answer	answer is ministerial correction date of answer 25/03/2015 answer text <p /> <p>The Ministry of Justice is mandated to encourage Small and Medium-Sized Enterprise (SME) engagement and the policy is set out by the Cabinet Office; this is a government wide agenda. SME participation is encouraged by removing barriers and making the procurement process faster and less complex. Most recently the government issued policy supporting a number of new reforms to make public procurement even more accessible to businesses, particularly SMEs. These new reforms take account of the wide consultation and engagement that the Government has undertaken with public bodies, small businesses and trade bodies over the last two years and in response to Lord Young’s recommendations to Government in his report ‘Growing Your Business’ (May 2013). These reforms are implemented in Part 4 of the new Public Contracts Regulations 2015, and have been embedded into MoJ procurement processes.</p><p>Secondly the Social Values Act must be taken into consideration. Contractors are sourced via Pan Government contractual arrangements and rates are set by the contract in line with contractors experience and the job role required. Contractors are not able to charge more for their services than the initial price agreed at time of appointment. Pan Government arrangements date back to 1/4/11 and no information prior to this date is available.</p><p> </p><p>(b) Since May 2010 there have been around 70 contracts awarded by The Ministry of Justice to provide the provision of consultancy.</p><p> </p><p>To establish whether a consultancy company have charged more than the initial price agreed for their services we would need to interrogate both the files and companies to obtain the information required and then review and collate that information. Please note this figure can vary between points in time as forecast contract value at award can be more or less than actual contract value as the contract progresses - this means contracts could fall into, or drop out of, the parameters specified above.</p><p> </p><p>The Ministry of Justice cannot accurately provide a figure for the number of contracts it plans to let. The department will evaluate each requirement on a case by case basis before making the decision to engage with the market or continuing to deliver the service in-house.</p><p>The private sector has an important role to play in helping deliver much needed reforms. We remain committed to promoting a diverse market including public, private and voluntary sector, as well as ensuring rigorous contract management and high standards of behaviour.</p><p>We have undertaken a major review of contract management to ensure that we have in place robust and accountable systems.</p><p> </p><p> </p><p><strong> </strong></p><p><strong>B) </strong>We are unable to answer the second part of the question as doing so would incur disproportionate costs.
