answer text <p /> <p /> <p>The latest official statistics, which are available at <a href="http://www.gov.uk/government/uploads/system/uploads/attachment_data/file/341890/benefit-cap-may-2014.pdf" target="_blank">www.gov.uk/government/uploads/system/uploads/attachment_data/file/341890/benefit-cap-may-2014.pdf</a> show that by May 2014, 39% of those no longer subject to the cap, 7,400 households, have moved into work, as shown by them having an open Working Tax Credit claim. In addition to this there may be a small number of cases who have moved into work with sufficiently high salaries that they are not entitled to Working Tax Credit.</p><p> </p><p>The DWP will be evaluating the policy and, where possible, its impacts on employment later this year and expect to publish these findings in autumn 2014.</p><p> </p> more like this

[204826]</p><p> </p><p>Mike Penning: Claims to attendance allowance, disability living allowance, employment and support allowance, incapacity benefit and personal independence payment from people who are terminally ill, as defined in law, are fast tracked. Claimants are considered to be terminally ill if they have a progressive disease as a result of which they are not expected to live longer than six months. Motor neurone disease is considered to be a progressive disease.</p> more like this

Claimants who consider their assessment has been delayed by Atos or Capita should in the first instance take this up with the relevant company, who each have their own complaints process. If the complaint cannot be resolved, complainants will be signposted to DWP’s independent complaint tier, the Independent Case Examiner (ICE). answer text <p /> <p /> <p>The Department operates a discretionary special payment scheme. The policy and guiding principles of the scheme are described in <a href="https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/309964/financial-redress-maladministration-apr-14.pdf" target="_blank">Financial Redress for Maladministration</a> which is available on Gov.UK.</p><p> </p><p>Employment and Support Allowance claimants will normally be in receipt of benefit while they wait for their assessment and any arrears due are paid once a decision is made.</p><p><strong> </strong></p><p>By the autumn, we expect no one to be waiting for a Personal Independence Payment assessment for longer than 26 weeks. By the end of the year, we expect no one will be waiting longer than 16 weeks.</p><p><strong> </strong></p><p>Any delays experienced in the Personal Independence Payment new claims process will not affect the date from which claimants are paid – all successful claims will be paid from the date the claim was initially made.</p>
