star this property answer text <p>All claims received are considered on their individual merits and in line with the Department's legal liability. Part of this process is to take a view as to whether a claim falls outside the limitation period. Records are not kept of the number of claims in which the Courts have heard limitation cases in which the Claimant is seeking discretion in the application of the time limit relevant to their claim against the Department.</p><p>The proposed civil litigation longstop will not preclude Service personnel or civilians deployed on overseas operations from bringing claims in relation to PTSD or other conditions that manifest or are diagnosed beyond that limit, as Section 11 of the Limitation Act calculates time limits from the later of (a) the date on which the cause of action accrued or (b) the date of knowledge.</p> more like this

Member to the answer I gave her to Question 163772.</p><p> </p><p>The Army Recruiting and Initial Training Command (ARITC), within Home Command, is responsible for delivering recruitment to the Regular and Reserve Army through the Recruiting Partnering Project contract with Capita. ARITC oversees the Army Recruiting Group, which includes the National Recruitment Centre (NRC) and local Army Careers Centres, and is staffed by a mixture of Capita staff and Army personnel.</p><p> </p><p>When candidates initiate an application to join the Army Reserves through the NRC, they are matched with a unit based on their location and declared role preference. On some occasions a candidate will be encouraged to consider a specialist or pinch-point trade unit if they present the relevant qualifications and experience.</p><p> </p><p>Recruiting Group are in daily liaison with Reserve Units at all levels to support the recruitment process.</p><p> </p> more like this

star this property answer text <p>The consultation on Legal Protections for Armed Forces Personnel and Veterans will close on 13 October 2019. The Ministry of Defence will study carefully the responses on its proposals (on a statutory presumption against prosecutions arising from overseas incidents occurring more than 10 years previously; on a partial defence that takes account of the operational context; and on limiting the courts’ discretion to extend the three-year time limit for bringing civil claims for personal injury or death) before deciding how to take these measures forward.</p><p> </p><p>The proposed civil litigation longstop will not preclude Service personnel or civilians deployed on overseas operations from bringing claims in relation to PTSD or other conditions that manifest or are diagnosed more than 10 years after the incident which caused the condition, as section 11 of the Limitation Act calculates time limits from the later of (a) the date on which the cause of action accrued or (b) the date of knowledge.</p>

star this property answer text <p>The Service Justice Board concerns itself with ensuring that the Service Justice System provides a fair system of justice for those who are alleged to have breached Service Law, and that the system is also able to support the Chain of Command in delivering operational effectiveness; the Service Complaints Ombudsman is not a member.</p><p> </p><p>The Service Complaints Ombudsman is provided with an annual budget from defence funds which, under the financial delegation given to her, is used to meet all the costs associated with her independent function; this includes the procurement of any legal advice. The amount spent by the Ombudsman’s office on legal advice varies year on year, and is detailed in the financial expenditure statements in her annual reports to Parliament on the fairness, effectiveness and efficiency of the Service Complaints system. These reports – and those submitted by the Service Complaints Commissioner, can be found at the following address:</p><p> </p><p>http://www.servicecomplaintsombudsman.org.uk/service-complaints-ombudsman/publications-and-reports/annual-reports/.</p><p> </p><p>The Annual Report for 2018 will be available in the first quarter of 2019.</p><p> </p><p>It will take time to collate the detailed information requested on investigation officers and I will write to the hon.
