Offenders released early on ECSL are subject to a standard supervision licence which is designed to enable the Probation Service to manage the risk that offenders may pose on release from prison and to safeguard public protection. The recall process is the same for those released on ECSL and other standard releases.</p><p> </p><p>The decision to recall an offender on licensed supervision is taken on the professional advice of senior probation staff following consideration of safe alternatives to recall. Where offenders are recalled, it is because they present a risk of serious harm to the public and the controls available are no longer sufficient to keep the public safe. These individuals will remain in prison for only as long as necessary to protect the public. answer	answer is ministerial correction date of answer 10/01/2024 answer text <p>The Government is committed to delivering a strengthened and consistent Out of Court Disposals framework in England and Wales through the reformed two-tier cautions framework set out in the Police, Crime, Sentencing, and Courts Act 2022. We are continuing to work towards implementing it effectively.</p><p> </p><p>Our draft Code of Practice, covering the use, administration, and scrutiny of the revised framework of the Diversionary and Community Cautions, was put to public consultation from 2 August to 13 October 2023. We are analysing the responses received to inform any necessary revisions to the draft Code of Practice and we will publish a Government response to the consultation in due course. Referees are approached for shortlisted candidates.</p><p> </p><p>Candidates are also asked to declare when they apply and again if interviewed, if they have any potential conflicts of interest, or any issues in their history which if they were appointed, may bring the appointment into disrepute, particularly in the context of meeting the Principles of Public Life. The Principles form part of the Code of Conduct for Board Members of Public Bodies, which candidates are informed they will need to adhere to. answer	answer is ministerial correction date of answer 03/07/2018 answer text <p>The Government is committed to bringing the Guardianship (Missing Persons) Act 2017 into force as soon as possible. This depends upon the creation of the necessary secondary legislation and administrative systems in the courts and the Office of the Public Guardian to define and support the working of the new procedure.</p><p> </p><p>The officials responsible for the implementation of the guardianship legislation work on a wide range of subjects, but the delay in the drafting of the secondary legislation is primarily due to work on the reform of the law relating to the personal injury discount rate. The Civil Liability Bill, which will implement this reform, was passed by the House of Lords on 27 June and introduced into the House of Commons on 28 June.
