Member is referring to cases where administrative action was taken, under AGAI Chapter 67 or the equivalent regulations in the Naval Service and RAF, against Service personnel who had been in receipt of a simple police caution, after the amendment to the Rehabilitation of Offenders Act 1974 made by section 49 the Criminal Justice and Immigration Act which came into force on 19 December 2008.

The range of administrative sanctions which could have been applied in such circumstances is extremely wide, ranging from a formal warning to termination of service.
