star this property answer text <p>The Government is committed to supporting parents with moving into work and, as part of this, we have increased the level of ongoing financial support for childcare costs from 70 per cent in legacy benefits to up to 85 per cent in Universal Credit, which is called the ‘childcare element’. The Universal Credit childcare policy aligns with the wider government childcare offer, which includes free childcare hours and tax free childcare. This offer means that reasonable childcare costs should not form a barrier to work.</p><p> </p><p>Beyond the Universal Credit childcare element, there is other financial support to help with childcare costs: the Flexible Support Fund and Budgeting Advances. Claimants are able to discuss eligibility for these with their jobcentre work coach.</p><p> </p><p>Where initial upfront childcare costs or deposits may prevent a claimant from starting work, work coaches have the discretion to use the Flexible Support Fund to support the transition into work until a claimant receives their first wage. Individual claimant circumstances are considered each time assistance may be appropriate.</p><p> </p><p>A budgeting advance can help with one-off urgent financial events for Universal Credit claimants, such as upfront childcare, and is repayable over a period of up to 12 monthly instalments. Only one Budgeting Advance will be paid at a time and further advances will be unavailable until the balance of the previous Budgeting Advance is cleared.</p><p> </p><p>The Department is working hard to ensure that the Universal Credit childcare offer continues to operate effectively for claimants. Since February 2018, Universal Credit claimants have been able to upload digital copies of their childcare cost receipts or invoices through their online Universal Credit account. When parents have good reason for late reporting of their childcare costs, the Department is piloting a more flexible approach to enable parents to be reimbursed at a later point.</p>

star this property answer text <p>The Department maintains guidance for its work coaches surrounding the eligibility and processes for awarding discretionary support to assist with claimants’ upfront childcare costs for those claiming Universal Credit.</p><p> </p><p>There are two discretionary sources of financial support to help with childcare costs: The Flexible Support Fund and Universal Credit Budgeting Advances. Claimants are able to discuss eligibility for these with their jobcentre work coach.</p><p> </p><p>Budgeting Advances provide valuable access to interest free payments for one-off items. They are designed to help claimants with irregular expenses including upfront childcare costs. Budgeting Advance payments are discretionary subject to eligibility conditions and must be repaid. Work coaches also have the discretion to use the Flexible Support Fund to support the transition into work until a claimant receives their first wage and is not repayable. Individual claimant circumstances are considered each time assistance may be appropriate.</p><p> </p><p>The Department deposits guidance to the House’s library on a range of Universal Credits topics including the below. star this property answer text <p>Work Coaches can use the Flexible Support Fund (FSF) to pay 100% of the upfront childcare costs up to the payment limits set that the claimant incurs between starting work and receiving their first wage. This is paid directly to the childcare providers and is not repayable. Examples of what it can be used to cover include:</p><p> </p><ul><li>Deposit – To pay a provider a one off advance payment of childcare costs.</li><li>Retainer – To pay a provider a one off advance payment to secure the nursery provision prior to the parent starting work or training.</li><li>Fees – To pay a provider upfront childcare fees in advance of the service being delivered; and</li><li>Taster/Settling in periods – To pay a provider a one off advance payment to enable the parent to prepare their child before taking up the full childcare offer.</li></ul><p> </p><p>Once a claimant has received their first wage, we have given Work Coaches the flexibility to use Budgeting Advances to help pay for further upfront childcare costs where required and where a claimant is eligible. This includes - during school holidays, change of childcare provider, or additional childcare in order to increase work hours. Budgeting Advances do have to be repaid, however, up to 85% of these childcare costs can be reimbursed through the UC childcare offer (up to caps) once a paid receipt is submitted.</p>

Examples of what it can be used to cover include:</p><p> </p><ul><li>Deposit – To pay a provider a one off advance payment of childcare costs.</li><li>Retainer – To pay a provider a one off advance payment to secure the nursery provision prior to the parent starting work or training.</li><li>Fees – To pay a provider upfront childcare fees in advance of the service being delivered; and</li><li>Taster/Settling in periods – To pay a provider a one off advance payment to enable the parent to prepare their child before taking up the full childcare offer.</li></ul><p> </p><p>Once a claimant has received their first wage, we have given Work Coaches the flexibility to use Budgeting Advances to help pay for further upfront childcare costs where required and where a claimant is eligible. This includes - during school holidays, change of childcare provider, or additional childcare in order to increase work hours. Budgeting Advances do have to be repaid, however, up to 85% of these childcare costs can be reimbursed through the UC childcare offer (up to caps) once a paid receipt is submitted.</p>

