answer text <p>People who have a Universal Credit claim but their award is nulled (received a nil award) during the qualifying period will not be entitled to a Cost of Living Payment.</p><p> </p><p>The DWP has published an Impact Assessment of the 2023/24 Cost of Living Payments which is available <a href="https://publications.parliament.uk/pa/bills/cbill/58-03/0244/SocSec(AdditionalPayments)IA.pdf" target="_blank">here.</a></p><p> </p><p>During the qualifying period for the first 2022/23 Cost of Living Payment of £326, an estimated 7,000 households received a nil award due to sanctions.</p><p> </p><p>People are only sanctioned if they fail, without good reason, to meet the conditions they agreed to. 97.6% of sanctions in the quarter to October 2022 were applied for failing to attend a mandatory appointment at a Jobcentre.</p><p> </p><p>These sanctions can often be resolved quickly by claimants getting in touch and attending their next appointment. If someone with no Universal Credit award due to a sanction re-engages with us they may get one of the later Cost of Living Payments.</p><p> </p><p>We will be delivering the means-tested cost of living payments in three separate payments in 2023/24, reducing the chances of someone missing out altogether.</p><p> </p>

answer text <p>DWP has recently moved to a new data platform to store and process data. During our live running process an issue was identified with the availability of software required to process Universal Credit full service (UCFS) sanction decisions data. This is currently being investigated and we aim to reinstate the decisions measure as soon as possible. We expect to provide a further update in late March 2022.</p> more like this

answer text <p>No assessment has been made of the (a) rate of Universal Credit sanctions on claimants who have a mental health condition and (b) effect of those sanctions on those people.</p><p> </p><p>We engage on an individual level with all of our claimants and are committed to tailoring support to their individual needs. This includes agreeing realistic and structured steps to encourage claimants into, or closer to, work, where appropriate. These conditionality requirements are regularly reviewed to ensure that they remain appropriate for the claimant. This would include tailoring to reflect any mental health issues the claimant raised.</p><p> </p><p>When considering whether a sanction is appropriate, a Decision Maker will take the claimant’s individual circumstances, including any health conditions or disabilities and any evidence of good reason, into account before deciding whether a sanction is warranted.</p> more like this

Claimants will not be asked to do anything unreasonable in light of the impact of their health condition, and any work related requirements will be compatible with public health guidelines.</p><p> </p><p>Where a claimant has failed to meet their requirements, we will look at any evidence of good reason, including individual circumstances and health considerations, such as shielding, when considering if a sanction is warranted.</p><p> </p><p>An equality analysis has been undertaken by the Department for Work and Pensions on the reinstatement of conditionality across affected benefits, and provided to the Secretary of State so she can fulfil her Public Sector Equality Duty (PSED) responsibilities. The reintroduction of conditionality and sanctions represents a return to business as usual and not a change in policy which requires direct consultation. The operation of these policies are reviewed on an ongoing basis through consultation with stakeholders.</p><p> </p>
