star this property answer text <p>HM Revenue and Customs (HMRC) has been consulting representative bodies through the Valuation Fiscal Forum over the last 18 months.</p><p> </p><p>HMRC has not withdrawn valuation services that are most relevant to employee share ownership schemes but has withdrawn valuation checks for income tax and PAYE as in most cases acceptable valuations were submitted and therefore, on a cost-benefit analysis, continuation of the service could no longer be justified.</p><p> </p><p>As HMRC has not withdrawn valuation services that are most relevant to employee share ownership schemes it is not intended to commission independent research on the potential effect of those valuation services being withdrawn.</p><p> </p><p>HMRC does not plan to withdraw the valuation check service for Chattels. Procedures remain unchanged from those outlined at the Chattels Valuation Fiscal Forum 2010 and, most recently, 2014.</p> more like this

star this property answer text <p>HM Revenue &amp; Customs (HMRC) will treat Accelerated Payments as a debt like any other, so HMRC will be able to use their normal considerations and flexibilities in cases of genuine hardship. HMRC will consider alternative payment arrangements as they do with any debt. The priority in cases of genuine hardship will be to get people onto a payment track so that the debt is paid as quickly as possible.</p><p> </p><p>It would be complex and costly to assess the ability of all those due an Accelerated Payment notice to pay the notice in advance of issuing it. It also risks creating a rigid approach that does not provide the flexibility to treat individual cases on their own terms.</p><p> </p><p>HMRC will equally be able to use their full range of debt collection powers as necessary to recover what is owed by the taxpayer, including insolvency powers in the most extreme cases.</p><p> </p><p> </p><p>HMRC will always ensure that its action is proportionate and the particular action will always depend on the precise facts and circumstances of the particular taxpayer.</p>

star this property answer text <p>Between March 2010 and April 2014, decisions were handed down by the courts and tribunals in 124 tax avoidance cases litigated by HM Revenue and Customs (HMRC). HMRC was successful in winning all or some points in 101of these. Many of these cases involved several taxpayers, and concerned marketed avoidance schemes used by many more. The following table sets out the number of litigation cases that have been decided upon and the number of cases where HMRC has been successful on some or all points in the years 2010/11 to 2013/14.
