unstar this property answer text <p>Superfast contracts include a take-up clawback mechanism to ensure public subsidies within the Superfast infrastructure are kept to a minimum. Clawback is generated over a 7 year period following completion of build implementation, based on customer take-up of service. Current estimates project take-up clawback to be at least £712m over this 7 year period. Some of this clawback has been returned early by agreement with the suppliers, and this is being reinvested.</p> more like this

unstar this property answer text <p>The Government's Future Telecoms Infrastructure Review, published in July 2018, set out that greater transparency of build plans, particularly those of Openreach, might have a positive impact on the commercial rollout of full-fibre broadband networks. It also committed the government, as first step, to discussing with BT and Ofcom how such transparency measures might be introduced.</p><p> </p><p>Since the FTIR was published, Government has held discussions with Openreach about the transparency of its build plans. On 28th January Openreach voluntarily published a list of towns and cities where it is building or intends to start deploying full fibre in the next 12 months. It also published information for the 14 locations that it had already announced, including a list of specific exchanges where it has already built, where it is currently building and where it intends to start building in the next 3 months. Openreach plans to update this information on a quarterly basis, including for the 11 new towns and cities once this information is available. unstar this property answer text <p>The Government’s Future Telecoms Infrastructure Review considered different policy and regulatory approaches that would help create the right conditions to accelerate fibre investment and extend coverage across the whole of the UK. The review concluded that the most effective way to deliver this was to promote competition between fibre networks where possible, supported by changes in the regulatory framework and only intervene in a small proportion of the country that can not support commercial investment.</p> more like this

unstar this property answer text <p>a) In life contractual reporting is required from all suppliers during build. This includes quarterly financial reporting on all spend to deliver the contract, including supplier contribution. Each payment request from the supplier must include supporting evidence that the costs are genuine and comply with the contractual definition of qualifying expenditure before payment can be made.</p><p>Once build has completed and been signed off by the contracting authority, all of the costs declared over the life of the build, including those funded by the supplier, are reviewed and compared to the contract baseline to confirm their eligibility against the contract. At this point, the final supplier contribution is established and agreed.</p><p> </p><p>b) Suppliers are required to periodically report on actual take-up against forecast, and therefore any associated take-up clawback, during the build and for a defined period after build has complete.</p> more like this

unstar this property answer text <p>The Department does not hold this information. BT gainshare/clawback was built into all of the Superfast contracts. This has been re-invested into a number of recent Superfast contracts and change requests. However those contracts and change requests also included a blend of other funding from BDUK, Local Bodies, Suppliers, ERDF and EAFRD. Furthermore in many cases those contracts have consisted of a mixture of Fibre to the Cabinet and Fibre to the Premise. Therefore it is difficult to determine a one to one correlation between clawback and Full Fibre connections.</p> more like this

A number of these contracts are still in delivery and expected to generate efficiency savings. unstar this property answer text <p>The 2017 Digital Strategy set out that Government would work with regulators and industry to ensure that the advertising of broadband reflects the speeds that consumers can expect to receive and accurately describes the technology used.</p><p> </p><p>Since the Digital Strategy was published, the ASA has implemented new guidance, which states that speed claims should be based on the download speeds available to at least 50% of customers at peak time, and no longer on 'up to' speeds available to at least 10% of customers. Ofcom has also updated its Code of Practice on Broadband Speeds.</p><p> </p><p>The ASA also reviewed the use of the term ‘fibre’ to describe part-fibre and full-fibre broadband and concluded in November 2017 that the term 'fibre' is unlikely to mislead consumers as currently used in the advertising of part-fibre broadband services. In June, the Administrative Court granted CityFibre permission to proceed with its Judicial Review (JR) of the ASA's decision. The next stage is for the Administrative Court to make a substantive decision on the JR.</p><p> </p><p>The Government remains committed to working with regulators and industry to ensure that consumers receive clear, concise and accurate information in order to make informed choices about their broadband, particularly as the rollout of new technologies like full fibre broadband increases.</p>
