answer text <p>The publication of the myth-busting guide, published in July 2018, was intended to clarify certain areas of the statutory guidance which practitioners had said were ambiguous or had given rise to incorrect assumptions about what is permissible.</p><p>When we received the letter from children’s rights organisations and experts we replied to make clear that nothing in the guide sought to alter legislation and that statutory guidance remained in force.</p><p>Our statutory guidance continues to set out how local authorities should operate in order to provide the best services for vulnerable children and young people and make sure everyone is given the chance to succeed.</p> more like this

answer text <p>Following extensive engagement with interested parties, the Department for Education and the Department for Health and Social Care launched a consultation on draft guidance on reducing the need for restraint and restrictive intervention for children and young people with learning disabilities, autistic spectrum conditions or mental health needs. The consultation sought views on how well the draft guidance would help a range of settings and services to support children and young people recognised as being at higher risk of restraint. The proposed scope of the guidance was health and care settings, special schools and specialist colleges.</p><p> </p><p>The consultation closed last year and we are currently considering the responses.</p><p> </p> more like this

answer text <p>To teach a class of pupils with vision impairment, a teacher must hold a mandatory qualification, in addition to qualified teacher status. The Department is currently reviewing the educational outcomes of the mandatory qualifications for teachers of classes with vision impairment, to ensure they reflect the changing needs of the education system.</p><p>The Children and Families Act 2014 requires local authorities to work with parents, young people, and schools and colleges to keep the provision for children and young people with special educational needs and disability (SEND) under review and to consider carefully how best to meet the needs of children and young people in their area, including those with vision impairment. To support local authorities, the Department has announced an additional £250 million high needs funding, over this year and the next. This will bring the total allocated for high needs next year to £6.3 billion.</p><p> </p><p>In addition, £3.4 million is being provided for 2018 to 2020 to equip the school workforce to deliver high quality teaching across all types of SEND, including vision impairment.</p><p> </p>

answer text <p>All schools have duties under the Equality Act (2010) towards individual disabled children and young people, including:</p><ul><li>to make reasonable adjustments, including the provision of auxiliary aids and services, to prevent them being put at a substantial disadvantage;</li><li>not to discriminate in relation to their disability; and</li><li>to publish accessibility plans setting out how they plan to increase access for disabled pupils to the curriculum, the physical environment and to information. (Local authorities have parallel duties to publish accessibility strategies.)</li></ul><p>Complementing this, the Children and Families Act (2014) places duties on schools to use their ‘best endeavours’ to make special education provision for those who need it, many of whom will have disabilities.</p><p>Taken together, this amounts to a range of exacting duties on schools in relation to disability.</p><p>To support schools in meeting those duties, in relation to vision impairment and more broadly, we are providing £3.4 million funding over 2018-2020, for the special educational needs and disabilities (SEND) schools’ workforce contract, which will be delivered by the Whole School SEND consortium, led by the National Association for Special Educational Needs, nasen. Our aim is to embed SEND into school-led approaches to school improvement in order to equip the workforce to deliver high quality teaching across all types of SEND. As part of this programme of work, we are also reviewing the learning outcomes of specialist SEND qualifications, including the mandatory qualifications for teachers of classes with vision impairment, to ensure they reflect the changing needs of the education system.</p>

answer text <p>In relation to qualifications, this is a matter for Ofqual, the Office of Qualifications and Examinations Regulation. I have asked its Chief Regulator, Sally Collier, to write to the Hon. Member and a copy of her reply will be placed in the Libraries of both Houses. <br> <br> Ofqual regulates statutory national curriculum assessments. In doing this they have two statutory objectives: to promote the development and implementation of national assessments which give a reliable indication of achievement and indicate a consistent level of attainment, including over time, between comparable assessments; and to promote public confidence in national assessments. Ofqual has no specific powers to follow up with the Standards and Testing Agency (STA) if there are mistakes in national tests. Modified tests are developed by a Modified Test Agency contracted to STA, who conduct Quality Assurance proofing at different stages in the development of materials. STA also engages external proofers during this process to ensure that any errors in questions are detected and rectified before materials are sent to schools.</p>
