star this property answer text <p>The Crown Prosecution Service (CPS) is committed to ensuring that assaults against prison officers are dealt with robustly. The CPS considers each case on its own facts and in accordance with the two stage test set out in the Code for Crown Prosecutors.The Code outlines that a prosecution is more likely to be in the public interest if the offence was committed against a person serving the public. Furthermore, the specific CPS Legal Guidance on Prison Offences outlines that, if the victim is a prison officer performing his/her duty, the public interest is heavily in favour of prosecution.</p><p>In addition to this, the new joint protocol produced by the Prison Service, CPS and Association of Chief Police Officers will set out that when there are serious assaults on prison staff, the perpetrators will be prosecuted unless there is a good reason why not.</p> more like this

star this property answer text <p>Supply teachers are able to participate in the Teachers' Pension Scheme (TPS) where they are employed by an ‘accepted employer'. In the main, these are local authorities (LAs), academies and further education colleges. This includes supply teachers who are recruited by a supply agency but then employed directly, under a contract of employment, by the accepted employer. The LA, academy or further education college is responsible for meeting a number of obligations that fall to employers under the teachers' pensions regulations, not least of which is to pay the employer contribution to the TPS.</p><p> </p><p>However, where supply teachers are self-employed or remain employed by the supply agency, and their services are provided under a ‘contract for services', it is not possible for them to participate in the TPS. This is because the Department for Education cannot mandate that private sector employers participate in the scheme.</p><p> </p><p>It is for LAs, academies and further education colleges to determine how supply teachers are employed – which can in turn enable access to the TPS under the current arrangements.</p>

star this property answer text <p>Healthwatch England, and the local Healthwatch network, have an important role in the health and care system. They ensure the patient voice is heard nationally and locally and this includes how it feels to make a complaint about your healthcare as set out in <em>Suffering in Silence</em>. Local Healthwatch also signpost people to advice and support in making a complaint.</p><p> </p><p> </p><p> </p><p>There are legislative requirements in place which set out an overall framework on how complaints about health and care services should be handled. In response to <em>Hard Truths</em>, we initiated a wide-ranging programme of work dedicated to improving complaints handling involving stakeholders from across the health and care system. Healthwatch England is a key contributor to this work.
