answer	answer is ministerial correction date of answer 10/06/2022 answer text <p>In the First-tier Tribunal (Special Needs and Disability) (SEND), all appeals are listed for hearing on the next available date, on receipt. If the hearing date allocated is unsuitable for whatever reason, the cancellation of the original hearing date is counted as a postponement in the SEND tribunal’s case-handling system – GAPS2. If that second hearing is cancelled and the case re-listed, that is counted as another postponement in the system. answer	answer is ministerial correction date of answer 10/06/2022 answer text <p>Under the framework established by the Legal Services Act 2007, the legal profession in England and Wales operates independently of the government. Regulation of legal services is independent of the professions and government.</p><p>Lawyers are required to follow strict procedures when transacting with sanctioned individuals. Those individuals are required to obtain a licence from the Office of Financial Sanctions Implementation to make payments for legal services, and lawyers should carefully consider whether their advice is helping the client to comply with the sanctions or is participating or facilitating a breach of those sanctions. There are severe penalties for breaches, including fines and potential imprisonment.</p><p>Legal sector regulators are looking at what can be done to further improve the enforcement of the restrictions under the current sanction and anti-money laundering regime. The Solicitors Regulation Authority (SRA) has also recently consulted on increasing its internal fining powers.</p><p>Following the SRA’s consultation on financial penalties, my right hon. Friend, the Deputy Prime Minister, has sought the views of the Law Society, SRA and Legal Services Board on increasing the SRA’s maximum internal fine amount from £2,000 to £25,000, with the view of enhancing the SRA’s enforcement powers to create a stronger deterrent to solicitor misconduct. answer	answer is ministerial correction date of answer 06/06/2022 answer text <p>The number of prisoners who were held on untried remand for alleged fraud and the length of time those prisoners were held on remand, in each prison in England and Wales, as at 30 June in each of the last five years, is shown in the attached tables.</p><p>The Bail Act 1976 provides a presumption in favour of bail, which recognises that a person should not be deprived of their liberty unless necessary for the protection of the public or the delivery of justice.</p><p>It is the courts that decide on a case-by-case basis whether a defendant presents such a bail risk as to warrant custody. Bail can only be refused where there is justification, as prescribed in Schedule 1 to the Bail Act, such as substantial grounds for believing that the defendant, would abscond, commit further offences, interfere with witnesses or otherwise obstruct the course of justice.</p><p>The Government is committed to supporting the recovery of the courts and we continue to take action to tackle the impact the pandemic has had on the system. We have extended 30 Nightingale courtrooms beyond the end of March 2022 and have again removed the limit on the number of days the Crown Court can sit this financial year. answer	answer is ministerial correction date of answer 06/06/2022 answer text <p>The Government has no current plans to conduct an audit of the presence of parasitic accessory liability in joint enterprise convictions secured before 2016.</p><p>The Ministry of Justice Court Proceedings database holds information on people who have been proceeded against, found guilty and sentenced for specific criminal offences in England and Wales (i.e. murder, manslaughter, etc).
