answer text

The Ministry of Justice records spend on catering but not at the level of detail which allows spend on take-away food to be isolated if this had occurred. Under the Department’s Gifts and Hospitality Policy, any requests for spend of this nature would need to be supported by a business case which would need to be cleared by the Director General Finance.

Since 2010, spend on hospitality has fallen significantly. Reasons for this include measures taken to ban lunches, teas and coffees for internal meetings. Any such refreshments for meetings with external stakeholders are only provided in exceptional circumstances and require sign of from a Director General. The department has also put in place a block on Government Procurement Cards preventing payments to bars and restaurants.
more like this

answer text
Section 22 of the Welsh Language Act states that in any legal proceedings in Wales, the Welsh language may be spoken by any party, witness or other person who desires to use it. The act does not establish the right to use Welsh in court hearings outside Wales. However, HMCTS’ Welsh Language Scheme allows judicial discretion to decide on whether evidence can be presented in Welsh for hearings taking place in England. If permission is granted HMCTS “will arrange translation facilities as readily and freely as they do in courts in Wales”.
more like this

The smaller Executive Agencies (Office of the Public Guardian, Criminal Injuries Compensations Authority) have not been included. answer text

When it came to power this Government made a priority of controlling legal costs which had become unsustainably high. We made changes to the law on how ‘no win, no fee’ conditional fee agreements (CFAs) operate, following recommendations by Lord Justice Jackson. The CFA reforms in Part 2 of the Legal Aid, Sentencing and Punishment of Offenders (LASPO) Act 2012 were delayed for insolvency cases until April 2015, to allow parties sufficient time to prepare for and adapt to the changes.

In April 2011 the Government published an Impact Assessment in relation to the reforms set out in Part 2 of the LASPO Act. It explained that there may be a reduction in the number of cases brought where no win no fee CFAs are used, but overall the LASPO reforms should make costs more proportionate.
more like this

answer text

Civil legal aid is available to help victims of human trafficking in relation to applications for leave to enter or remain in the UK, and also for claims for damages or under employment law brought by victims of human trafficking arising in connection with their exploitation. These services are set out in paragraph 32 of Schedule 1 to the Legal Aid, Sentencing and Punishment of Offenders Act 2012. Victims of human trafficking are also able to apply for any other civil legal aid service for which they are eligible.

The Legal Aid Agency does not routinely collect information on the circumstances of applicants for legal aid, except where this is directly relevant to the application. This includes whether or not applicants are victims of human trafficking, which was not relevant to any legal aid applications before the introduction of LASPO or for services other than those described under paragraph 32 of Schedule 1 to LASPO since. Data is being collected on services provided under paragraph 32, but due to the length of time it takes for cases to conclude, we do not have a clear picture of funding since implementation of LASPO. As a result, it is not possible accurately to estimate the total cost of enabling victims of human trafficking to access legal aid for the period requested.
