It is important that these decisions are, and are seen to be, free from political and Government influence.</p><p> </p><p>Legal aid can be provided, if the matter or issue in question is within scope of the legal aid scheme, as defined in the Legal Aid, Sentencing and Punishment of Offenders Act 2012 (LASPO).</p><p> </p><p>Legal aid is available for advice and assistance for all inquests, subject to a means and merits test. 	answer	answer is ministerial correction date of answer 08/07/2019 answer text <p>The Government’s first ever cross-government Victims Strategy outlines our commitments to victims of crime.</p><p> </p><p>The Crown Prosecution Service is responsible for the prosecution of criminal cases. Victims of crime are not separately represented in criminal trials.</p><p> </p><p>Victims of historic sexual abuse have access to an independent sexual violence adviser (ISVA). The ISVA’s role is to ensure the victim receives the right support before, during and after legal proceedings. As part of proceedings, a victim may be called to give evidence as a witness for the prosecution. ISVAs will work alongside the Court-Based Witness Service to support the victim to give their best evidence and participate in the court process.</p><p> </p><p>In April this year, the Ministry of Justice awarded £8m in funding to rape support centres to provide emotional and practical support to victims of sexual violence and historic sexual abuse, including the provision of ISVA services. 	answer	answer is ministerial correction date of answer 08/07/2019 answer text <p>The Ministry of Justice recognises that there is a high level of postponements in the Special Educational Needs and Disability jurisdiction of the First-tier Tribunal (“the SEND Tribunal”). Statistics show that 77% of cases listed for hearing in 2018/19 were postponed, compared with 76% in 2017/18. The number of postponements (2,900 in 2018/19) is due to two factors. 	answer	answer is ministerial correction date of answer 29/07/2019 answer text <p>The purpose of the statutory Criminal Injuries Compensation Scheme is to make compensatory awards to individual persons who have sustained a serious physical and/or mental injury as a direct result of a violent crime, and to family members of those killed. Businesses impacted by the Manchester Bombing of 22 May 2017 do not fall under the ambit of the Criminal Injuries Compensation Scheme 2012.</p><p> </p><p>Crimes of violence for the purposes of the Scheme include physical and sexual assault, acts of a violent nature that cause physical injury, and threats against a person causing fear of immediate violence (in circumstances which would cause a person of reasonable firmness to be put in such fear).</p><p> </p><p>The Scheme provides for awards based upon a tariff of serious physical and mental injuries. The aim of the pilots, when they begin, will be to develop an evidence base for how we might reduce the numbers of women entering and re-entering custody for short periods.</p><p> </p><p>We want to make sure the models we take forward are sustainable, scalable and appropriate for the local context of each site. We have recently concluded our first phase of consultation with stakeholders, partners and providers to inform our scoping. We will continue to consult with partners as we refine the design and delivery of the pilot.</p><p> </p><p>We are currently reflecting on the findings from our scoping work to develop a delivery plan for the pilots. 	answer	answer is ministerial correction date of answer 25/06/2019 answer text <p>We have specifically protected legal aid, both for initial advice and representation, subject to the statutory means and merits tests, for civil legal services provided in relation to contravention of the Equality Act 2010.</p><p> </p><p>Publicly funded advice continues to be available for Employment Tribunal discrimination claims, and publicly funded advice and representation is available in the Employment Appeal Tribunal, and the civil courts more generally.</p><p> </p><p>Our Legal Aid Support Action Plan, published in February, has also committed to improving the access victims of discrimination have to state-funded legal representation.
