answer text <p>The Commission has on-going dialogue with the Minister for the Constitution and has raised the need for a significant increase to its current maximum fine of only £20,000 per offence. This would ensure that sanctions are proportionate and provide a genuine deterrent to campaigners who may be tempted to break the UK’s political finance laws.</p><p>It continues to recommend that its investigative and sanctioning powers should be extended to include offences relating to candidate spending and donations at major elections. This would help to ensure compliance with the rules at UK-wide and other national elections, and to strengthen voters’ trust in the regulatory system.</p> more like this

answer text <p>The Political Parties, Elections and Referendums Act 2000 requires registered political parties to report cash and non-cash donations and borrowing to the Electoral Commission on a quarterly basis. Parliament made it an offence to deliver, without reasonable excuse, donation reports that are inaccurate or miss the statutory deadline. Parliament also gave the Commission investigation and sanction powers for these, and other, offences. The Commission investigates and where appropriate sanctions inaccurate or late donation reports in line with its Enforcement Policy.</p> more like this

answer text <p>The Electoral Commission has powers to impose a variable monetary penalty where it is satisfied beyond reasonable doubt that a person has committed a prescribed offence or contravention under the Political Parties, Elections and Referendums Act 2000. The Commission takes decisions on sanctions in line with its Enforcement Policy. This document was the result of a public consultation and is available on its website; I have arranged for copies to be placed in the Library.</p><p>The Commission has called for an increase to the maximum penalty it can impose on political parties and others for offences or contraventions under the political finance rules. The Commission’s view is that the current maximum fine of £20,000 per offence could be seen as a cost of doing business, and that monetary penalties should be more proportionate to the income and expenditure of larger and well-funded parties and campaigners.</p> more like this

The Commission has written to those being investigated to advise them of the initial findings. In accordance with statute they have 28 days to make further representations before final decisions are taken. answer text <p>The Electoral Commission sets performance standards for Electoral Registration Officers (EROs), relating to their duty to maintain accurate and complete electoral registers.</p><p>The Commission uses a risk-based approach to inform its monitoring of performance, and provides support and challenge to EROs as needed. It provides guidance and other resources to EROs to support them in promoting electoral registration; this includes examples of innovative tactics used by EROs to encourage applications to register to vote.</p> more like this

It is currently investigating whether Momentum, a registered non-party campaigner at the 2017 UK Parliamentary General Election, breached campaign finance rules in relation to spending.</p><p>The Commission does not comment on live investigations. answer text <p>Where the Electoral Commission is made aware of allegations of electoral fraud it advises the complainant to contact their local police force or Crimestoppers. It does not record where such advice has been provided.</p><p>Statistics reported to the Electoral Commission by police forces across the UK show that in 2017 there were 148 cases in relation to alleged electoral fraud at the UK Parliamentary General Election. There were a further 168 cases relating to other election types, and 20 cases recorded as non-election specific.</p><p>It is not possible to know which of these cases may have resulted from advice given to a complainant by the Commission.</p> more like this
