In 2016 we gave local authorities the power to issue fixed penalty notices for small scale fly-tipping and enhanced local authorities’ ability to search and seize the vehicles of suspected fly-tippers. In January this year, we introduced further financial penalties to crack down on fly-tipping giving local authorities the power to issue penalties of up to £400 to householders who fail to pass their waste to a licensed carrier and whose waste is then found fly-tipped. We will also support local authorities in increasing householders’ awareness of their duty of care to ensure their waste is disposed of appropriately.</p><p> </p><p>In our Resources and Waste Strategy for England, we have <del class="ministerial">included</del> <ins class="ministerial">committed to develop a</ins> fly-tipping toolkit which will cover how local authorities can set up and run an effective fly-tipping partnership and how to present robust cases to court to ensure tougher penalties. We have given local authorities the power to issue fixed penalty notices for small scale fly-tipping and enhanced local authorities’ and the Environment Agency’s ability to search and seize the vehicles of suspected fly-tippers.</p><p> </p><p>Earlier this year we consulted on giving local authorities and the Environment Agency the power to issue fixed penalty notices to householders who fail in their duty of care and pass their waste to fly-tippers. A further announcement will follow later this year. We will also support local authorities in raising householders’ awareness of their duty of care and update the Waste Duty of Care Code of Practice to better inform householders about how to ensure their waste is disposed of properly.</p><p> </p><p>As part of the Government’s Resource and Waste Strategy (due to be published before the end of the year), we are developing a strategic approach to waste crime. We have recently strengthened these powers by introducing fixed penalty notices for small scale fly-tipping and enhancing the ability of local authorities to search and seize vehicles of suspected fly-tippers. The NFTPG has published guidance which sets out clearly the powers available to local authorities when tackling fly-tipping.</p><p>Earlier this year we consulted on proposals to introduce a new fixed penalty for householders who pass their waste to a fly-tipper. We also intend to provide updated guidance for householders about how to ensure their waste is disposed of correctly. Subject to Parliamentary approval, we will seek to implement the changes later this year.
