All package holidays are subject to the Package Travel, Package Holidays and Package
Tours Regulations 1992. In the event that a tour operator cancels a package the consumer
is entitled to a full refund or to take a substitute package of the same or higher
quality, if offered. If the consumer is offered a replacement of lower quality the
consumer is entitled to receive a refund of the difference in price. It is the consumer’s
choice as to whether to accept a replacement or a full refund.

Tour operators have a general duty of care towards their customers and the
Regulations also make them liable for contractual failure in respect of any of the
services being provided as part of a package. I understand that the industry is reacting
to the situation in Tunisia responsibly. Holidays have been cancelled in the shorter
term, and refunds and alternatives offered. Longer term, consumers are being offered
the chance to change their arrangements with no alteration fees.
