These alternatives are the Messaging Exchange for Social Care and Health, the Data Landing Platform and the Strategic Data Collection Service.</p><p> </p><p>NHS Digital is advising users on the most suitable alternative service for their needs and supporting transition. A timescale must be agreed with the complainant at an initial meeting, or if the complainant declines this meeting, the National Health Service body must write to the complainant informing them of how long the complaint will take to be investigated.</p><p> </p><p>If a complainant is unhappy with their complaint outcome or a delay in the NHS responding they have the right to approach the Health Service Ombudsman and ask them to investigate. Plans are in place to widen the question to also ask if a patient was a regular, reservist or service family member. answer	answer is ministerial correction date of answer 24/07/2018 answer text <p>The Government has not made any assessment of the financial effect on the National Health Service of the introduction of the General Data Protection Regulation (GDPR).</p><p> </p><p>The GDPR came into effect on 25 May, replacing the Data Protection Act 1998. Its provisions form legal obligations that must be observed. The right of access plays a central role in the GDPR. This updates similar provisions, known as Subject Access Requests, that were available within the Data Protection Act 1998, giving individuals the right to obtain a copy of their personal data, including, from a health perspective, copies of medical records.</p><p> </p><p>Previously, under the Data Protection Act 1998, organisations were able to make a charge for dealing with the administration required in such a request. Under the GDPR, the ability, in law, to levy such charges has been removed in most cases. This is a blanket requirement of the GDPR, applicable to all businesses and public authorities which was subject to the collective agreement of all European Union member states. This includes the accurate recording, maintenance and retrieval of patient records as a key part of providing quality and safe care and to support effective and efficient management of the healthcare system.</p><p> </p><p>Employers will also ensure that their employees have undertaken relevant training in information governance and data protection.</p><p> </p><p>The General Data Protection Regulation (GDPR) came into effect on 25 May 2018, replacing the Data Protection Act (DPA) 1998. Its provisions form legal obligations that must be observed. The right of access plays a central role in the GDPR. This updates similar provisions, known as Subject Access Requests, that were available within the DPA 1998.</p><p> </p><p>The GDPR provides that the usual time limit for responding to right of access requests (within one month) may be extended by two further months where necessary, taking into account the complexity and the number of the requests and providing an explanation is given to the data subject within a month of receiving the request.</p><p> </p><p>NHS Digital holds important patient information, created from general practitioner medical records, in the Summary Care Record system. It can be seen and used by authorised staff in other areas of the health and care system involved in the patient's direct care.
