answer text <p>Statutory guidance is issued under section 113B(4A) of the Police Act 1997 in order to assist chief officers of police in making decisions to provide relevant non-conviction information and other intelligence from local police records for inclusion in enhanced Disclosure and Barring Service certificates. The Home Office introduced the first edition of this guidance on 10 September 2012 and the most recent revision came into force on 10 August 2015.</p> more like this

answer text <p>Registered/Umbrella Bodies are governed by a Code of Practice, set out in Part V of the Police Act 1997, which includes the handling of personal data. Failure to comply with the Code of Practice may result in the suspension or cancellation of the umbrella body’s registration. In addition the Disclosure and Barring Service undertakes robust checks to ensure that its authorised Registered/Umbrella Bodies have appropriate safeguards in place to protect the personal data of people they are representing.</p> more like this

answer text <p>The operational performance plans of police disclosure units are matters for Chief Constables in association with Police and Crime Commissioners.</p><p>The DBS regularly publishes detailed datasets showing statistics against internal performance standards which form the basis of its monthly reports to the Home Office. This includes performance against their target to issue 95% of all disclosures within 56 days and the number of disclosure applications in progress each month. This can be accessed here: https://www.gov.uk/government/statistics/dbs-dataset-1-disclosure-progress-information-disclosed-and-update-service-subscriptions.</p><p>DBS also publishes datasets showing statistics against service level agreements with police forces. answer text <p>The Disclosure and Barring Service (DBS) offers an Update Service which can deliver savings in both time and costs. With the certificate holder’s permission, a potential employer or another person with a legitimate interest can check via a DBS online portal whether any new information has been recorded since the certificate was issued. Only if there has been a change is there any need for the individual to obtain a new certificate. This enables portability of certificates between organisations. It is only applicable where the certificate holder is moving within the same workforce – such as work with children or work with vulnerable adults. Where the person is moving between workforces a new certificate will be required, as there may be different factors affecting decisions about whether information is appropriate for disclosure.</p> more like this

answer text <p>The average processing time for disclosure applications is 15.3 days and 94.3% of applications are issued within 8 weeks, as of December 2015. Some Enhanced Certificate applications are referred to relevant police forces. DBS is working closely with the small number of forces whose performance does not meet turnaround targets.</p> more like this

answer text <p>The oldest uncompleted application for an enhanced Disclosure and Barring Service (DBS) certificate was received on 30 May 2014.</p><p>It would not be appropriate to comment further on this specific case. But there are a number of factors which can affect the timely completion of checks. These include the length of time it can take for an employer to deal with the initial application, the accurate completion of the application form, the clarity of the information provided, the existence of conviction or non-conviction information and the operational effectiveness of the disclosure units of the police forces involved in the enhanced process. In some cases, forces will ask DBS to clarify some details provided by the applicant which requires further investigation and this can cause further delays.</p> more like this

answer text <p>The Disclosure and Barring Service (DBS) provides a formal monthly performance report to the Home Office and Home Office Ministers. This includes updates on the performance of police forces in meeting the Service Level Agreement (SLA) standards for the time taken to complete local disclosure checks.</p><p>The DBS monitors the performance of all police disclosure units and works closely with any force, including the Metropolitan Police Service (MPS), not meeting its targets. An MPS Gold Group is overseeing the recovery plan in place at the MPS and Home Office officials maintain a close oversight of the progress being made by assessing weekly reports and through regular attendance at the Group.</p><p>It is a priority of the MPS, DBS and the Home Office to see improvements as quickly as possible and I will continue to monitor the situation closely.</p> more like this
