answer text <p>Under international law, the United Kingdom has undertaken to comply with the European Convention on Human Rights. The Human Rights Act 1998 gives further effect in domestic law to certain rights and freedoms drawn from the Convention, called the Convention rights. Section 6(1) of the Act makes it unlawful for a public authority to act in a way which is incompatible with a Convention right. Under section 6(3), “public authority” is defined as including a court or tribunal, and “any person certain of whose function are functions of a public nature”; but does not include either House of Parliament or a person exercising functions in connection with proceedings in Parliament. Section 73(2) of the Care Act 2011 additionally specifies that a provider of regulated care and support that has been arranged or paid for by a local authority or Health and Social Care trust is also to be taken as exercising a function of a public nature for the purposes of the Human Rights Act. Any allegation that a public authority has acted incompatibly with a Convention right may be brought to court as specified in section 7 of the Act.</p><p> </p><p>Guidelines produced by the Organization for Security and Co-operation in Europe are not legally binding.</p>

answer text <p>When someone makes a Lasting Power of Attorney (LPA) a ‘certificate provider’ is required to be impartial and sign the application to certify that the donor is making the LPA by choice, has not been put under any pressure and understands its implications.</p><p> </p><p>Under the Mental Capacity Act 2005 the holder (‘donee’) of a LPA must act in the donor’s best interests, whatever the cause of loss of capacity. The Court of Protection (CoP) has the power to revoke a power of attorney if the donee acts in a way that is not in the donor’s best interests. There may also be a criminal investigation.</p><p> </p><p>Any concerns about the use of a power of attorney should notify the Office of the Public Guardian (OPG) which registers LPAs and has the power to investigate. The OPG acts on such ‘safeguarding referrals’ from relatives, local authorities, care homes and financial institutions. OPG works with organisations such as the CoP, local authorities and the police to protect donors.</p><p>OPG received a total of 2,681 safeguarding referrals during 2015/16 and investigated 876 cases, of which 151 cases resulted in an application to the CoP.</p>

answer text <p>The government continues to encourage more people to go online, so they can access the guidance and services they need – as well as reducing the cost of public services. Through our Digital transformation programme within HMCTS, and MoJ’s Transformation programme which introduces more mobile IT devices we have reduced our reliance on paper. answer text <p>Each prison is required to have at least one family liaison officer or FLO. The FLO acts as the family’s chief point of contact with the prison. They must inform the prisoner’s nominated next of kin in person, as soon as possible following the prisoner’s death. If it is not possible to do this in person, for example because of distance, the FLO must arrange a follow-up visit promptly. They will then continue to meet the family and/or correspond with them, according to their wishes, to offer continuing information and support until all investigations of the death are concluded.</p><p> </p><p>Further details can be found in Prison Service Instruction 64/2011, which can be viewed on gov.uk.</p> more like this

We are taking immediate action to strengthen the frontline by recruiting around 2,500 more prison officers and rolling out improved training for staff on suicide and self-harm reduction.</p><p> </p><p>The Government publishes statistics on deaths in custody quarterly, and updated detailed tables annually.