star this property answer text <p>Ahead of closure Child Support Agency send customers a series of letters advising about their case closing and what they can do should they want child maintenance payments to continue. This advice includes making an advance application to the Child Maintenance Service, t o ensure there are no breaks in child maintenance.</p><p> </p><p>When the Child Support Agency case is closed, we write to non-resident parent during the stage where we are confirming the arrears position, to remind them of the amount we have worked out they owe. We advise them to contact us if they have any other relevant information which would impact this. A letter is then sent to receiving parent advising we have confirmed their balance of child maintenance. Where child maintenance is owed, we ask if the balance is correct and if they want their arrears written off or managed by Child Maintenance Service. Parents are provided with contact details to discuss their case, at all points.</p><p> </p><p>In cases where the arrears are moved to Child Maintenance Service, a letter is sent to both parties confirming their Child Support Agency case is fully closed. We also advise the unpaid child maintenance is now being managed by Child Maintenance Service. This provides the parent with the new telephone number they will need if they wish to contact Child Maintenance Service.</p><p> </p><p>Where there is a new Child Maintenance Service case, which was previously a Child Support Agency case, the calculation can change. This is because it is a fresh start under the new service, with new rules and data.</p><p> </p><p>At the outset of a Child Maintenance Service case, we issue an indicative calculation letter to the parents. This explains the new calculation, including the information used in the calculation. This provides opportunity for the non-resident parent to provide any further information that would impact the calculation. Following this we issue an initial calculation letter which confirms the calculation and the details used.</p><p> </p><p>Parents are advised they have the opportunity, throughout the application process and the life of the case as well as at annual review stage, to challenge the information used and request change.</p>

star this property answer text <p>There are no plans to introduce email as a secure method of exchanging citizen information.</p><p> </p><p>DWP’s security policy defines how we communicate with claimants using email and ensures DWP is vigilant to risks such as data breaches and data loss as well as the possible corruption of DWP’s IT systems.</p><p> </p><p>Once information leaves DWP’s secure systems there is a risk that information may be subsequently lost, manipulated or stolen. We take positive steps to minimise these and other risks, such as limiting the exchange of personal information using email.</p><p> </p><p>We do communicate with disabled claimants using email as a reasonable adjustment where this best meets their communication needs. If an organisation does not meet the criteria to be on the trusted partner list, we have an option to use software to encrypt e-mail between us and the third party which will then allow us to exchange data securely. Currently we communicate with 1100 external recipients via this method from 450 organisations. If the external agency cannot support either of the above then we would not be able to exchange information securely via email and would need to agree an alternative method with them.</p> more like this

star this property answer text <p>The Department for Work and Pensions has not undertaken a specific assessment of the affordability and adequacy of provision of childcare for parents subject to the benefit cap. As part of its evaluation of the benefit cap policy, we have commissioned the National Centre for Social Research to conduct a survey of capped households to assess the effects of the cap on claimants’ behaviours toward employment and the drivers behind different responses to the cap, which will include childcare availability and costs. We anticipate publishing the findings in the Autumn.</p><p> </p><p>The department recognises that high childcare costs can be a real barrier to parents taking up employment or increasing their working hours. To help overcome this, Universal Credit is more generous than legacy benefits in the support it provides towards childcare costs, with an increased level of support for childcare costs from 70% in legacy to up to 85% in Universal Credit.</p><p> </p><p>In addition, significant work has been undertaken within the department to raise awareness and understanding of the UC Childcare Offer amongst work coaches and work continues across Government to support take up of the different childcare offers, ensuring information is readily accessible for parents, providers and employers, including via digital channels. The Government now provides more support than ever before to help parents with the costs of childcare and will be spending a record amount of around £6 billion on childcare support in 2019-20.</p>

star this property answer text <p>In response to bringing forward legislative proposals to protect breastfeeding mothers at work, the Health and Safety Executive (HSE) is not proposing to introduce legislative changes to protect breastfeeding mothers in the workplace. Breastfeeding mothers are already protected under the Workplace (Health, Safety and Welfare) Regulations 1992 (the Workplace Regulations)</p><p> </p><p>The Workplace Regulations require employers to provide suitable rest facilities for breastfeeding mothers. Employers are also recommended to provide a private, healthy and safe environment for nursing mothers to express and store milk. Comprehensive online guidance on how employers can meet their legal requirements can be found at <a href="https://eur02.safelinks.protection.outlook.com/?url=http%3A%2F%2Fwww.hse.gov.uk%2Fmothers%2F&amp;data=02%7C01%7Cparlybranch.pqs%40beis.gov.uk%7Cd6523640efd34bf2d8b408d730890091%7Ccbac700502c143ebb497e6492d1b2dd8%7C0%7C0%7C637031237282951465&amp;sdata=cXmk3wvgYbAn72K18nJzCp2gVC%2BeKxtuVzyxlCXCEYM%3D&amp;reserved=0" target="_blank">http://www.hse.gov.uk/mothers/</a></p><p> </p><p>Research commissioned and published in 2016 by the Equality and Human Rights Commission and Department for Business, Energy and Industrial Strategy found that almost all employers said they understood their legal responsibility to ensure a safe working environment for mothers returning from maternity leave. Often where difficulties arose in terms of health and safety, it was due to poor communication and a lack of ongoing discussion between managers and new and expectant mothers. HSE has published guidance which emphasises the importance of this to help address any issues or concerns. It can be found at <a href="https://eur02.safelinks.protection.outlook.com/?url=http%3A%2F%2Fwww.hse.gov.uk%2Fpubns%2Findg373.pdf&amp;data=02%7C01%7Cparlybranch.pqs%40beis.gov.uk%7Cd6523640efd34bf2d8b408d730890091%7Ccbac700502c143ebb497e6492d1b2dd8%7C0%7C0%7C637031237282951465&amp;sdata=D063NUU8RU2o6UPt9j8P6j2%2ByaRGSuXeqLa%2F6faxvwE%3D&amp;reserved=0" target="_blank">http://www.hse.gov.uk/pubns/indg373.pdf</a></p><p><strong> </strong></p><p>On reducing the promotion of breast-milk substitutes, there is strict legislation currently in place in the form of the EU Directive (2006/141/EC) which regulates the composition, labelling and marketing of infant formulae and follow-on formulae. The Directive reflects scientific advice on the essential composition of infant formulae and follow-on formulae and discussions at an international level in the Codex Alimentarius forum. This Directive is implemented in England by the Infant Formula and Follow on Formula (England) Regulations 2007 and similar legislation applies in Scotland, Wales and Northern Ireland. The Directive also gives effect to the principles and aims of the 1981 World Health Organisation (WHO) Code on the Marketing of Breastmilk Substitutes by regulating labelling and restricting advertising and presentation of infant so as not to discourage breastfeeding.</p><p> </p><p>The new Delegated Regulation (EU) 2016/127 will apply from 22nd February 2020; as a member state, the UK Government was fully involved and committed to the introduction of the new regime within the EU. In the event of EU Exit prior to 22 February 2020, the intention is therefore to make UK-wide legislation to mirror the delegated legislation as closely as possible, and to progress with implementation of the provisions.</p>

