answer text <p>The RSPCA is able to bring prosecutions under the Animal Welfare Act 2006 because that particular piece of legislation allows anyone to do so, even private individuals, if they have the necessary evidence to do so. To identify the exact number of times the CPS took over or forced the discontinuation of a private prosecution brought by the RSPCA would require a manual exercise to review individual files which would incur a disproportionate cost.</p><p> </p> more like this

answer text <p /> <p /> <p>If the RSPCA are investigating an allegation of animal cruelty and the owners do not cooperate or refuse entry to their property, the RSPCA would normally call upon the assistance of the police. The RSPCA has no special powers for entry or search and seizure – these powers lie with police constables and some local authority officers.</p><p> </p><p>As such they would be subject to the law as any member of the public would be.</p> more like this
