Friend the Secretary of State for Business, Energy and Industrial Strategy has responsibility for intellectual property and regularly receives a wide range of representations about rights across the intellectual property spectrum.</p><p> </p><p>In the case of a trade mark application for a band name, the application would be examined in accordance with the Trade Mark Act 1994 and the Trade Mark Rules 2008. Any trade mark applications including the name of a famous individual or group would be considered in line with Section 3(6) of the Trade Marks Act 1994, which states that a trade mark shall not be registered if or to the extent that the application is made in bad faith. Anyone can oppose the registration of a trade mark once it has been published after examination through the Intellectual Property Office’s low-cost tribunal service. The government also provides a specialised Intellectual Property Enterprise Court to provide access to justice at an affordable cost for SMEs and entrepreneurs. This court has streamlined procedures, a limit on legal costs and a cap on damages. 	answer	answer is ministerial correction date of answer 11/07/2019 answer text <p>As referenced in the answer to Question 264735, where an application is made to register a trade mark, the application is examined in accordance with the Trade Mark Act 1994 and Rules 2008.</p><p> </p><p>For trade mark applications that consist of the name of a well-known band, the examiner will consider the application based on the facts of the application before them and Section 3(6) of the Trade Marks Act 1994 will be considered. Section 3(6) of the Act states that a trade mark shall not be registered if or to the extent that the application has been made in bad faith. In addition to this, every trade mark application is published, before it is registered, <strong>for an opposition period of up to three months.</strong> During this period, anyone can oppose the registration of a trade mark including where a third party believes that an application has been filed in bad faith - where, for example, facts not visible or apparent to the examiner are known by that third party. 	answer	answer is ministerial correction date of answer 06/06/2019 answer text <p>In the UK, the Phone-paid Services Authority (PSA) regulates Premium Rate Services (PRS), which include premium rate text services. Providers of PRS must comply with the PSA Code of Practice which is approved by Ofcom, which includes specific protections for vulnerable consumers.</p><p> </p><p>The PSA has the power to take robust enforcement action against companies that breach their Code. In serious cases, the PSA Code Adjudication Tribunal may impose sanctions which can include ordering refunds to be paid to affected consumers, prohibition of the provider from providing services and fines of up to £250,000 for each breach of the Code.</p><p> </p><p>The PSA has recently consulted on draft proposals to strengthen the regulation of phone-paid services offered on a subscription basis. The PSA considered risks to consumers as part of the consultation including the specific risk of harm to vulnerable consumers. We have reformed entertainment licensing and planning policy guidance, making it easier for well-established music and cultural venues to operate. Government has confirmed that it will work with all Mayoral Combined Authorities and Local Enterprise Partnerships (LEPs) to develop Local Industrial Strategies, which are locally-led and agreed with Government. The national Industrial Strategy provides a policy framework against which Local Industrial Strategies will be assessed. That review resulted in several new appointments which ensure that all creative industries are adequately represented. Under the new Terms of Reference, all members are appointed for (renewable) three year terms, providing the basis for ongoing review. By design the CIC is made up of leading figureheads of industry, who are able to drive industry lead approaches to the issues discussed in the meetings. They are experts in their field who are well able to champion their respective workforces.</p><p> </p><p>The review also took into account the need to ensure that the diversity of the creative industries workforce was represented on the council.
