The agreement that we have reached on citizens’ rights is the only way of fully protecting the rights of all citizens.</p><p>The Prime Minister has been clear that EU citizens resident in the UK by the 29 March will be able to stay and have their rights protected. The Withdrawal Agreement ensures that the UK’s membership of the EU, and the CJEU’s jurisdiction in the UK, is wound down in a sensible and orderly way. In keeping with this, and in the interests of ensuring citizens’ rights are interpreted consistently, the UK has agreed that a very narrow group of issues will be able to be referred to the CJEU for an interpretation, having due regard to whether relevant case law already exists.</p><p>For questions that relate to the settled status of EU citizens, UK courts will be able to refer questions of interpretation to the CJEU eight years from exit day, because settled status applications will be made from exit day. answer	answer is ministerial correction date of answer 04/01/2019 answer text <p>The UK Government currently does not plan to pay the Settled Status Fee for its non-UK EU citizen employees. The fee is set at an affordable rate (£65), less than the cost of a UK passport. Outsourced workers are not employees of the Department and therefore this would be a decision for their employers.</p><p>The number of non-UK EU citizens employed across the Civil Service is not consistently collected across Government. It is therefore not possible to estimate the cost of paying the settled status fee for non-UK EU nationals employed directly by the department.</p><p>We value the significant contribution made by EU citizens working in the Civil Service and we want these colleagues to continue to play a full role in the work of the Civil Service. We are committed to supporting our EU citizen employees across the Civil Service; the important engagement with EU national networks across government will continue over the coming months.</p><p>The Government has confirmed that, in a no deal scenario, the EU Settlement Scheme will continue to be implemented, enabling EU citizens and their family members living in the UK by 29 March 2019 to secure their status and continue to be able to work, study, and access benefits and services in the UK. Most recently, DExEU Secretary of State, Steve Barclay, and I met the Chief Minister of Gibraltar, Fabian Picardo, on 5 December, and the Prime Minister met him on 15 November. We also meet regularly in the Joint Ministerial Council, our primary forum for engagement, which has met seven times since the referendum.</p><p>Chief Minister Picardo observed in his statement on 23 October that we have worked “hand in glove” throughout the negotiations on Withdrawal. This broadly means equal access for workers and the self-employed and limited access for those not working. This confirms EU citizens resident in the UK by 29 March 2019 will be able to work, study, and access benefits and services as now and that. The Home Office will continue to run the EU Settlement Scheme, with no changes to the basis for qualifying under the scheme.</p><p>This demonstrates the UK Government’s ongoing commitment to citizens and removes any ambiguity over their future.</p><p>We are calling for EU Member States to offer the same protections to UK nationals in the EU. Some countries have committed already to do so, and we hope others will do the same shortly.
