answer text <p>There are no current plans to undertake an assessment of the financial effect implementation of the General Data Protection Regulation (GDPR) may have on the National Health Service.</p><p> </p><p>However, the impact of the GDPR’s potential impact on general practitioner practices has been raised as part of the General Medical Services contract negotiations which are currently on-going. Negotiations are confidential and neither we, nor the General Practitioner Committee, comment on the content of negotiations as it may prejudice the outcome.</p> more like this

answer text <p>General practitioner (GP) Registration forms currently ask if the patient has been a serving member of the armed forces, their address before listing, service or personnel number and enlistment date. Plans are in place to widen the question to also ask if a patient was a regular, reservist or service family member. This can then be recorded and logged on the GP IT system using Read and SNOMED Codes.</p><p> </p><p>Further work is ongoing to increase awareness of the Armed Forces Covenant within the NHS, such as the Royal College of General Practitioners (RCGP) Accreditation programme (over 90 GP practices in the pilot area of the West Midlands) and Veterans Covenant Hospital Alliance, improved e-learning packages and it also forms part of the curriculum for all GPs nationally and is tested in the RCGP membership exam.</p> more like this

answer text <p>NHS England and NHS Digital (formerly the Health and Social Care Information Centre) work together to ensure the data required to operate the National Health Service is collected and made available where required.</p><p> </p><p>NHS Digital shares data for secondary purposes with customers through its Data Access Request Service (DARS) and NHS England applies for data from NHS Digital through this service.</p><p> </p><p>NHS Digital continues to deliver a significant programme of work to further improve the efficiency of this service and this includes:</p><p> </p><p>- Delivering a more streamlined approvals process;</p><p>- Implementing revised governance in line with the Data Protection Act 2018;</p><p>- Increasing the number of datasets available through DARS; and</p><p>- Making datasets available through a new secure on-line service.</p> more like this

answer text <p>The Government has not made any assessment of the financial effect on the National Health Service of the introduction of the General Data Protection Regulation (GDPR).</p><p> </p><p>The GDPR came into effect on 25 May, replacing the Data Protection Act 1998. Its provisions form legal obligations that must be observed. The right of access plays a central role in the GDPR. This updates similar provisions, known as Subject Access Requests, that were available within the Data Protection Act 1998, giving individuals the right to obtain a copy of their personal data, including, from a health perspective, copies of medical records.</p><p> </p><p>Previously, under the Data Protection Act 1998, organisations were able to make a charge for dealing with the administration required in such a request. Under the GDPR, the ability, in law, to levy such charges has been removed in most cases. This is a blanket requirement of the GDPR, applicable to all businesses and public authorities which was subject to the collective agreement of all European Union member states. There has been no assessment made on the cost of dealing with such requests.</p>

answer text <p>Professional bodies emphasise the importance of appropriate knowledge, skills and behaviours in the education and training of health professionals. This includes the accurate recording, maintenance and retrieval of patient records as a key part of providing quality and safe care and to support effective and efficient management of the healthcare system.</p><p> </p><p>Employers will also ensure that their employees have undertaken relevant training in information governance and data protection.</p><p> </p><p>The General Data Protection Regulation (GDPR) came into effect on 25 May 2018, replacing the Data Protection Act (DPA) 1998. Its provisions form legal obligations that must be observed. The right of access plays a central role in the GDPR. This updates similar provisions, known as Subject Access Requests, that were available within the DPA 1998.</p><p> </p><p>The GDPR provides that the usual time limit for responding to right of access requests (within one month) may be extended by two further months where necessary, taking into account the complexity and the number of the requests and providing an explanation is given to the data subject within a month of receiving the request.</p><p> </p><p>NHS Digital holds important patient information, created from general practitioner medical records, in the Summary Care Record system. It can be seen and used by authorised staff in other areas of the health and care system involved in the patient's direct care. This information is already stored in a suitable format and therefore no changes have been required to support timely response to subject access requests.</p>
