly-tipping and develop a fly-tipping toolkit. The toolkit, which will be developed with the National Fly-tipping Prevention Group, will be a web-based tool to help local authorities and others work in partnership to tackle fly-tipping.</p><p> </p><p>In recent years we have also bolstered local authorities’ powers to tackle fly-tipping. We have introduced the power to issue fixed penalty notices of up to £400 to both fly-tippers and householders who pass their waste to an unlicensed waste carrier. We have also provided local authorities with powers to stop, search and seize vehicles of suspected fly-tippers.</p><p> </p><p>In April 2021 we commissioned a research project considering the drivers, deterrents and impacts of fly-tipping. This research project is due to be completed before the end of this year and will support informed policy making. We are exploring additional funding opportunities, including the role of digital solutions.</p><p> </p><p>We are also preparing a number of legislative reforms to tackle waste crime, which should help to tackle fly-tipping. We are taking forward the commitment in the Resources and Waste Strategy to develop proposals for the reform of the waste carrier, broker, and dealer regime. We are working with industry and the regulator and we intend to consult later this year. We also intend to consult on the introduction of mandatory electronic waste tracking. Digital records of waste movements will allow regulators to detect when waste doesn’t reach the next stage, which may indicate illegal activity including fly-tipping.</p><p> </p><p>We are bringing forward several measures in the Environment Bill to ensure agencies and authorities can work more effectively to combat waste crime through better access to evidence and improved powers of entry. We have raised the upper limit for fixed penalties for fly-tipping to £1,000 and taken steps to encourage councils to issue more of these penalties.</p><p> </p><p>We are developing a toolkit with the National Fly-Tipping Prevention Group, to help councils and others tackle fly-tipping. This includes a guide on how to present robust cases to court and a new framework on setting up and running effective local partnerships.</p><p> </p><p>We have also awarded nearly £1.2m to help more than 30 councils purchase equipment to tackle fly-tipping at known hot-spots. We have recently launched another grant opportunity that could see a further £1m handed out in grants next year to help even more councils tackle the issue.</p><p> </p><p>The Environment Agency (EA) investigates fly tipping if the incidents are large-scale, serious, organised illegal dumping or if it immediately threatens human health or the environment. They work in partnership with other local partners such as the police, local authorities, the fire service and United Kingdom Health Security Agency (UKHSA) as needed. This includes seeking advice from UKHSA about public health risks from illegal waste activities if necessary.</p><p> </p><p>As part of its partnership work the EA has provided advice and guidance to the London Borough of Havering to help deal with a specific site in Havering and will continue to do so. The council is the lead authority on regulating this particular site and for monitoring air quality. These new enforcement tools have been available to councils since May 2016, providing them with an alternative to prosecutions and assisting them in taking a proportionate enforcement response.</p><p> </p><p>This builds on other Government action to tackle fly-tipping, which has included:</p><p> </p><ul><li><p>Introducing stronger powers for local authorities and the Environment Agency to seize vehicles of those suspected of waste crime.</p></li></ul><p> </p><ul><li><p>Cracking down on offenders by working with the Sentencing Council to ensure sentences act as a real deterrent to offending. New guidance came into force on 1 July 2014.</p></li></ul><p> </p><ul><li><p>Strengthening the waste duty of care by publishing a revised Waste Duty of Care Code of Practice, that provides guidance to local authorities, regulators, waste industry and all those that produce, keep, import, treat, have control or dispose of controlled waste on how to comply with their waste duty of care obligations.</p></li></ul><p> </p><ul><li><p>Supporting the industry-led Right Waste Right Place campaign to promote Duty of Care to small businesses. The campaign will be targeting construction, retail and agricultural businesses.</p><p> </p></li><li><p>Chairing the National Fly-Tipping Prevention Group (NFTPG) to prevent and tackle illegal dumping. The NFTPG includes representatives from central and local Government, enforcement authorities, the waste industry, and private landowners.
