It is up to individual schools to apply to convert to become academies unless they are underperforming, in which case the department will look to match them with a sponsor.</p><p>Between 2010 and 2012, local authorities held 41 competitions under section 7 of the Education and Inspections Act 2006, as amended by the Education Act 2011, to create new schools. The statutory guidance for schools makes it clear that this is likely to be particularly useful for pupils with special educational needs (SEN), learning difficulties or disabilities; and that this group of pupils should receive advice about all of the education, training and employment opportunities on offer and information on the full range of specialist provision.</p><p> </p><p>The statutory guidance also emphasises the need for schools to have high aspirations for all pupils with SEN, learning difficulties or disabilities. It requires schools to work with local authorities around the provision of specialist support services. Where a student has an Education, Health and Care Plan, this must include a focus on preparing for adulthood, including employment, independent living and participation in society. It is up to the classroom teacher to determine how they should teach. Ofsted’s judgements on teaching are predicated on whether children are learning, progressing and achieving good outcomes.</p><p> </p><p>We recognise the importance of Ofsted delivering a consistently good service across a broad remit.
