answer text <p>Since 1 October 2013, 210 employers have been named under the National Minimum Wage naming scheme.</p><p> </p><p>HMRC has issued 333 Notices of Underpayment (NoUs) since 29 January 2015. Of these, 274 were for investigations that commenced on or after 1 October 2013 and are therefore eligible for naming under the new scheme.</p><p> </p><p>Since 29 January 2015, the Department for Business, Innovation and Skills has named 118 employers, of which 4 employers were issued an NoU after that date. The Department expects to name more employers shortly.</p> more like this

answer text <p>The Government is committed to increasing compliance with National Minimum Wage legislation and the effective enforcement of it. HMRC responds to every complaint it receives and conducts risk-based enforcement in sectors or areas where there is perceived to be a higher risk of workers not being paid the National Minimum Wage.</p><p> </p><p> </p><p> </p><p>The Government has increased the NMW penalty so that employers that break the law face a penalty equivalent to the arrears they owe, up to a maximum penalty of £20,000 per worker.</p><p> </p><p> </p><p> </p><p>Employers are also named publically under the Government’s NMW naming scheme for non-payment. So far, 210 employers have been named for non-payment of the National Minimum Wage and have been charged financial penalties totalling over £248,000. In total, HMRC has recovered over £57m in arrears for workers since 1999/2000.</p><p> </p><p> </p><p> </p><p>Prosecution is reserved for the most serious cases. HMRC will refer cases to the Crown Prosecution Service who will decide whether to prosecute. Prosecution does not necessarily result in arrears being paid to workers.</p><p> </p><p> </p><p> </p><p>The number of NMW prosecutions for non-compliance in each of the last five years is set out below:</p><p> </p><p> </p><p> </p><p>2014: 0</p><p> </p><p>2013: 1</p><p> </p><p>2012: 0</p><p> </p><p>2011: 0</p><p> </p><p>2010: 1</p><p> </p><p> </p><p> </p><p>Anyone who thinks they might be entitled to the minimum wage but have not been paid it should call the ACAS Helpline on 0300 123 1100.</p><p> </p><p> </p><p> </p><p> </p><p> </p><p> </p><p> </p><p> </p><p> </p>

answer text <p>Since 1 April 2014, the lowest paid contracted staff at the Department for Business, Innovation and Skills (BIS) offices across the UK have been paid £7.85 per hour, up £1.40 or nearly 22% from the previous £6.45 per hour rate. This increase restored and surpassed the real value of wages that had fallen in recent years. This means that BIS contractors are amongst the top 25% of contractors across Whitehall.</p><p> </p><p> </p><p> </p><p>We absolutely encourage suppliers to pay above the National Minimum Wage where affordable and without cutting jobs - but this is a decision that must be taken by the suppliers themselves. We will always award contracts on the basis of the best value for money for the taxpayer most often following a competitive process, making use of the Crown Commercial Frameworks to ensure a consistent application with the rest of Government.</p><p> </p> more like this

answer text <p>276 Notices of Underpayment have been issued by HMRC since 1 October 2013 where the investigation started on or after that date. All of these cases will be considered for naming under the revised BIS naming scheme. We have already named 92 employers under the new scheme and we will name more soon.</p><p> </p><p> </p><p> </p><p>After the Notice of Underpayment is issued, employers have 28 days to pay back the arrears they owe and the penalty, or they can lodge an appeal against the NOU. HMRC then issue a case closure letter. From the date of that letter, the employer has 14 days to make a representation to BIS as to why they should not be named.</p><p> </p><p> </p><p> </p><p>Any worker who is concerned that they have not been paid the minimum wage should call the Pay and Work Rights Helpline on 0800 917 2368.</p><p> </p> more like this

answer text <p>The recruitment sector is regulated by the Employment Agencies Act 1973 and the Conduct of Employment Agencies and Employment Businesses Regulations 2003 (the ‘Conduct Regulations’). The Conduct Regulations require employment businesses to agree a number of terms with the work-seeker, including whether the work-seeker will be employed under a contract of service or apprenticeship, or a contract for services, and the rate of pay that will apply.</p><p> </p><p> </p><p> </p><p>The Employment Agency Standards Inspectorate is not aware of any complaints about work-seekers being deliberately wrongly designated as apprentices.</p><p> </p> more like this

answer text <p>The term “intern” is not defined in any legislation: entitlement to the minimum wage depends on whether or not an individual is a worker. If an internship meets the legal definition of a worker, then they must be paid at least the minimum wage from the start.</p><p> </p><p> </p><p> </p><p>Given this dependency on employment status, it is vital that employers and workers understand how this is determined. We continue to carry out targeted awareness raising initiatives with interns and HMRC have been working with employers to identify potential non-compliance.</p><p> </p><p> </p><p> </p><p>Complaints from interns about non-payment of the minimum wage are prioritised by HMRC for investigation and HMRC will investigate every complaint made to the Pay and Work Rights Helpline. Any worker who believes that they are being paid below the minimum wage should call the helpline on 0800 917 2368.</p><p> </p><p> </p><p> </p><p>Determining an individual’s employment status can be complicated. This is why the Business Secretary announced a review of employment status in October this year, to help ensure an employment status framework in the UK that meets the needs of everyone. This is an internal review and will present findings to ministers early next year.</p><p> </p>
