answer text <p>As set out by Lord Murray during the passage of the Illegal Migration Bill through parliament, the Home Office will be updating the Adults at Risk in Immigration Detention policy to work with provisions in the Illegal Migration Act. In accordance with section 59 of the Immigration Act 2016, amendments to the statutory guidance will be laid before parliament by statutory instrument in due course.</p><p>A separate, broader review of the Adults at Risk policy is also currently being undertaken and includes reviewing Rule 34 and Rule 35 of the Detention Centre Rules 2001.</p> more like this

answer text <p>Western Jetfoil at Dover is a reception area for individuals rescued from the Channel. Napier Barracks is not a detention facility. No individuals are held under immigration detention at either Western Jetfoil or Napier Barracks.</p><p>Manston is a processing centre and short-term holding facility, not a detention facility. As of 1500hrs on 24 November 2022, no persons were held under immigration detention at Manston. Manston provides a mix of different types of accommodation to allow the Home Office to flex to meet the demands of fluctuating numbers and cohorts of people crossing the Channel. That inevitably brings a level of fluidity to capacity levels.</p> more like this

answer text <p>The government remains committed to using detention only where necessary. Indeed, the vast majority of people liable to be removed from the UK are granted immigration bail.</p><p> </p><p>Stephen Shaw’s reports (from 2016 and 2018) led to a comprehensive and systematic programme of work to improve and reform immigration detention, informing both our strategic and tactical approach to reform and the treatment of people who are detained. The broad programme of reforms has strengthened our decision-making and safeguards for the vulnerable, ensuring those who are detained are treated with dignity and respect in an estate that is fit for purpose.</p><p> </p><p>As part of the Department’s immigration detention reform programme, we conducted two pilots exploring alternatives to detention. In line with international best practice, each pilot ran for two years before final evaluation.</p><p>The first of these pilots, Action Access, provided women who would otherwise be detained with a programme of support in the community. This pilot concluded on 31 March 2021 after operating for two years. The second pilot, the Refugee and Migrant Advisory Service, supported both men and women and concluded in June this year as planned.</p><p>We are working with the United Nations High Commissioner for Refugees (UNHCR) on these pilots and they have appointed the National Centre for Social Research (NatCen) to independently evaluate this work. The evaluation report of the Action Access pilot was published on the 24 January 2022 and the report for the Refugee and Migrant Advisory Service is due to be published early next year. We will use the evaluations of these pilots to inform our future approach to case-management focused alternatives to detention.</p><p> </p><p>The immigration removal estate is kept under ongoing review to ensure sufficient resilience and capacity for the men and women it is necessary to detain for the purposes of removal.</p><p> </p><p> </p><p>In April 2022, faced with an unprecedented situation on the south coast, the Government announced a package of measures to tackle illegal migration, further strengthen safe and legal routes and break the business model of people smuggling gangs. As part of wider work to support this package, the Government announcement confirmed that the removals estate would be expanded. In operating these sites our focus will be on dignity, welfare and safety.</p>

To provide this information would require a manual trawl of case records and to do so would incur disproportionate cost.</p><p>The Adults at Risk in Immigration Detention (AAR) policy strengthens the presumption against the detention of those who are particularly vulnerable to harm in detention. Under the AAR policy, vulnerable individuals will be detained only when the evidence of vulnerability in their particular case is outweighed by the immigration considerations, including expected date of removal, compliance with immigration law, and public protection. Where a decision is taken to maintain the detention of a vulnerable person, safeguards are in place including regular reviews to ensure detention remains lawful, appropriate and proportionate.</p><p>All Home Office staff working in the detention system are given training and support to identify and act upon indicators of vulnerability.</p> more like this

answer text <p>In accordance with the Detention Centre Rules 2001, all detained persons should be provided with an opportunity to participate in activities to meet, as far as possible, their recreational and intellectual needs. This includes the provision of voluntary paid activity opportunities. Rule 17 of the Detention Centre Rules permits those in detention to engage voluntarily in paid activities. These activities are provided to meet the recreational and intellectual needs of detained individuals. In accordance with Rule 17, pay rates are determined by the Secretary of State for the Home Department. The currently approved rates of pay are £1 per hour and, for specified projects, £1.25 per hour, as set out in the published Detention Services Order 1/2013 ‘Paid Activities’. Management information on the number of hours of paid activity undertaken by detained individuals for each year from 2015 is set out in the table below. This is provisional management information that is subject to change.
