Any worker who is concerned that they have not been paid the minimum wage should call the Pay and Work Rights Helpline on 0800 917 2368. HMRC respond to every complaint.</p><p> </p><p> </p><p> </p>

answer text <p>Since 1 April 2014, the lowest paid contracted staff at the Department for Business, Innovation and Skills (BIS) offices across the UK have been paid £7.85 per hour, up £1.40 or nearly 22% from the previous £6.45 per hour rate. This increase restored and surpassed the real value of wages that had fallen in recent years. This means that BIS contractors are amongst the top 25% of contractors across Whitehall.</p><p> </p><p> </p><p> </p><p>We absolutely encourage suppliers to pay above the National Minimum Wage where affordable and without cutting jobs - but this is a decision that must be taken by the suppliers themselves. We will always award contracts on the basis of the best value for money for the taxpayer most often following a competitive process, making use of the Crown Commercial Frameworks to ensure a consistent application with the rest of Government.</p><p> </p> more like this

answer text <p>276 Notices of Underpayment have been issued by HMRC since 1 October 2013 where the investigation started on or after that date. All of these cases will be considered for naming under the revised BIS naming scheme. We have already named 92 employers under the new scheme and we will name more soon.</p><p> </p><p> </p><p> </p><p>After the Notice of Underpayment is issued, employers have 28 days to pay back the arrears they owe and the penalty, or they can lodge an appeal against the NOU. HMRC then issue a case closure letter. From the date of that letter, the employer has 14 days to make a representation to BIS as to why they should not be named.</p><p> </p><p> </p><p> </p><p>Any worker who is concerned that they have not been paid the minimum wage should call the Pay and Work Rights Helpline on 0800 917 2368.</p><p> </p> more like this

answer text <p>The term “intern” is not defined in any legislation: entitlement to the minimum wage depends on whether or not an individual is a worker. If an internship meets the legal definition of a worker, then they must be paid at least the minimum wage from the start.</p><p> </p><p> </p><p> </p><p>Given this dependency on employment status, it is vital that employers and workers understand how this is determined. We continue to carry out targeted awareness raising initiatives with interns and HMRC have been working with employers to identify potential non-compliance.</p><p> </p><p> </p><p> </p><p>Complaints from interns about non-payment of the minimum wage are prioritised by HMRC for investigation and HMRC will investigate every complaint made to the Pay and Work Rights Helpline. Any worker who believes that they are being paid below the minimum wage should call the helpline on 0800 917 2368.</p><p> </p><p> </p><p> </p><p>Determining an individual’s employment status can be complicated. This is why the Business Secretary announced a review of employment status in October this year, to help ensure an employment status framework in the UK that meets the needs of everyone. This is an internal review and will present findings to ministers early next year.</p><p> </p>

answer text <p>There is no reliable estimate of the total income lost each year as a result of non-compliance with the National Minimum Wage.</p><p> </p><p>Office for National Statistics estimates of the Annual Survey of Hours and Earnings (ASHE) show that there were 236,000 jobs with pay less than the NMW held by employees aged 16 and over in April 2014. This constituted 0.9% of UK employee jobs.</p><p> </p><p>However, although it is our best measure of earnings, ASHE is not a complete measure of non-compliance as, for example, it does not account for employers making authorised deductions for accommodation.</p><p> </p><p>Calculating the income lost would require more assumptions to be made about the level of underpayment for individual jobs and would be significantly less robust.</p><p> </p><p>We have increased the resources available for enforcement, strengthening HMRC’s capacity to investigate complaints and target employers where the likelihood of non-compliance is highest. We have also increased the sanctions for non-compliance. Employers will face a maximum penalty of £20,000 per worker and will be publicly named and shamed. Any worker who feels they are not getting what they are due can call the Pay and Work Rights Helpline on 0800 917 2368.</p><p> </p><p> </p><p> </p>
