answer	answer is ministerial correction date of answer 19/03/2019 answer text <p>The Government is committed to a fair and humane immigration policy which welcomes and celebrates people here legally, and which distinguishes effectively between those with lawful status and those here illegally.</p><p>In common with other comparable countries, the UK has in place a framework of laws, policies and administrative arrangements, ensuring access to work benefits and services is permitted for those with the right access to them. The term “hostile environment” is not used to describe these policies and does not reflect our values. Key measures were the subject of public consultations and/or impact assessments before they were introduced. These policies already incorporate important safeguards, including the ability to exercise discretion where there are genuine barriers to persons leaving the UK or there are exceptional compassionate factors.</p><p>We are considering further options to evaluate the impact of controls on work, benefits and services.</p><p>My Rt hon Friend, the Home Secretary has already announced that he will review the structures and processes of the immigration system to ensure that we can deliver a future system in a way that is fair and humane. <br>We are considering the form and timing of the review, but it will need to build on the lessons learnt from the Lessons Learned review, which is be-ing led by Wendy Williams and is seeking to establish how members of the Windrush generation became entangled with immigration measures designed to tackle illegal immigration.</p> answering member printed Baroness Williams of Trafford question first answered 19/03/2019 15:21:00 answering member 4311 label Biography information for Baroness Williams of Trafford

answer	answer is ministerial correction date of answer 23/07/2018 answer text <p>The Home Office completed the checks to ensure that no one has had a study restriction imposed, as part of their bail restrictions, inappropriately, by 31 May. Furthermore, the Home Office has implemented ongoing safeguards to ensure that study restrictions are only imposed where appropriate.We do not hold detailed information on all categories of persons who were incorrectly given this restriction, but the largest category of cases were asylum seekers who had not exhausted their appeal rights.</p><p>Provisional management information indicates that over 4,000 people have had their bail restriction on study varied in May 2018, although it should be noted that it is not possible to distinguish the exact nature of the variation that was applied to their bail conditions. answer	answer is ministerial correction date of answer 18/07/2018 answer text <p>The public expects us to enforce immigration laws approved by Parliament as a matter of fairness to those who abide by the rules.</p><p>Successive Governments have brought forward measures to tackle illegal migration and prevent the misuse of public services and benefits.</p><p>It is right, however, that we understand the impact of those measures; that they are meeting our aim to deter immigration offending, and, vitally, that safeguards are effective in ensuring they are not capturing those who are entitled to access work, benefits and services in the UK. We recognise the need to put in place evaluation to do this, and will consider options in due course. In light of Windrush, we are also reviewing our safeguards.</p><p>The Home Office has also announced a Windrush lessons learned review. answer	answer is ministerial correction date of answer 13/07/2018 answer text <p>In line with the <em>Surinder Singh</em> caselaw, except where the family members are EU citizens exercising Treaty rights, the spouses and civil partners of UK nationals have EU law residence rights in the UK only in limited circumstances. This is where they have resided together as family members in another EU Member State where the UK national was genuinely exercising their Treaty rights, before returning to the UK. This provision does not extend to durable partners.</p><p>Although not covered by the Withdrawal Agreement, it is our intention that spouses and civil partners of UK nationals who have genuinely exercised their free movement rights in another EU Member State before returning to the UK before the end of the implementation period, on 31 December 2020, will also be eligible to apply to the EU Settlement Scheme.
