star this property answer text <p>The number of offenders (including young people) cautioned, for offences of rape, sexual assault, robbery and burglary, by months in England and Wales from 2010 to 2013 (latest available) can be viewed in the table. There were no cautions administered for murder.</p><p><del class="ministerial">Simple cautions (previously police cautions) are a non-statutory disposal available to the police to dispose of any offence committed by an adult and designed for dealing with low level, mainly first time offending. The Government does not believe that cautions are appropriate for serious offences. We issued new guidelines on 14 November 2014 following a detailed review of how cautions were being used by police forces, and are strengthening the law to prevent cautions being used for serious offences.</del></p><p> </p><p>The Ministry of Justice issues guidance on the process to be followed by the police and the CPS when they are administering simple cautions for adult offenders. This guidance states that the use of a simple caution for indictable only offences, such as rape, should only be given following authorisation by the CPS. These will be cases where there were exceptional circumstances which would mean that it was not in the public interest to prosecute.</p><p> </p><p>The overall number of simple cautions issued has halved since 2007. The cautioning rate, that is, the number of offenders cautioned as a percentage of offenders who were either cautioned or convicted, in 2013 was 20 per cent; this has declined from a peak of 31 per cent in 2007.</p><p>The Government is clear that serious offences should always be brought to court and to ensure that there is increased public confidence in the justice system last year announced limits on the use of simple cautions. These changes restrict the use of cautions for indictable only offences and certain serious either way offences unless there are exceptional circumstances and a senior police officer, as well as the CPS for certain cases, has agreed that a caution should be administered.</p><p>The MOJ guidance on Adult Simple Cautions was amended in November last year to reflect these changes, and we are currently legislating in the Criminal Justice and Courts Bill to place statutory restrictions around their use.</p><p> </p>

star this property answer text <p> </p><p> </p><p>The information requested in parts (a) and (b) of the question is set out in Tables 1 and 2 below for 2009-10, 2010-11 and 2011-12, which are the last three years for which this information was collected.</p><p> </p><p>The information requested in part (c) was provided in my earlier answer to the right honourable Member for Tooting on 6 June 2013: (<a href="http://www.publications.parliament.uk/pa/cm201314/cmhansrd/cm130606/text/130606w0003.htm#13060674001141" target="_blank">http://www.publications.parliament.uk/pa/cm201314/cmhansrd/cm130606/text/130606w0003.htm#13060674001141</a>).</p><p> </p><p>Figures have been drawn from administrative IT systems, which, as with any large scale recording system, are subject to possible errors with data entry and processing.</p><p> </p><p>Purposeful activity was formerly a performance indicator for prisons, but was discontinued at the start of 2012-13. The indicator was not used in the day-to-day management of prisons and NOMS had concerns over the burden on the frontline of collecting the information. Indicators introduced into prison SLAs in respect of rehabilitation, resettlement and work in prisons provide a better demonstration of the efforts to equip prisoners to be less likely to offend on release.</p><p> </p><p>Work in prisons is a key priority to ensure prisoners are engaged purposefully whilst they are in custody. It also gives them the opportunity to learn skills and a work ethic which can increase their chances of finding employment on release, a key element to reducing reoffending.</p><p> </p><p>The number of prisoners working in industrial activity in public sector prisons increased from around 8,600 in 2010-11 to around 9,700 in 2012-13. This delivered an increase in the total hours worked in industrial activities from 10.6 million hours to 13.1 million hours. The average hours per week spent in education has increased since 2010.</p><p> </p><p>In addition there are substantial numbers of prisoners who work to keep prisons running on tasks such as cooking, serving meals, maintenance and cleaning.</p><p> </p><p>Our reforms to the Incentives and Earned Privileges national policy framework came into effect in adult prisons on 1 November 2013. Information on the number of officers serving on detached duty before the introduction of the national scheme is not available. The full-time equivalent of officers provided on detached duty from the beginning of the nationally co-ordinated scheme until the 31 December 2013 is contained in the table below. Some allocations outside of the national scheme continued after October 2013 but is not included in the information provided. London region particularly allocated staff within their own region. Information collected on the staffing allocated. On occasions the resource is not actually deployed due to changes in local circumstances.</p><p> </p><p>The deployment of staff between prisons on detached duty is a regular and normal part of prison resourcing. It allows staff to be allocated from prisons with the capacity to provide them, to those where additional staffing is required. On average over the three month period (October to December 2013), less than 1% of staff were provided on detached duty. A large proportion of the capacity was available from prisons that were in the process of closure or going through a re-role. In order to establish the number of recorded confiscations or possessions for the period in question would require the interrogation of over 30,000 individual electronic incident files. This could only be achieved at disproportionate cost.</p><p> </p> more like this

star this property answer text <p>NOMS takes the issue of assaults very seriously. It currently has systems in place to deal with perpetrators quickly and robustly, with serious incidents referred to the police for prosecution. star this property answer text <p>We are opening up delivery of probation services to a diverse range of new organisations in order to tackle repeat reoffending which blights our communities. As part of our reforms, we will extend post-release supervision to offenders released from custodial sentences of less than 12 months. We plan to commence the relevant provisions of the Offender Rehabilitation Act 2014 at the point when ownership of the new Community Rehabilitation Companies (CRCs) transfers to successful bidders. We will do this in line with the Government's commitment to roll out these important reforms by 2015.</p> more like this

star this property answer text <p>During their initial training prison officers learn how to identify and respond to a prisoner exhibiting signs of distress or a change in their normal behaviour. Prison staff also receive training in assessing and managing offenders' risk of harm, including the risk of harm from others.</p><p> </p><p>Officers receive training about prevention of violence in prisons and to complement this, specific training about sexual violence will be included in the revised Prison Officer Entry Level Training (POELT) course which will be introduced from January 2015.</p><p> </p> more like this
