star this property answer text <p>Defra has routinely met environmental stakeholders since the introduction of the Retained EU Law (Revocation and Reform) Bill to sight them on developments as the Bill passes through Parliament. Defra will continue to engage stakeholders as it takes steps to create laws and regulations in the interests of the UK. Defra is committed to engaging with stakeholders to ensure policy decisions are well-informed and result in benefits for both citizens and business.</p><p> </p><p>Defra is in the process of analysing its REUL stock to determine what should be preserved as part of domestic law, and what should be repealed, or amended. In reviewing retained EU law, Defra’s aim is to ensure that environmental law is fit for purpose and able to drive improved environmental outcomes, whilst also ensuring regulators can deliver efficiently. This will ensure the UK regulatory framework is appropriate and tailored to the UK.</p> more like this

star this property answer text <p>The Government is committed to leaving the environment in a better state than we found it and has been clear that we will realise the benefits of leaving the EU, including implementing new ways of delivering better levels of environmental protection. The Government continuously looks for opportunities to improve the effectiveness of environmental protections and has already brought forward a number of measures to drive forward standards and to help assess the adequacy of environmental legislation in future.</p><p> </p><p>For example, the Environment Bill sets a new legal foundation for Government action to improve the environment and is part of the wider Government response to the clear and scientific case for a step-change in environmental protection and recovery. As part of the provisions in the Bill, the Government must have an Environmental Improvement Plan which sets out the steps it intends to take to improve the environment and review it at least every five years. The 25 Year Environment Plan will be adopted as the first statutory Environmental Improvement Plan (EIP) in the Environment Bill.</p><p> </p><p>The Bill also establishes a new, independent statutory body - the Office for Environmental Protection (OEP) - which will have a statutory duty to monitor and report on the Government's progress in improving the natural environment in accordance with the EIP. The OEP’s annual report may provide recommendations on how to improve progress towards meeting targets or environmental improvement, to which Government must respond.</p><p>In many cases, we will be going further than the EU. For example, the approach taken in the Environment Bill towards environmental principles goes further than the EU by ensuring that Ministers across Government are obliged to consider the principles in all policy development where it impacts the environment. Through the Bill’s targets framework, we are seeking to develop a comprehensive suite of targets across the entire natural environment which is novel and not something developed at an EU level. The OEP’s enforcement powers are different from those of the European Commission, as the OEP will be able to liaise directly with the public body in question to investigate and resolve alleged serious breaches of environmental law in a more targeted and timely manner.</p>

star this property answer text <p>It has not been necessary to carry out such an assessment. The Retained EU Law (Revocation and Reform) Act 2023 will only remove from the UK statute book pieces of Retained EU Law (REUL) specifically cited in the revocation schedule. These are being removed because they are obsolete, expired, duplicated, no longer relevant to the UK, or have been superseded by new legislation. The Government remains fully committed to upholding environmental standards. Ministers made commitments at all stages of the Bill’s passage not to reduce environmental standards and protections. Since the start of November Ministers have had a legal duty to have due regard to the environmental principles policy statement under the Environment Act 2021 when making policies using the REUL Act’s powers. This Government uses expert advice, including that of many independent experts, when making provisions that relate to the environment.</p> more like this

star this property answer text <p>No. Regulations 9 and 10 of the National Emission Ceilings Regulations concern the National Air Pollution Control Programme (NAPCP). The NAPCP was a bureaucratic process that does nothing to improve the air we breathe. Its content is a duplication of material contained, in a more accessible format, in national policy statements including the EIP for England which sets out our actual delivery plan to improve the air we breathe. When we consulted on the NAPCP of those who expressed an opinion, a majority agreed that the format of the NAPCP could be improved, with a consensus that the format was too lengthy and too technical. With this in mind, we are considering how we can simplify the process to reduce administrative burdens and improve transparency.</p> more like this

star this property answer text <p>Nature is in need of our help, so HM Government has set a legally binding target to halt its decline by 2030. In March this year, we published the Nature Recovery Green Paper setting out our proposals to reform our system of protections to better support this ambitious work, including the Habitats Regulations. The Green Paper is available <a href="https://consult.defra.gov.uk/nature-recovery-green-paper/nature-recovery-green-paper/" target="_blank">here</a>.</p><p> </p><p>Our proposals seek to create a system that better reflects the latest science and impending impacts of climate change, our domestic species and habitats, and helps us to achieve our significant goals to recover nature.</p><p> </p><p>The Nature Recovery Green Paper consultation closed on 11th May and we are now in the process of analysing responses. HM Government will publish a formal response in due course.</p> more like this