star this property answer text <p>Legally, it is the responsibility of the customer to inform us if their address changes and as part of preparing a case we are ensuring that any outstanding change of addresses are processed. If a customer has not informed us of a change but have informed another part of DWP or HMRC then their address should have been updated on the Customer Information Service (CIS), and then we will automatically be informed and the clients record updated accordingly.</p><p> </p><p>CSA will write to both parents at the most recent address we hold for them. If this is unsuccessful, we will attempt to trace them using the trace tools available to us. Trace activity would include using any information provided by the receiving parent on the representation letter in order to find the paying parents current location.</p><p> </p><p>If, at the point of issuing a representation letter to the customer, we hold a Dead Letter Office (DLO) or No Fixed Abode (NFA) address for the customer the system suspends the representation and flags to the case worker to conduct a trace action.</p><p> </p><p>If during representation a letter is returned DLO or NFA then the caseworker is instructed by procedures to suspend the representation and complete trace action.</p><p> </p><p>If trace action is successful then the address will be updated the representation period restarted. Only if trace action is unsuccessful would we then continue to write off CSA debts.</p>

star this property answer text <p>No comparative assessment has been made between Universal Credit (UC) sanction rates and sanction rates for legacy benefits.</p><p> </p><p>There are differences between sanctions policy in UC and other benefits (such as Job Seekers Allowance (JSA)) which means that sanction rates across benefits are not directly comparable. For example, a JSA claimant would have their claim closed (rather than be sanctioned) if they failed to attend a meeting with their Work Coach, and did not make contact within five days. In UC, the same claimant would remain on the benefit and be referred for a sanction. If a sanction was applied, they would continue to receive the UC elements to which they remained entitled, such as those for housing or child costs. UC is designed to provide continuous support to claimants, ensuring that all payment does not cease while we investigate the reasons for loss of contact with a claimant.</p><p /><p>The Department publishes sanction rates quarterly for UC, JSA and Employment &amp; Support Allowance, the latest statistics can be found at the link below.</p><p><a href="https://www.gov.uk/government/statistics/benefit-sanctions-statistics-to-april-2019" target="_blank">https://www.gov.uk/government/statistics/benefit-sanctions-statistics-to-april-2019</a></p><p> </p><p>The roll out of Universal Credit is now complete and is available in every Jobcentre across the country. By 2023, all existing legacy claimants will be moved to Universal Credit.</p>

star this property answer text <p>In May 2019, 49,700 households had their Housing Benefit claim capped in Great Britain, of which 44,800 households had 2 or more dependent children. Claimants are exempt from the cap in Housing Benefit if they are entitled to Working Tax Credits. UC households are exempt if they have earnings of at least £569 per month. There are also exemptions for the most vulnerable groups such as severely disabled claimants and carers. In addition, households are exempt from the cap for 9 months (the grace period) if there is a previous consistent work history.</p><p>The average weekly cap amount for households with 2 or more dependent children deducted from the Housing Benefit award was £56 in May 2019, compared to an average cap amount of £55 for all capped households.</p><p>(Source: DWP Stat Xplore portal, ‘Benefit cap average amount by family type’ table)</p><p>In May 2019, 25,700 households had their Universal Credit claim capped in Great Britain, of which 89% (23,000) had dependent children. Statistics on the Universal Credit capped caseload, by number of dependent children in the household, will be published for the first time on the DWP Stat-Xplore portal during the w/c 9th September.</p>
